Andrew Cuomo<\/a>&nbsp;responded to a COVID massacre in nursing homes by shielding nursing home executives from lawsuits \u2014 after a health care lobby group funneled $1 million into his political machine.&nbsp;<\/p>\n\n\n\n<p>Senate Republicans in Washington then&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUMtuxCAM_Jrllii8Qnrg0Et_IyLg7NJNgPJolH59nV3LFtYw8thjTYV7zKdOsVTSCuTZOz1KPsmJOC0cvRpf5jUD7MZvuuYGJLVl89ZUH8PF50qpiTy0opxTvohl-pgmPirupFJMLMIugwW3kktlNs15CBY0_EI-YwCy6Uetqdz45419YR7H0TsUOy8-5N7GHdGEVWyMqSsQcO_ujq2NyYPrTHBdMkh2HZOOeM0GNlBMqqQYWE_7Np4DPH_kyr9vYtjvrC9tKdXY5zWeZP0XQzUUA79N3F4o3jnju7fg6zmj6rKBe1tQ35a9LqpnAh3gKBtU3PcNoi-MMjmOQhCUchHtC7r4HKv5BxJmf5w\">copied Cuomo\u2019s liability shield legislation<\/a>&nbsp;and pasted it word-for-word into their last COVID stimulus proposal in July.<\/p>\n\n\n\n<p>Unable to pass that federal liability shield legislation on its own, lawmakers from both parties have now come together in a grand show of post-election bipartisan unity to help their corporate donors create a hostage situation that\u2019s something out of a dystopian sci-fi movie: Their proposal predicates long overdue and desperately needed unemployment assistance on the condition that corporations are given a get-out-of-jail free card when their profit-maximizing business practices extinguish the lives of employees.&nbsp;<\/p>\n\n\n\n<p>Support from Democratic lawmakers for the liability shield legislation comes after the same health care lobby group that drafted New York\u2019s law has poured more than&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUMuOwyAM_JpySwTk2QOHXvY3Ih5Ow5ZAFsxG7NcvaS1btsaWxjNaIjxDLOIICUlOEBdrxDh08zATI3rDrsGmZY0Au7ROYMxAjqyc1RJt8Nd9N03TTDbBOgNr1xs10Ukbpu-r6fl95qO6j6A5JRfLIrOx4DUI-IVYggfixIZ4pFv3uPGvmud5tqaSleseYqvDXtGj1gbS4dZoGaFxQanSYLSQGgyNyqXRIR4hVk3ECk45ZTXZNPSUt6zNY6Hw-hnW7vvW0_3J25RVQqlfFwGJ4i94lKxGXcvg3mhVutS-Z2-xLOClcmA-JuDHtLcmLAcID2dygPXjD1id4YwP49j3pFKZUA30ItkYUP4DPJiBnw\">$11 million<\/a>&nbsp;into House and Senate Democratic super PACs.&nbsp;<\/p>\n\n\n\n<p>The party, though, doesn\u2019t seem to want its own voters to know the details of the deal it is cutting with the GOP: In a comically on-the-nose attempt at a bait-and-switch, Democratic Sen. But that seems like a ruse, as indicated by private equity mogul and Sen. Mitt Romney, R-Utah,, who&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJw9UNtuhCAU_Bp5NNxEfeChSbO_YRCOu7QKFo4a-_VFNykhOYeZCTMZaxCeMZ16jRnJliEN3mnViK7piNPSsWvxeZgSwGL8rDFtQNZtnL016GO49KJt24689NQY1_agmJK97DkVfOoss1xMIzcgKLlcBrM5D8GChh3SGQOQWb8Q11yJj4o_yj2Oo56MhTHG79rG5YIM2leZs9_hEonHXolPxmXx7mnfi3uruEowFSJE9FN53bNEvLSKqk4ozjilVEr-z2Ihr2-H3TuIxGtOOS0qxtpGUl6zelMnhe-fZhJflaTLk9d5GzMae6cjSf_GgIaVU2gT5xstHQ1lLlvweA4QzDiDe9eH77rvNvBcQQc48gyIkN5g6bTkbJSSkhQrF0v1QWefIpo_0VCNvg\">said<\/a>&nbsp;the federal COVID liability shield provision \u201cprovides a temporary suspension of any liability-related lawsuits, state or federal level associated with COVID-19, giving states enough time to put in place their own protections.