IT&#8217;S UP TO US."},"content":{"rendered":"\n<p>SAT, 5\/18\/2024 &#8211; BY\u00a0<a href=\"https:\/\/www.occupy.com\/author\/carl-gibson\">CARL GIBSON<\/a> (Occupy.com)<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/www.occupy.com\/sites\/default\/files\/field\/image\/47-bars.jpg?itok=8UKLNKwA\"><img decoding=\"async\" src=\"https:\/\/www.occupy.com\/sites\/default\/files\/styles\/slide_narrow\/public\/field\/image\/47-bars.jpg?itok=8UKLNKwA\" alt=\"\"\/><\/a><\/figure>\n\n\n\n<p>It\u2019s likely that if any of us were charged with even half of the felony charges former President Donald Trump is facing, we would almost certainly be in prison by now. Trump\u2019s four indictments in three jurisdictions \u2014 both state and federal \u2014 would be virtually insurmountable for anyone other than a former commander in chief.&nbsp;<\/p>\n\n\n\n<p>The fact that Trump has still as of this writing managed to remain a free man is a testament to both his immense privilege and the inability of the justice system to meaningfully rein him in. If any of us hope to stop Donald Trump from becoming the 47th president of the United States, it will have to be done from the ballot box, not the courts.<\/p>\n\n\n\n<p>After Department of Justice special counsel Robert Hur declined to charge President Joe Biden with any crimes in his own classified documents probe, a senior adviser to former President Donald Trump complained about the \u201c<a href=\"https:\/\/thehill.com\/homenews\/campaign\/4457630-trump-senior-advisor-says-theres-two-tiered-system-of-justice\/\" target=\"_blank\" rel=\"noreferrer noopener\">two-tiered system of justice<\/a>\u201d in the United States. Jason Miller told NewsNation in February that the 45th president of the United States was a victim of \u201cselective prosecution\u201d by the DOJ, alleging that Biden was getting fairer treatment than his predecessor.<\/p>\n\n\n\n<p>But Trump remaining a free man in the face of dozens of felony indictments is a stark contrast to the case of Mark Sumrell, who was&nbsp;<a href=\"https:\/\/theappeal.org\/as-decriminalization-drives-reforms-for-marijuana-convictions-activists-see-others-serving-time-left-behind\/?fbclid=IwZXh0bgNhZW0CMTEAAR1w-GYa2ofhdU6C18QwwaxLlp7Jk7cYwCRbr0MnK7fKUyXsbkJzdSFO3MA_aem_AVhGKwPpIw_4O1mxm3pUHby-l1ZGMEiPyxaojqw3Sp2xOBPI2XG5a_2RvVryA84ezaRR05FbzP2u-80O3KBHmMI7\" target=\"_blank\" rel=\"noreferrer noopener\">imprisoned for life without parole<\/a>&nbsp;for stealing a $39 jacket from a grocery store in Mississippi more than two decades ago. Sumrell\u2019s unusually harsh sentence was due to Judge Ashley Hines sentencing him under the Magnolia State\u2019s&nbsp;<a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/ca5\/09-60461\/09-60461.0.wpd-2011-03-16.html\" target=\"_blank\" rel=\"noreferrer noopener\">habitual offender law<\/a>&nbsp;as Sumrell has two prior nonviolent felony convictions: One for a robbery in 1991, and another for cocaine possession in 1993. Even though shoplifting carries a maximum sentence of five years, Sumrell, who is in his fifties, remains in prison. His daughter, who was two at the time of his sentencing, is now fully grown.<\/p>\n\n\n\n<p>Sumrell\u2019s case proves there is absolutely a two-tiered justice system in the United States, but not in the way Jason Miller alleges. Rather, the kid-gloves treatment Trump has received from the courts up to this point is proof that wealthy, powerful, politically influential white men are able to wield their status to effectively skirt accountability in ways that ordinary people cannot. Stopping Trump is up to the voters. And motivating the most important voting constituencies to show up is up to Biden and the Democratic Party.