The second is known as the \u201cneutrality rule,\u201d which would require federal contractors like Amazon to remain neutral during unionization campaigns. Such a unilateral move would come with risks; executive actions are more likely to be held up in a federal court system packed with conservative, anti-union judges. But short of passing the PRO Act, such executive actions, despite their legal vulnerabilities, might offer the best opportunity to deter Amazon and other employers\u2019 efforts to block workers from unionizing.&nbsp;<\/p>\n\n\n\n<p>By jeopardizing Amazon and other union busters\u2019 access to lucrative federal contracts, a neutrality law or executive order from Biden could prompt those companies to cease the sort of&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJw1UUGOwyAMfE25NQISSnrgsJf9RuSAm6AmUIGzUfb167RahDwGezRm8EA45XK4V64kzjDQ8UKXcK8LEmERW8UyxOBupu1NL4LrgjqTWIdHQVwhLo7KhuK1jUv0QDGns7-11vZidtYjoHxo8A9_H6V6oIdeWhW88SD78aMKW4iYPDr8wXLkhGJxM9GrXtqvi_7mve97s0OdY5oop5PU-LxygdDPKS95OvigpVYMUv8HWOE3p-uWeKzrDgXnzC-67rk8sVRuENGdJNmpThkpjW1Uo7vW9B3cQ6usRRu0tOGmvJVS3y0YdenkOummbmMl8M9zEFEc6xAoXlyGvLxv2ZSBcWV9OgZMMC4YPn7Rx_S3g8OECQt_RhiAnLqpvlPaMCrz8ec01KhWSWkFy4bMrORqLJngDzyKlsU\">intense employee intimidation<\/a>&nbsp;Amazon undertook during its workers\u2019 most recent union drive. Similarly, a persuader rule could create a public-relations deterrent, by making more of a company\u2019s anti-union spending public knowledge, therefore giving union organizers and supporters more information to try to shame companies into backing off.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>\u201cGreat News For All Employers On The Union-Avoidance Front\u201d<\/strong><\/h4>\n\n\n\n<p>During the 2020 campaign, Biden promised to reverse President Donald Trump\u2019s repeal of the Obama-era persuader rule, which had been designed to address a loophole in a 60-year-old labor statute requiring that any hires made by employers for the purpose of anti-union activities be reported to the Department of Labor within thirty days of the hire. But any law firms that may have been hired to advise on anti-union tactics but did not directly interact with employees remain shielded from public view.<\/p>\n\n\n\n<p>This renders the disclosure requirement far less powerful, said Brandon Magner, a labor lawyer.&nbsp;<\/p>\n\n\n\n<p>\u201cThe vast majority of the anti-union ecosystem is inhabited by law firms who are advising employers and consulting with them,\u201d Magner told T<em>he Daily Poster<\/em>, rather than contractors directly interacting with workers, meaning the disclosure requirement often isn\u2019t triggered.<\/p>\n\n\n\n<p>In 2011, the Obama administration tried to change the dynamic by issuing a new rule expanding this disclosure requirement to require employers to disclose when they hired outside counsel to fight a unionization drive. noopener\" target=\"_blank\" An&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlkUuOwyAMhk8TlhGPENIFi5FGvUbkgNOioVCBaadz-iGthWz028biswPCSy4ve8-V2OFWet3RJnzWiERYWKtY1uDtrNWiF-bt5MVxCXXdC-INQrRUGrJ722JwQCGno14ZYxZ2tXqbxealn3cj_L6dEGCfHXDl9Y6LWz5TofmAyaHFB5ZXTsiivRLd66C-Bnnup7prjlDqGOE5thQfI_rWdXcJ3T8CPl1OhInGQ1FnKBRcxEF9C875IOd3-pe64HIrtJWAe2XBSi4Fn8QkNOfajGKUk9LLBCevhDFovOTGz8IZzuXJgBbDxG8XOda2VQL3M7p8Y8X-9edBdOtpyPGtdiRrj7eWAr1WTLBF9B9a9EH-5rdeMGHpq_ArkBWzWCYhdY9Cf-gcOLVQ_SOG9bE-965kayiZ4B9PFZaC\">amicus brief<\/a>&nbsp;submitted by 20 law professors argued that the rule was within the authority of the Department of Labor to issue and did not violate attorney-client privilege.