\u201d<\/p>\n\n\n\n<p>Though full legislative language has not been released, the goal seems clear: to give state legislatures more time to&nbsp;<em>permanently<\/em>&nbsp;prevent workers from suing employers who endanger them, and to permanently block their families from mounting such lawsuits when the workers die.<\/p>\n\n\n\n<p>Notably, lawmakers announcing the proposal did not point to a spate of frivolous wrongful death lawsuits that corporations have been warning about as a rationale for the liability shield. Instead, as the watchdog group Taxpayers for Common Sense recently noted, \u201cof more than 4,100&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUEuOwyAMPU3ZNQIC-SxYzGauERFwGqYEMmAaZU4_pLUs23r-P6MRHjGdao8ZScmQJmdVJ9tBDsQqYdkVuDwtCWDTzitMBcheZu-MRhfDVd_2fT-QVc3zqAfLRt1ayq3oWMtGuQgqFjmOPTPk2jLpYh0EAwpekM4YgHi1Iu751n7d-HfV4ziatQSMQT8bE7cKQajGxJezdzbeMWnzhNSsuHniFKecsqqsl4LyhjWlOyk8f-XS_twE3R68yWXOWJuucSSpvxhQsyo1raN_o_WpqfqtBIfnBEHPHuznX_zw8z4fzx1UgCN7QIT0ASsJnHHZdUKQusrGylVQ2aWI-h9qVXhx\">COVID-19 related lawsuits filed<\/a>, only 75 are for wrongful death or injury as a result of getting sick at work. Two-thirds fall into three categories \u2014 insurance disputes, prison cases and civil rights cases, including challenging shelter-in-place orders.\u201d<\/p>\n\n\n\n<p>The liability shield legislation is not some standalone cause \u2014 it should be understood as the culmination of a much larger, long-term campaign to remove countervailing force and give capital supreme power over labor.&nbsp;<\/p>\n\n\n\n<p>Over the last few decades, the government \u2014 through legislation and court rulings \u2014 has&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUMuShCAM_JrhpsVLcQ8c9rK_YSHGGWcVXAjjul-_caQCHRIq3bR3CPeYDrvFjKxkSP082rZRXdOx0epRnMmc-ykBrG5eLKYCbCvDMnuHcwzne2WM6djDet4JMU6ya43RTgpouQL9wSflJjV4w06W3pVxhuDBwgvSEQOwxT4Qt3xTnzf5RbHve_2Kv7WPK90kFx1BS1vo8zBamU5JSp8ulFy5KfsVqly2BIQ-loRVCSSuQnD-AanaIumF6tJdZfAYE5ut5DScQphGc1mLurQHh--fZlLPm-brXda5DBmd_z7FsGT_YkAnaFHbxeVdpak94UqUePQQ3LDAeBmFl7Hvf-OxgQ2w5wUQIV1Fck8K2bSt1oyoxkgmB5vnFNH9A8S9iqg\">weakened unions<\/a>, which have used collective bargaining to protect workers rights; limited&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUcGSgyAM_Zpy01FEbQ8c9tLfcBCyli2CG0Id9-s3tkxmSB5JXnixhmBJeOgtZRIlA07e6aHvrv1VOK1cezo-T98IsBofNGEBsZU5eGvIp3jmd-M4XsVDu6G30HVwa5y1Ut3krEDNYzOOytxg7MTJMpniPEQLGl6AR4oggn4QbfnSfV3knW3f99qsgEwRZ4N1woXRBVPhJHkPnvzyJufApnX1RAD5HcRcuJDdDY0lb4Fd2bQ3vp5wVLlsCCtUNhWkCkvwcanyo1CuXNpjZYPJuTorUzyTIgEy5teKy9LLBO4jvJYN92Rrx141sm7rMhwNPH_77-7nopp1kXUucyZjnzUPKFD_pUim5cPPJoU3yipO5_glejomiGYO4D4C02chb73o2EBH2HMA_id-QFZdtrIfBqUEU7nEy4k6e0xk_gGgqaLL\">class action lawsuits<\/a>&nbsp;and&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJxlUUluwzAMfE10k-FFXnrQoZd-w6AlOlGjxdUSw319aedYgRDEETHDIRVkvId4yC2kzErCOBsth76b-olpKXRzPkya14jowFiZY0G2lcUaBdkEf9Z34zhO7CG1rieN0IppWBQsAoa1-xiJRKxC1OvKTpUZijboFUp8YTyCR2blI-ct3brPW_tFse97dTdLCl4X7ysVHIGFJ57KFtEhV6HEnLhGZRL1wK1xhvL8QA4uFJ95WPlWvMnmhVyDgzsmDi8yAItFXrzGyFekGyyxOXeSwM7B6ytFT3SE6YJ8i0FhSm-Ry_P19Y_eeK4sUCGoq4h6Zka2dVs3FM3Yi7qtmqoMR43Pn37tvm-idve2SmVJGdTzNMqi_A0-Q0OHviHYC6WBz2dfp-Yxoz9d6Pcu8nt312jzsaH0uCeLOWN8g7Sgtmn7YRCCkZQOtEcvk4khwx-JfbWJ\">punitive