Vest \u00a9 2025 The New York Times Company<\/figcaption><\/figure>\n\n\n\n<p>The City is trying to help block the deployment of the National Guard in Chicago before it even arrives in San Francisco.<\/p>\n\n\n\n<p>Along with more than 40 other local governments, San Francisco urged the Supreme Court in a friend-of-the-court brief filed Monday to block&nbsp;<a href=\"https:\/\/www.scotusblog.com\/2025\/10\/supreme-court-urged-to-leave-ruling-in-place-preventing-trump-from-deploying-national-guard-in-illinois\/\" target=\"_blank\" rel=\"noreferrer noopener\">President Donald Trump\u2019s effort<\/a>&nbsp;to deploy more than 300 National Guard troops in Chicago over the objections of state and local leaders.<\/p>\n\n\n\n<p>The threat of a similar deployment in San Francisco is real and explicit. Trump told Fox News in an interview released Sunday that he has&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/oct\/20\/trump-san-francisco-troops\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cunquestioned power\u201d<\/a>&nbsp;to deploy troops in San Francisco. If he does, San Francisco would be the sixth city in which Trump has deployed federal troops or attempted to deploy them.<\/p>\n\n\n\n<p>\u201cWe\u2019re gonna go to San Francisco,\u201d Trump said. \u201cThe difference is I think they want us in San Francisco.\u201d<\/p>\n\n\n\n<p>City Attorney David Chiu met that threat with one of his own.<\/p>\n\n\n\n<p>\u201cShould President Trump make good on his ridiculous threats to send the military to San Francisco, our city is prepared, and my office is prepared to take the necessary legal action to defend San Francisco,\u201d Chiu said.<\/p>\n\n\n\n<p>California Gov. Gavin Newsom and Attorney General Rob Bonta said in a statement Tuesday afternoon that the state is prepared to \u201cimmediately\u201d sue the federal government if Trump deploys troops to The City.&nbsp;<\/p>\n\n\n\n<p>\u201cDonald Trump, himself a convicted felon who pardoned felons convicted of assaulting federal law enforcement officers, is misleading the public with his false narrative that America, and especially California, is some lawless wasteland,\u201d Newsom said. \u201cBut California is proving him wrong \u2014 in the courts and on the facts. We don\u2019t bow to kings, and we\u2019re standing up to this wannabe tyrant.\u201d<\/p>\n\n\n\n<p>Chiu\u2019s statement and the amicus curiae brief come as city leaders wrestle with how to respond to Trump\u2019s threat. Prior to Sunday\u2019s interview,&nbsp;<a href=\"https:\/\/www.sfexaminer.com\/news\/politics\/trump-floats-sf-action-after-da-rejects-calls-for-troops\/article_33af8b14-55c3-416a-97aa-de9e2fa6cef3.html#tncms-source=article-nav-next\" target=\"_blank\" rel=\"noreferrer noopener\">Trump had said<\/a>&nbsp;at a press conference earlier this month that he would \u201cbe strongly recommending, at the request of government officials \u2014 which is always nice \u2014 that you start looking at San Francisco\u201d for a future deployment.<\/p>\n\n\n\n<p>Mayor Daniel Lurie issued a statement that did not directly address Trump, but it touted San Francisco\u2019s historically low crime rates and its existing relationship with federal law-enforcement agencies, which he pointed to as proof that the National Guard is not needed to confront The City\u2019s persistent struggles with fentanyl and homelessness.<\/p>\n\n\n\n<p>\u201cI am deeply grateful to the members of our military for their service to our country, but the National Guard does not have the authority to arrest drug dealers \u2014 and sending them to San Francisco will do nothing to get fentanyl off the streets or make our city safer,\u201d Lurie said.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" loading=\"lazy\" width=\"4\" height=\"3\" src=\"https:\/\/occupysf.net\/wp-content\/uploads\/2025\/10\/image-47.png\" alt=\"\" class=\"wp-image-44702\"\/><figcaption class=\"wp-element-caption\">Protesters march through downtown San Francisco as part of the nationwide \u201cNo Kings\u201d demonstrations on Saturday, Oct. 18, 2025.