&nbsp;<\/p>\n\n\n\n<p>If a resurrected persuader rule survived legal challenges, Magner said that it would help specifically in making unions aware of when employers were planning anti-union pushes.&nbsp;<\/p>\n\n\n\n<p>Employers \u201calways have the first-strike capability,\u201d he said. \u201cThey can call up these lawyers whenever they want, get all the advice they need, and then they\u2019re prepared\u201d for a future union drive, even if one is not currently on the horizon, Magner said.&nbsp;<\/p>\n\n\n\n<p>\u201cUnder the Department of Labor\u2019s [persuader] rule, you are taking away the advantages provided under that system,\u201d he said. \u201cThe union would have a little bit of a heads up if the employers are preparing a huge offensive.\u201d<\/p>\n\n\n\n<p>Knowing whether companies are employing anti-union law firms would also help unions shame union-busting employers, Magner added.<\/p>\n\n\n\n<p>But that hasn\u2019t happened, because so far Biden has not moved to reinstate the Obama-era rule.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Requiring Government Contractors To Stop Busting Unions<\/strong><\/h4>\n\n\n\n<p>The White House has come closer to following through on Biden\u2019s other campaign promise to implement a labor neutrality rule, which would require that companies with federal contracts remain neutral and refrain from actively combating union organizing among their employees. This measure was&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUbGO5CAM_ZqhSwQkDJmCYporrlqtro8ccDJoCURANpf7-nN2kIWfH8a2ni1UXFI-zZZKZdc11nNDE_EoAWvFzPaCefTO3FU3qIE50ztxAV_GOSOu4IOpeUe27VPwFqpP8crvtNYDexnZcYlK8kH3kxQwaNCTmx6zfci7nLl7d4XdeYwWDX5jPlNEFsyr1q3cuudN_iI7jqMtr7y2KS8UfmJJe7ZYntH9SSkU4gIuEBqIrrFp3YIHKkg0Ek7nirE2AQ4iPmDBK_-5YqaJY_M7TaX5CISOtAfXwDyjrRTkry2AxRbK9pd5I7kUvBe9UJwr3YpW9p0aeni4TmiN2kmu3V1Yzbl8aFDi1vN1kW3Zp1LBfrU0F8vmX4oVBB16hhR-WFJvJL_u0ddzxAhTQPcWtr638yP1uGDETFtzI1Qj7mLohVTkhXoLeSmvRCc414zaukS_oik-pwr_AesYpio\">included<\/a>&nbsp;in Biden\u2019s sweeping infrastructure proposal, the American Jobs Plan.<\/p>\n\n\n\n<p>If conservative Democrats maintain their opposition to ending the filibuster, Democrats will likely try to pass Biden\u2019s infrastructure plan using budget reconciliation, which allows legislation to pass under with a simple majority vote. Using the reconciliation process allows the Senate parliamentarian to advise tossing certain measures from legislation if she decides they aren\u2019t specifically budget-related, and it\u2019s easy to see that happening with the labor neutrality rule.&nbsp;<\/p>\n\n\n\n<p>Senate Democrats could overrule or replace the parliamentarian, but they&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlkMGOhCAMhp9muGkAQZwDh73saxi0ZYasgoG6xn36xbFpaVPa_Ok3O8JXyqfdUiF2PSOdG9qIR1mQCDPbC-YxgO11N-iBgVUgriKU0WfE1YXFUt6Rbfu0hNlRSPGa74wxA3tbM3k5-P5peuUBYdLoBTht-KSw54O_Vd0OAeOMFn8xnykiW-ybaCuP7ushv6sfx9FCFTuvecztnNba3WosWEqKpfE5rQ0lcGdpIKUVoUHvUyYWrORScCWU0Jxr04pWqk4Pyj2hE8agAckN9GI2nMuncVo8FF9fsi37VMjNP5ccy_YvRXKiWv12afl0691jzeseA50jRjctCDcSurl-II0vjJgrbxgdWdGLQQmpaxb6RnAx06ITnBtWZSHVrWhLyIncP75QjfU\">refused<\/a>&nbsp;to do so last month to keep a $15 minimum wage provision in their COVID-19 relief bill.&nbsp;<\/p>\n\n\n\n<p>As the ultimate overseer of federal procurement, Biden could also attempt to enact the neutrality rule through some form of executive order to fulfill his promise to \u201censure federal contracts only go to employers who sign neutrality agreements committing not to run anti-union campaigns.