Photo by Frankie Solinsky Duryea<\/figcaption><\/figure>\n\n\n\n<p>The American Civil Liberties Union and local groups are suing U.S. Immigration and Customs Enforcement for arresting asylum-seekers outside immigration courts across Northern California and keeping them in \u201cpunitive and inhumane\u201d conditions in San Francisco holding cells.<\/p>\n\n\n\n<p>The class-action&nbsp;<a href=\"https:\/\/lccrsf.org\/wp-content\/uploads\/2025\/09\/32.pdf\">suit<\/a>, filed Sept. 18 in the U.S. District Court for the Northern District of California, alleges harsh conditions for immigrants held at&nbsp;<a href=\"https:\/\/missionlocal.org\/2025\/08\/ice-hq-in-s-f-s-financial-district-has-an-80-year-history-of-detaining-immigrants\/\">630 Sansome St.<\/a>, the ICE field office in downtown San Francisco that is a few floors below an immigration court.&nbsp;<\/p>\n\n\n\n<p>Asylum-seekers have been held there for \u201csometimes up to six days\u201d in \u201csmall, cold rooms, sometimes with hardly enough space to sit, let alone sleep,\u201d the suit alleges.\u201cThey are kept for days without basic hygiene supplies, access to bathing facilities, a change of clothes, or prescribed medications.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/newspack-missionlocal.s3.amazonaws.com\/mission\/wp-content\/uploads\/2024\/03\/mission-local-logo-300x300.jpg\" alt=\"Mission Local logo, with blue and orange lines on the shape of the Mission District\" class=\"wp-image-639216\"\/><\/figure>\n\n\n\n<p>Want the latest on the Mission and San Francisco? Sign up for our&nbsp;<strong>free daily newsletter<\/strong>&nbsp;below.Sign up<\/p>\n\n\n\n<p>The holding cells were designed for short stays, usually less than 12 hours, when immigrants arrested by ICE are waiting to be transferred to long-term detention elsewhere in California or out of state.<\/p>\n\n\n\n<p>But in June, ICE&nbsp;<a href=\"https:\/\/immpolicytracking.org\/policies\/ice-waives-the-12-hour-holding-cell-limit-allowing-detainees-to-be-held-for-72-hours\/#\/tab-policy-documents\">waived<\/a>&nbsp;its 12-hour holding limit across the country, and increased it to 72 hours. Chart by Kelly Waldron.<\/p>\n\n\n\n<p>The ACLU\u2019s suit, which was filed alongside the Lawyer\u2019s Committee for Civil Rights in San Francisco and CARECEN, is on behalf of three plaintiffs \u2014 Carmen Aracely Pablo Sequen, Martin Hernandez-Torres and Ligia Garcia \u2014 who are asylum-seekers and were all detained at 630 Sansome.<\/p>\n\n\n\n<p>The ICE field office has an&nbsp;<a href=\"https:\/\/missionlocal.org\/2025\/08\/ice-hq-in-s-f-s-financial-district-has-an-80-year-history-of-detaining-immigrants\/\">80-year history<\/a>&nbsp;of detaining immigrants, dating back to the 1940s. It has been the site of intense protests recently in which ICE agents have&nbsp;<a href=\"https:\/\/missionlocal.org\/2025\/06\/sf-protests-clash-ice-immigration-arrests\/\">swung batons<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/missionlocal.org\/2025\/08\/ice-tackles-detains-protesters\/\">tackled protesters<\/a>.<\/p>\n\n\n\n<p>The plaintiffs allege that conditions inside 630 Sansome are unconstitutional.&nbsp;<\/p>\n\n\n\n<p>The holding cells on the sixth floor of the building have \u201cno beds,\u201d and asylum seekers are \u201cforced to sleep on metal benches or directly on the floor \u2026 with nothing more than a thin plastic or foil blanket or a thin mat.\u201d<\/p>\n\n\n\n<p>The lights are on \u201cat all hours,\u201d the suit reads, and ICE keeps rooms at \u201cbitterly cold temperatures.\u201d&nbsp;<\/p>\n\n\n\n<p>\u201cDetained people are forced to sleep on filthy floors or near the dirty toilet that has been used, and will continue to be used, by the dozens of people who pass through the crowded hold room,\u201d the suit continues.<\/p>\n\n\n\n<p>\u201cImmigrants have resorted to cleaning the toilet with wads of dry toilet paper when the stench becomes unbearable.\u201d<\/p>\n\n\n\n<p>ICE also \u201cimpedes access to counsel\u201d for those in holding cells by preventing attorneys from entering after 3 p.m. or on weekends, and forcing asylum-seekers to pay for phone calls with \u201cpoor audio quality\u201d while ICE agents are in the room, listening.