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/www.occupy.com\/sites\/default\/files\/medialibrary\/20240506-113349-resized.JPG\"><img decoding=\"async\" src=\"https:\/\/www.occupy.com\/sites\/default\/files\/medialibrary\/20240506-113349-resized.JPG\" alt=\"\"\/><\/a><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">HOW TRUMP\u2019S MASTERY OF DELAY TRUMPED THE JUSTICE SYSTEM<\/h3>\n\n\n\n<p>For a time, it appeared as if prison was inevitable for the former president. Between Manhattan District Attorney Alvin Bragg\u2019s&nbsp;<a href=\"https:\/\/manhattanda.org\/district-attorney-bragg-announces-34-count-felony-indictment-of-former-president-donald-j-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">34-count indictment<\/a>, Department of Justice special counsel Jack Smith\u2019s&nbsp;<a href=\"https:\/\/d3i6fh83elv35t.cloudfront.net\/static\/2023\/06\/trump-indictment.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">37-count indictment<\/a>&nbsp;in the Southern District of Florida and his&nbsp;<a href=\"https:\/\/apnews.com\/trump-election-2020-indictment\" target=\"_blank\" rel=\"noreferrer noopener\">four-count indictment<\/a>&nbsp;in the District of Columbia, and the&nbsp;<a href=\"https:\/\/www.npr.org\/2024\/03\/13\/1238260873\/georgia-trump-case-solicitation-counts-dropped\" target=\"_blank\" rel=\"noreferrer noopener\">10 felony counts<\/a>&nbsp;he\u2019s facing in Fulton County, Georgia, it seemed highly unlikely that Trump would make it to the Republican National Convention as a free man, let alone the general election in November.<\/p>\n\n\n\n<p>But yet again, Trump has&nbsp;<a href=\"https:\/\/knowyourmeme.com\/memes\/id-like-to-see-ol-donny-trump-wriggle-his-way-out-of-this-jam\" target=\"_blank\" rel=\"noreferrer noopener\">wriggled his way out of nearly every jam<\/a>, just as he\u2019s done since running for office. The only legal proceeding that will conclude with a verdict before November is his ongoing criminal trial in Manhattan, which is regarded as the least egregious of the four. And even if the former president is found guilty of any single felony charge, he\u2019ll be able to stave off a prison sentence past November through the appeals process. For a man as wealthy and powerful as Trump to not be afforded plentiful time for an appeal is extremely unlikely.<\/p>\n\n\n\n<p>Earlier this month, the Georgia Court of Appeals&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/georgia-appeals-court-grants-trumps-request-consider-whether-fani-will-rcna151231?fbclid=IwZXh0bgNhZW0CMTAAAR1LXN_2FPjaCWAFqWKLUbXwXEAE1QJS8ku9kakZYR4VwVBbBvxrxTBcMOE_aem_ARId7og2YuLP7p2EKq6H47QPgg-e6AbYtPNpwa7BgfNHIeRJ5tv2n_YPuqZQFAG7XbWW5nLDVT2DPB3VEW3lnoCh\" target=\"_blank\" rel=\"noreferrer noopener\">granted Trump\u2019s request<\/a>&nbsp;to hear his appeal of Judge Scott McAfee\u2019s decision to allow Fulton County District Attorney Fani Willis to remain on the case as lead prosecutor. Attorneys representing Trump co-defendants in Willis\u2019 sprawling RICO indictment argued that her prior romantic relationship with special prosecutor Nathan Wade constituted a conflict of interest. McAfee ruled that one of the two could remain on the case, and Wade submitted his resignation to Willis the same day McAfee issued his ruling (she promptly accepted it).<\/p>\n\n\n\n<p>But now that Georgia\u2019s appellate court has agreed to hear Trump\u2019s case, this means that the Fulton County case likely won\u2019t go to trial until late 2025 at the earliest. Atlanta Journal-Constitution politics reporter Greg Bluestein told MSNBC that if the court dockets Trump\u2019s case soon, the earliest that a ruling could be expected&nbsp;<a href=\"https:\/\/www.youtube.com\/watch?v=lmNb6lk8Cps\" target=\"_blank\" rel=\"noreferrer noopener\">would be in March of 2025<\/a>. And even if that appeal doesn\u2019t go Trump\u2019s way, Judge McAfee would likely still give both sides two to three months to prepare for trial, meaning Trump won\u2019t have to worry about having to physically appear in a Georgia courtroom until the summer of next year (assuming he\u2019s not in the White House).