\u201d&nbsp;<\/p>\n\n\n\n<p>So far, he has not done that, and some labor law experts argue that such a rule would be struck down in court on the argument that it&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUUGOwyAMfE25EQGBkhw47GW_ERlwU7QEIiBbZV-_pEUWRmM8Ho0dNFxzOc2eayPXtbRzR5PwVSO2hoUcFcsSvLmrcVIT8UZ6fj1CXR4FcYMQTSsHkv2wMThoIafr_6i1nsjT3B8jE3qS8-QkcO3s3IlmOWqhAXUnek-FwwdMDg3-YjlzQhLNs7W93savm_jucUkabMx5s1jWCK_B5a3jvgs4aQSbCy2459I6GHGFSEuoP_TqqBQqtcFjonuEVOmRukpqwf2gp3vJ7ii4YWp0P-qTBCOY4ExyyRVjSg98EHJUk4TZj1xr1F4w7e_cacbErEHxm2TbKoZ62No666WNFPOXUwPeTy9Djm-027T0vHUJ7VwwgY3oPw62zxreni4rJix9PX6BZvidT5IL1TNXH8cuixUfOWOa9LE-965kaii5wT-c5p4y\">would be preempted by<\/a>&nbsp;the National Labor Relations Act.&nbsp;<\/p>\n\n\n\n<p>Short of enacting the neutrality rule, Biden could also pass an executive order mandating that the federal government only enter into contracts with companies that have collective bargaining agreements, an idea proposed by&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlkEtuxCAMhk8z7BJhEiBZsOim14gc8ExRCURAWqWnL5lYlm35od_6LFZ6pXyaPZXKrrDUcycT6bcEqpUyOwrlxTuj5DDJiTkzOrgKX5ZnJtrQB1PzQWw_1uAtVp_itT9orSf2ZSY5i6e2w6i4AkIl3DqtIECRnJ_K0a2Kh_MULRn6oXymSCyYr1r38hg-HuKzeXsp063R27S1DubqbaBWgeJC8nupc4ShC7im3O0YHW3edqt3FJk3ggvgI4wgOZe6h16Mg5xGnN0AWpN2gmunwGrOxaxRwmPk20v05VhLRft9KbNs_lKsCM3aGFN4d9trS8vbEX09F4q4BnI3mXrjfbNaXhQpN-xuwWpAwTSCkC2DvElc6CQMwLlmTdaldhVN8TlV_AcfAY2u\">labor lawyer Thomas Geoghegan<\/a>.<\/p>\n\n\n\n<p>However Biden goes about doing so, if the administration adopts any neutrality rule, it could have major implications for major employers that work with the government \u2014 and that includes Amazon.<\/p>\n\n\n\n<p>The federal government contracts with Amazon Web Services (AWS), the company\u2019s cloud computing subsidiary,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUUGO5CAMfE1zSwSENMmBw1z2G5EDng5aAi1wJsq-fp1phChTLrBV9kD4KvVy79JI3MdC1xtdxrMlJMIqjoZ1icE9x2EaJxGcCeoOYlu-K-IOMTmqB4r3sabogWLJt36w1k5ic-oZpA7rd8DVwjRbxAFAGenn2a-zMp-qcISI2aPDH6xXySiS24je7TF8PfQf3ud59rQhUIJM0fe-7MwS-i2XVF4XX6D6Lf4gR1oqwyDtLdmwC0jcZ-tgLQd1N-MjNKYhdWekrYMd_pXM6sGa56A5ENFpqZU0yqhRytH2qtdmGCcDcxiUtWiDljY8lbdS6tnCqB5G7i_dt2NtBP7v3aOojj8mULw4DSX9smzWwrgfOdK1YIY1Yfj4SJ9h_Dq7vDBj5SGFBYitVJNRemRU48e32-hRDUpKK7hsKPwquxZrIfgPaTqdHA\">mostly<\/a>&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUcuO5CAM_Jrm1hHm0SQHDnPZ34jc4EmjTaAFzkTZr18yjVAVctnYFAGZllJP_y6NxQUzn2_ymY62EjNVsTeqc4r-YfVoRxG9iXAdUpu_K9GGafVcdxLv_bmmgJxKvvK1c24UL_9ttEIZH5ONgDSRDpZGlCFa99TauE9X3GOiHMjTD9WzZBKrfzG_201_3dSfvo_jGJjCK5e1LGeln0THEMrWJSVh6gSygxw7OKvNFdmI-I4b1T5Xu_dHUeP7ltbEWM_7kjBfMv4ruSeL5JVUIA0YsFJaN8CgjLajwSlqcI5cVNLFBwQnpZocWrgZuS1qaPuzMYa_1zyi-n4fI_TVZSzrb7S7M3fe9pz4nCnjc6X4MY4_7v9aOS-UqfZfiTOyhweMBpTtDPZj1OWsBQ1SOtHbxtKrsm-pFsb_ILiXrQ\">through<\/a>&nbsp;intelligence and national security agencies. The March 2020 coronavirus-related stimulus bill that was signed by Trump included language aimed at&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/email.mg2.substack.com\/c\/eJwlUcGu4yAM_JpySwQklPTAYS_7G5EBt0WbQATOi_q-fp0UIdvCY89oCED4KvXjttJInGGmz4Yu49EWJMIq9oZ1TtHdzTCZSUQ3RnUWqc3PirhCWhzVHcW2-yUFoFTyiR-stZN4O9CAI3gw4PH-BKUtSAnG-ykG5a38ssIeE-aADn-wfkpGsbg30dZuw5-b_sv3OI5-AV9qxeUiafsWWX4fysrtUH5S7NTjLKFi6yBQx9CEz-5Zardyt6Vf7PzeUsbWGMKTHI9E7y6tW6kEmbo98-7uIsHIkBzTxcaLRXJaaiVHNSojpbG96vU4mGmERxyUtWijljbeVbBS6ocFo26jXF-6b7tvBOHfqVZU91sygeLDbSjL9cr-zZxXFkCfGTP4BePXWvr-z2X2_MKM9RQ3Azl1V9OotOGszNfK03ujBiWlFUwbC09l11ItBP8BN4apIw\">requiring<\/a>&nbsp;some corporate recipients of federal loans to remain neutral in union elections.
