The board will vote on the proposal on May 23.<\/p>\n\n\n\n<p>Peskin did so hours after San Francisco District Attorney Brooke Jenkins announced she would not press charges against Michael Earl-Wayne Anthony, the 33-year-old who shot and killed Brown after the latter was allegedly shoplifting. Anthony said he acted in self-defense during the April 27 shooting.<\/p>\n\n\n\n<p>Jenkins\u2019 office also released&nbsp;<a href=\"https:\/\/www.sfexaminer.com\/news\/crime\/banko-brown-killing-video-released-by-sf-da-brooke-jenkins\/article_b89dd652-f361-11ed-b9e8-db8e970de697.html\" target=\"_blank\" rel=\"noreferrer noopener\">video footage of the killing<\/a>, which Peskin said in a statement \u201cappears, at a minimum, to be an unjustified shooting.\u201d<\/p>\n\n\n\n<p>Supervisor Shamann Walton said in a statement he would support Peskin\u2019s resolution on Tuesday and that the footage showed that Brown, a transgender Black man, was \u201cexecuted.\u201d<\/p>\n\n\n\n<p>\u201cThis is not who we are,\u201d Peskin said in a statement. \u201cStealing a bag of candy does not warrant the death penalty. I understand people are afraid of crime, a fear being stoked by too many politicians and their political allies. But this is not a choice between justice and safety \u2014 we can have both. And allowing what appears, at a minimum, to be an unjustified shooting does not make us safer. It does not make us better. It should make us ashamed.\u201d<\/p>\n\n\n\n<p>The California Attorney General\u2019s Office told The Examiner in a statement Tuesday that it \u201cis not currently involved in the matter\u201d and suggested we reach out to the San Francisco District Attorney\u2019s Office on the case.<\/p>\n\n\n\n<p>The U.S. Department of Justice declined to comment to The Examiner.<\/p>\n\n\n\n<p>Jenkins announced on May 1 that she would not file murder charges against Anthony. She later said that this was because of a 72-hour charging deadline following Anthony\u2019s arrest.<\/p>\n\n\n\n<p>As calls from the public and politicians for her to reexamine that decision intensified,&nbsp;<a href=\"https:\/\/www.sfexaminer.com\/news\/crime\/brooke-jenkins-sf-walgreens-killing-video-cant-be-released\/article_266d8a90-ede2-11ed-abce-c7c27211776f.html\" target=\"_blank\" rel=\"noreferrer noopener\">Jenkins said she couldn\u2019t release footage<\/a>&nbsp;of Brown\u2019s death because the&nbsp;<a href=\"https:\/\/www.sfexaminer.com\/news\/crime\/sf-da-brooke-jenkins-says-walgreens-shooting-still-open-case\/article_6a4bada8-eb64-11ed-8c40-23402eaaee17.html\" target=\"_blank\" rel=\"noreferrer noopener\">case was still under investigation<\/a>. She said she would release footage if prosecutors didn\u2019t charge Anthony, a decision that was announced Monday.<\/p>\n\n\n\n<p>Peskin\u2019s resolution is not the first piece of legislative pressure on Jenkins. The board last week passed a resolution urging her to release evidence and security footage from the killing.<\/p>\n\n\n\n<p>Walton said Monday he watched the footage \u201cseveral times,\u201d during which \u201cBanko Brown was clearly walking backwards, after being thrown to the ground, punched and abused by the security guard for several seconds.\u201d<\/p>\n\n\n\n<p>\u201cThe security guard had the upper hand the entire time and even told Banko that he was letting him go, as stated in the transcript released by the DA,\u201d Walton said. \u201cWhere is the perceived threat? DA Jenkins\u2019 decision to not charge gives every armed security guard in San Francisco a license to have an open season to shoot and kill Black and transgender people for alleged shoplifting.\u201d<\/p>\n\n\n\n<p>The case is the third in recent months in which Jenkins has dropped or declined to pursue charges against an armed officer or guard in an on-duty shooting. Last week, Jenkins moved to&nbsp;<a href=\"https:\/\/www.sfgate.com\/bayarea\/article\/da-brooke-jenkins-dismisses-charges-sfpd-shooting-18094931.php\" target=\"_blank\" rel=\"noreferrer noopener\">dismiss charges against officer Christopher Flores<\/a>&nbsp;for shooting and injuring an assault suspect. In February, she&nbsp;<a href=\"https:\/\/sfstandard.com\/criminal-justice\/new-details-raise-questions-about-why-da-dropped-case-against-sf-cop\" target=\"_blank\" rel=\"noreferrer noopener\">dismissed charges against Christopher Samayoa<\/a>&nbsp;for shooting and killing a carjacking suspect in 2017.<\/p>\n\n\n\n<p>The family of Sean Moore, who died of wounds he sustained in a 2017 police shooting, has said they are&nbsp;<a href=\"https:\/\/missionlocal.org\/2023\/03\/sean-moore-medical-records-jenkins-sfpd-cha-prosecution\" target=\"_blank\" rel=\"noreferrer noopener\">worried Jenkins will drop charges<\/a>&nbsp;against Kenneth Cha.<\/p>\n\n\n\n<p>Jenkins said some of the aforementioned prosecutions were \u201cpolitically motivated\u201d under her predecessor, progressive DA Chesa Boudin, whose recall she championed last year.<\/p>\n\n\n\n<p>\u201cProsecuting police officers is not the kind of thing that\u2019s high on her agenda,\u201d John Burris, the civil rights attorney representing Banko Brown\u2019s family who says he is working on a wrongful death lawsuit, said of Jenkins\u2019 charging decisions.<\/p>\n\n\n\n<p>\u201cThose are political decisions and a political philosophy that she\u2019s adopted, and there\u2019s not much I can do about that,\u201d he said.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/www.sfexaminer.com\/users\/profile\/Marcus%20White\"><img decoding=\"async\" src=\"https:\/\/bloximages.chicago2.vip.townnews.com\/sfexaminer.com\/content\/tncms\/avatars\/a\/2e\/096\/a2e096d0-383e-11ed-8dff-03ca0c28c2ed.6e26757400633d7b219baab76e54234b.png?_dc=1665446500\" alt=\"Marcus White\"\/><\/a><\/figure>\n\n\n\n<h4 class=\"wp-block-heading\"><a href=\"https:\/\/www.sfexaminer.com\/users\/profile\/Marcus%20White\">Marcus White<\/a><\/h4>\n\n\n\n<p><em>Marcus White is a senior digital writer and producer for the San Francisco Examiner.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>San Francisco lawmakers are calling on state and federal officials to review evidence in last month\u2019s&nbsp;killing of Banko Brown&nbsp;after The City\u2019s top prosecutor&nbsp;decided not to file charges.