<\/p>\n\n\n\n<p>For all his work in attempting to hold Trump accountable in the federal judiciary, Jack Smith may have nothing to show for it depending on what happens in November. The Supreme Court of the United States (SCOTUS) still has yet to issue a ruling on the ex-president\u2019s claims of absolute immunity from criminal prosecution for official acts carried out in office after hearing oral arguments in April. And a victory for Smith on that decision is uncertain, given how some of the more conservative justices appeared to take Trump lawyer John Sauer\u2019s arguments seriously.&nbsp;<\/p>\n\n\n\n<p>In an&nbsp;<a href=\"https:\/\/newrepublic.com\/article\/181032\/supreme-court-trump-immunity-sealed-fate\" target=\"_blank\" rel=\"noreferrer noopener\">article for the New Republic<\/a>, journalist Brynn Tannehill wrote that while the former president \u201cshould be going down in flames 9-0,\u201d at least five SCOTUS justices \u201cseemed to buy into the Trump team\u2019s arguments that the power of the office of the president must be protected from malicious and politicized litigation.\u201d She argued that the Court ruling in Trump\u2019s favor would effectively mean that SCOTUS will have \u201ccastrated itself,\u201d and \u201csigned its own death warrant\u201d as a decision upholding criminal immunity would signify an end to the judicial branch being able to check the power of the executive.<\/p>\n\n\n\n<p>The Court technically doesn\u2019t have to issue a ruling&nbsp;<a href=\"https:\/\/www.cbsnews.com\/news\/supreme-court-major-cases-trump-immunity-abortion-guns\/\" target=\"_blank\" rel=\"noreferrer noopener\">until its term ends in June<\/a>, and U.S. District Judge Tanya Chutkan has already indicated that once the ball is back in her court that both sides would get as many as 90 days to prepare for trial. This means that Trump might not have to face prosecution for his alleged role in the events leading up to the January 6, 2021 siege on the U.S. Capitol until September. Notably, SCOTUS has yet to rule on a separate case involving a January 6 defendant who was charged under the same statute as Trump. If the far-right Supreme Court rules in his favor \u2014 which a Reuters report&nbsp;<a href=\"https:\/\/www.reuters.com\/world\/us\/us-supreme-court-tackles-rioters-obstruction-case-with-trump-implications-2024-04-16\/\" target=\"_blank\" rel=\"noreferrer noopener\">suggested was likely<\/a>&nbsp;based on oral arguments \u2014 that could weaken Smith\u2019s indictment against Trump even further in the DC election interference case.&nbsp;<\/p>\n\n\n\n<p>And finally, the Mar-a-Lago classified documents case \u2014 which is&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2023\/06\/trump-indictment-criminal-conspiracy-charges-explained.html\" target=\"_blank\" rel=\"noreferrer noopener\">perhaps the most open-and-shut case<\/a>&nbsp;against the 45th president due to the overwhelming evidence the DOJ has accumulated \u2014 is also the least likely to happen, due to the judge overseeing it. The ex-president couldn\u2019t have gotten a better draw anywhere in the country than U.S. District Judge Aileen Cannon, who he appointed to the bench to a lifetime term in 2020. Initially, Trump was to stand trial in that case on May 20. However, Cannon has&nbsp;<a href=\"https:\/\/apnews.com\/article\/trump-trial-classified-documents-judge-cannon-6f910c3cbe8d91e493ab5fb13019d45f#:~:text=WASHINGTON%20(AP)%20%E2%80%94%20The%20federal,trial%20date%2C%20postponing%20it%20indefinitely.\" target=\"_blank\" rel=\"noreferrer noopener\">scuttled that date<\/a>, citing the backlog of eight pre-trial motions she has yet to rule on that she says may take until late July.