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/newspack-missionlocal.s3.amazonaws.com\/mission\/wp-content\/uploads\/2025\/09\/082625_MMG_SansomePrayerVigil-06-930x580.jpg\" alt=\"\" class=\"wp-image-785328\"\/><figcaption class=\"wp-element-caption\">Protesters hold up signs reading \u201cKeep families together\u201d at an interfaith prayer vigil at 630 Sansome on Aug. 26, 2025. Photo by Mariana Garcia.<\/figcaption><\/figure>\n\n\n\n<p>The suit also challenges President Donald Trump\u2019s decision to discard decades of precedent by allowing courthouse arrests, which were previously discouraged, except in cases involving individuals who posed a risk to public safety.<\/p>\n\n\n\n<p>Now, asylum-seekers, most of whom have no criminal record, attend court and are arrested in the hallways.&nbsp;<\/p>\n\n\n\n<p>\u201cMasked federal agents lurk outside of courtrooms, violently ambush immigrants, shackle their hands and feet, and immediately whisk them away to detention,\u201d the suit reads.<\/p>\n\n\n\n<p><em>Mission Local<\/em>&nbsp;has documented&nbsp;<a href=\"https:\/\/missionlocal.org\/2025\/09\/ice-arrest-federal-ruling\/\">dozens<\/a>&nbsp;<a href=\"https:\/\/missionlocal.org\/2025\/09\/ice-arrests-another-7-at-s-f-immigration-court-2-without-lawyers\/\">of such<\/a>&nbsp;<a href=\"https:\/\/missionlocal.org\/2025\/08\/six-arrested-immigration-court\/\">arrests<\/a>&nbsp;since they started at&nbsp;<a href=\"https:\/\/missionlocal.org\/2025\/06\/sf-ice-arrests-tracker\/\">the end of May<\/a>. \u201cThese arrests have caused widespread fear among immigrant communities,\u201d the suit said.<\/p>\n\n\n\n<p>The practice puts asylum seekers in a Catch-22: Either attend your court hearing in person and risk arrest, or skip court and be declared deportable.<\/p>\n\n\n\n<p>\u201cNow,\u201d the suit reads, \u201cthey must either risk immediately and arbitrarily losing their freedom or lose their opportunity to pursue their lawful claims to remain in the United States.\u201d<\/p>\n\n\n\n<p>About 71 percent of people held in ICE detention have no criminal record, according to the&nbsp;<a href=\"https:\/\/tracreports.org\/immigration\/quickfacts\/\">Transaction Records Access Clearinghouse<\/a>.<\/p>\n\n\n\n<p>Plaintiffs allege violations of the First and Fifth Amendments, particularly the Fifth Amendment\u2019s due-process protections. The suit asks, among other things, for the court to nullify ICE\u2019s memos allowing for courthouse arrests, and to mandate the agency improve conditions at 630 Sansome.<\/p>\n\n\n\n<p>ICE has been under pressure nationwide to fix poor conditions in its holding cells.<\/p>\n\n\n\n<p>In New York, a federal judge yesterday&nbsp;<a href=\"https:\/\/www.nytimes.com\/2025\/09\/17\/nyregion\/ice-migrant-cells-judge-ruling.html\">ordered<\/a>&nbsp;the Trump administration to ameliorate conditions that could amount to \u201cunconstitutional and inhumane treatment\u201d at 26 Federal Plaza, the immigration courthouse that has been subject to near-constant protests.&nbsp;<\/p>\n\n\n\n<p>Today, 11 elected New York Democrats were&nbsp;<a href=\"https:\/\/www.nytimes.com\/2025\/09\/18\/nyregion\/elected-officials-arrested-ice-new-york.html\">arrested<\/a>&nbsp;by ICE for demanding access to those cells to monitor conditions.<\/p>\n\n\n\n<p>Plaintiffs cite&nbsp;<em>Mission Local\u2019s<\/em>&nbsp;reporting on San Francisco immigration arrests three times in the suit.&nbsp;<em>Mission Local&nbsp;<\/em>has&nbsp;<a href=\"https:\/\/missionlocal.org\/2025\/06\/sf-ice-arrests-tracker\/\">documented<\/a>&nbsp;near daily arrests of asylum-seekers at both 630 Sansome St. and 100 Montgomery St., the city\u2019s other immigration courthouse.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-help-us-cover-ice-in-san-francisco\">Help us cover ICE in San Francisco<\/h4>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/newspack-missionlocal.s3.amazonaws.com\/mission\/wp-content\/uploads\/2025\/08\/ICE-0820-8-853x640.jpg\" alt=\"A police officer wearing protective gear confronts a masked individual holding a bicycle during a street incident.