damages<\/a>, which are designed to punish corporate misbehavior; and&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUEGOwyAMfE25JQICCXvg0Mt-IyLgNmwTYMG0yr5-SWtZsjUea-yxBuEe86FTLEhqgTx7p0c5KKmI08Kxs_FlvmWA3fhNY65AUl02bw36GE7-ME2TIqt2A5hJUfWlhFiGyXFJF-a4UIO042Q4OVVmU52HYEHDE_IRA5BNr4ipXIbrhX-3xBV8QMgWEvY27g3ilNNWGH33JyfXPXWxrKZ7xfxIm7HQFXMDPDobn941DvH63GMt2SQF5T3r63hQePzK2_BzEXS_877UpaCxj1OJZP0XAxrWoo1N3N5o-3duda_B4zFDMMsG7mMFfqx7f4ZHAh3gVTbAdv4HbP5wxuU4CkGalIvNxqCLzxHNP05DgDc\">gutted<\/a>&nbsp;the Occupational Safety and Health Administration, which is supposed to enforce the weak workplace safety laws still on the books.&nbsp;<\/p>\n\n\n\n<p>Now come liability shields, laundered as a necessary COVID salve, but which are really designed to permanently remove the last remaining deterrent to corporate abuse.&nbsp;<\/p>\n\n\n\n<p>Large employers already knew that a hobbled OSHA would \u2014 at most \u2014 give them the equivalent of&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUEFywyAMfE24xQMYMD1w6KXf8GBQEloMLoh43NcXJxqNllmJWWmdRbjncpgtVyStQpmDN0qOWmrijfDsfIQ63wrAakM0WBqQrS0xOIshp3N-nKZJk4exlvlF38RIp4VqB_xDCe4Vl1zqaVo0OVVm23yA5MDAE8qRE5BoHohbvYyfF_7Vc9_3YcsxYHB5cHntVIK9duCU0w7sLFT1kuvDXl0uOdlnKK1eN0g2YoB6FVxp3pc35yfWk01SUD6woamDws-vvI3fF0HXOx9qWypa93OqkWL-ckLLevS2zfHF9pvnjmtLAY-5qywR_NsOfNv3ug6PDcy5bQREKG-ye8QZl0oJQbqUz93KZGooGe0_EqmBAQ\">a parking ticket for killing workers<\/a>. The situation is now so unregulated and so bleak that in one situation, corporate managers were&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUMuOwyAM_JpySxXI-8BhL_sbkQtOy5ZAFkyj7Nev0yLLtmasGTQGCO8xHXqLmUTJmGZndd81YzcKq1srz8XleUmIKzivKRUUW7l5Z4BcDOd9MwzDKB66q6Gf1LhAtyzDtNSIU6PqTuFo26lvrDhdZijWYTCo8YXpiAGF1w-iLV-ar4v65nJxBwObI_DW5Q3IPK4mrsyoWtU8pDzbyM3Dnoujio4cQ7VCgDumXN2QqpWlj4rRR9xP5qj2mJ4nu8fibWVioASGeHk5W8mJ5YTTp4XkkkPX1uoqr6U_anz-dkvzc2nr9a6uudwygXmenxJJ_7EQSH5MQ_RvlBOaea4lODpmDHDzaD_h0SfsdxZ0bKgD7tkjEaYPyIkqqbq-b1vBVjZy8EFnlyLBPzQNk4k\">allegedly<\/a>&nbsp;betting on the number of COVID deaths that would happen at a meatpacking plant.&nbsp;<\/p>\n\n\n\n<p>With liability shields, those same employers will know that they can get away with all kinds of cost-slashing and corner-cutting that endangers workers and&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlkE2OhCAQhU_T7DSAoPaCxWzmGgalbOlWcKhijHP6wW5SoV7qJy_1TZbgEdNp9ojEMkIavDOtbnrdM2eUE5fwOMwJYLN-NZQysD2Pq58s-Riu-abrup4tpnf9pMVdt7rtFYjpDhIaPnM5jncphWOXy2Cz8xAmMPAL6YwB2GoWoh1vzddNfpc4jqM-LC4-PCiGa6me4lYaY0YfALFIySUviatL6_JtYKk6YnpBwgrtDHRWz7HIzdMye1hdRSfGUEaZN9e6KCE6rbisRZ3bk8PrR8_N86b49pA15hHJTq_LmyXzFwNZUV5p27i-q4XDUPKWg6dzgGDHFdwHEX2Qvi-mcwcT4MAViCB9ioWbFFK3rVKsWLlY8AaDPkWy_wbqic0\">denies<\/a>&nbsp;them access to basic protective gear.&nbsp;<\/p>\n\n\n\n<p>In other words, corporations will know they can drive the COVID body count ever higher, and they won\u2019t even have to worry about being called into a courtroom to answer for their crimes.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><em>This newsletter relies on readers pitching in to support it.