<\/p>\n\n\n\n<p>Smith has&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/-nuclear-button-special-counsel-seek-removal-judge-trump-classified-do-rcna146507\" target=\"_blank\" rel=\"noreferrer noopener\">previously threatened<\/a>&nbsp;to petition the 11th Circuit Court of Appeals, which supervises Cannon\u2019s district, to assign a new judge to the case. But according to Syracuse University law professor Greg Germain,&nbsp;<a href=\"https:\/\/www.newsweek.com\/donald-trump-aileen-cannon-jack-smith-mar-lago-classified-documents-palm-beach-florida-1898895\" target=\"_blank\" rel=\"noreferrer noopener\">that could be easier said than done<\/a>. He told Newsweek that while there were \u201cserious questions about whether Judge Cannon was biased or incompetent,\u201d Smith was limited in his options to argue for a new judge based purely on her scheduling order. Because Cannon\u2019s decision to&nbsp;<a href=\"https:\/\/www.cnn.com\/2024\/05\/07\/politics\/judge-postpones-trump-classified-documents-trial\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">indefinitely postpone proceedings<\/a>&nbsp;was interlocutory (meaning interim or temporary), it can\u2019t be appealed. Germain added that it would be hard for Smith to win an appeal as it\u2019s \u201cvery hard to overturn a scheduling order because courts have broad control over their own calendars.\u201d<\/p>\n\n\n\n<p>\u201cTrump is a master at denial and delay,\u201d longtime Republican pollster Whit Ayres&nbsp;<a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2024-05-09\/legal-stalling-tactics-lucky-breaks-boost-trump-white-house-bid\" target=\"_blank\" rel=\"noreferrer noopener\">told Bloomberg<\/a>&nbsp;in May. \u201cHe\u2019s got a lot of experience with it, but he also has a Justice Department that\u2019s waited a long time to get serious about prosecuting [the Mar-a-Lago case].\u201d<\/p>\n\n\n\n<p>If Trump succeeds in running out the clock on his two pending federal trials and wins the election, he could escape accountability entirely if he becomes the 47th president of the United States. If he appoints a pro-Trump attorney general to oversee the DOJ, Trump could effectively ensure that his appointee dismisses both of Smith\u2019s indictments against him outright.&nbsp;<\/p>\n\n\n\n<p>Even on the off chance that a trial happens before the election and he is convicted, there would be nothing stopping Trump from&nbsp;<a href=\"https:\/\/www.law.gwu.edu\/yes-donald-trump-can-pardon-himself-it-would-be-disastrous-idea\" target=\"_blank\" rel=\"noreferrer noopener\">issuing a presidential pardon to himself<\/a>. And while presidential pardons don\u2019t extend to state-level convictions, Trump\u2019s Georgia attorneys have said that he shouldn\u2019t have to stand trial&nbsp;<a href=\"https:\/\/www.forbes.com\/sites\/anafaguy\/2023\/12\/01\/trump-attorney-georgia-trial-should-be-delayed-to-2029-if-trump-is-elected\/?sh=54300dffb543\" target=\"_blank\" rel=\"noreferrer noopener\">until his second term ends in 2029<\/a>&nbsp;if he wins the election, arguing that his duties as president supersede any action from the courts. If the ex-president wins a second term, New York authorities may have difficulty enforcing a sentence from Judge Juan Merchan if Trump is found guilty in Manhattan. It\u2019s unlikely that Governor Kathy Hochul (D) would have the stomach to force a public standoff between New York state troopers seeking to haul Trump off to prison, and U.S. Secret Service agents sworn to protect Trump outside the White House in 2025.