&nbsp;Terry Chea\/Associated Press<\/figcaption><\/figure>\n\n\n\n<p><a href=\"https:\/\/www.sfexaminer.com\/news\/politics\/pelosi-rallies-for-prop-50-to-take-back-house-for-dems\/article_314c03c4-723d-4686-8938-12e8a67eef86.html\" target=\"_blank\" rel=\"noreferrer noopener\">Rep. Cities joining San Francisco in the amicus brief include San Jose, Oakland, and Sacramento.<\/p>\n\n\n\n<p>Citing Trump\u2019s declaration that \u201cwe\u2019re gonna have troops everywhere,\u201d the cities and counties warned of \u201ca cascade of harms\u201d if Trump is allowed to move ahead with his plans.<\/p>\n\n\n\n<p>Such action would not only illegally infringe on local and state sovereignty, but prove ineffective, they contended. Federal troops are ill-equipped to replace local law enforcement and are only escalating conflict while straining local resources in the cities to which Trump has dispatched them, including Los Angeles, the brief argues.<\/p>\n\n\n\n<p>\u201cOur Nation\u2019s constitutional order demands that domestic deployment of the federal military be restricted to exceptional circumstances and that federal courts hold the line against Executive overreach,\u201d the brief states.<\/p>\n\n\n\n<p>Trump said in the Fox News interview that he could deploy federal troops to cities under the Insurrection Act, an 1807 law that allows the president to dispatch troops within the U.S. in order to quell an insurrection or civil unrest.<\/p>\n\n\n\n<p>U.S. Solicitor General D. John Sauer argued in a filing to the Supreme Court that the blockage of troop deployment to Chicago \u201ccause[s] irreparable harm to the Executive Branch by countermanding the President\u2019s authority as Commander in Chief, jeopardizing the lives and safety of DHS officers, and preventing the President and the Secretary of War from taking reasonable and lawful measures to protect federal personnel from the violent resistance that has persisted in the Chicago area for several months.\u201d<\/p>\n\n\n\n<p>The cities argued the circumstances in Chicago don\u2019t meet the legal threshold for a federal troop deployment.<\/p>\n\n\n\n<p>Under the Trump administration\u2019s reasoning, the brief states, \u201cthe President could issue an order seeking to federalize troops at any time, anywhere, for any reason \u2014 based on nothing more than being a disfavored jurisdiction, a perception that local law enforcement cannot adequately do their jobs in their jurisdictions, or even a perceived threat of future violence.\u201d<\/p>\n\n\n\n<p>Later Tuesday, in one of his regular appearances before the Board of Supervisors, Supervisor Jackie Fielder asked the mayor about how his administration \u201cis preparing to defend\u201d San Franciscans\u2019 \u201ccivil liberties and rights.\u201d<\/p>\n\n\n\n<p>Lurie responded to Fielder, who represents the Mission, that city officials have been \u201cconstantly monitoring the possibility of federal intervention, really, since the day I took office.\u201d<\/p>\n\n\n\n<p>\u201cWe\u2019ve been convening a cross-departmental policy group of public safety leaders, representatives from the City Attorney\u2019s Office and other affected department heads to continue coordinating our local response to potential federal actions,\u201d Lurie said. One such meeting had occurred earlier in the day, he said.<\/p>\n\n\n\n<p>The mayor said the city attorney\u2019s amicus brief makes \u201cit clear that local law enforcement is best positioned to keep our communities safe, and that they are doing it well.\u201d<\/p>\n\n\n\n<p>The longstanding sanctuary policy prohibits city police officers \u201cfrom participating in federal civil immigration enforcement,\u201d Lurie said.<\/p>\n\n\n\n<p>\u201cIt is not the role of local law enforcement to assist with military operations on our streets,\u201d said Lurie, who said his administration is in regular communication with community and immigrant leaders.<\/p>\n\n\n\n<p><em>Marcus White contributed reporting to this story.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The City is trying to help block the deployment of the National Guard in Chicago before it even arrives in San Francisco.