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/www.occupy.com\/sites\/default\/files\/medialibrary\/trump-hush-money.jpg\"><img decoding=\"async\" src=\"https:\/\/www.occupy.com\/sites\/default\/files\/medialibrary\/trump-hush-money.jpg\" alt=\"\"\/><\/a><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">A TRUMP VICTORY IS A VERY REAL POSSIBILITY DEPENDING ON TURNOUT<\/h3>\n\n\n\n<p>The only way for Trump to avoid prison, and the only way for America to have any hope of the justice system prevailing against the quadruple-indicted ex-president would be for Trump to secure 270 electoral votes in November. And the Electoral College math is admittedly not great for Biden as of mid-May.&nbsp;<\/p>\n\n\n\n<p>In the&nbsp;<a href=\"https:\/\/www.nytimes.com\/2024\/05\/13\/upshot\/polling-biden-battlegrounds-senate.html?unlocked_article_code=1.rk0.NFNA.Q5oNCXE3-dew&amp;smid=url-share&amp;utm_source=newsletter&amp;utm_medium=email&amp;utm_campaign=newsletter_axiosam&amp;stream=top#_ga=2.266510606.1029634014.1715642261-133368921.1698081591\" target=\"_blank\" rel=\"noreferrer noopener\">latest New York Times\/Siena College poll<\/a>&nbsp;of both likely and registered voters in the six swing states likely to decide the 2024 Electoral College majority \u2014 Arizona, Georgia, Michigan, Nevada, Pennsylvania, and Wisconsin \u2014 Trump is leading in five of them (Biden leads among likely voters in Michigan, and among registered voters in Wisconsin). Trump\u2019s lead is largely due to defections from young voters and minority voters, particularly among the African American, Hispanic, and Arab-American demographics.<\/p>\n\n\n\n<p>Bizarrely, the poll shows that those constituencies, which are historically Democrat-leaning, still back Democrats in down-ticket races, with Senate candidates in those swing states still in front of their Republican rivals. When the&nbsp;Times\u2019 Nate Cohn dug into what\u2019s causing voters to be more enthusiastic about Democratic U.S. Senate candidates than the party\u2019s presidential candidate, Biden\u2019s handling of the ongoing humanitarian crisis in Gaza appears to be the primary cause.&nbsp;<\/p>\n\n\n\n<p>Roughly 70% of Muslim voters told the&nbsp;Times that Gaza was their chief hang-up with the president. That could prove significant in cities like Dearborn, Michigan, where a sizable portion of Muslims with Palestinian ties expressed their dissatisfaction with Biden by voting \u201cuncommitted\u201d in the Mitten State\u2019s Democratic primary.&nbsp;<a href=\"https:\/\/apnews.com\/article\/biden-uncommitted-israel-gaza-michigan-arab-eba62caeec16c00f57e3979ec61ca8bd\" target=\"_blank\" rel=\"noreferrer noopener\">More than 100,000<\/a>&nbsp;Michiganders checked that option on their primary ballot in the state Biden won&nbsp;<a href=\"https:\/\/www.politico.com\/2020-election\/results\/michigan\/\" target=\"_blank\" rel=\"noreferrer noopener\">by less than three points<\/a>&nbsp;in 2020.<\/p>\n\n\n\n<p>Voter turnout \u2014 particularly in those six states \u2014 will decide whether Biden or Trump will be in the White House for the next four years. Biden still has several more months on the calendar to barnstorm swing states and blanket airwaves with messaging&nbsp;<a href=\"https:\/\/www.cnn.com\/2024\/05\/08\/politics\/biden-wisconsin-economy-inflation\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">hyping his accomplishments<\/a>&nbsp;on both supercharging the economy and&nbsp;<a href=\"https:\/\/abcnews.go.com\/US\/us-stats-show-violent-crime-dramatically-falling-rising\/story?id=108042096\" target=\"_blank\" rel=\"noreferrer noopener\">significantly lowering crime<\/a>&nbsp;rates nationwide. But he can\u2019t simply bank on voters\u2019 fear of Trump, which is arguably already at a maximum.&nbsp;<\/p>\n\n\n\n<p>If he hopes to drive enough voter turnout to win the Electoral College, Biden has to show voters what he\u2019s for, provide a compelling vision for how he would lead America for the remainder of the decade, and get buy-in specifically from demographics where enthusiasm is waning.
