Photo by Sage Rios Mace.<\/figcaption><\/figure>\n\n\n\n<p>A San Francisco federal judge ruled Wednesday that the Trump administration\u2019s decision to end Temporary Protected Status was unlawful, restoring the status for nearly 90,000 immigrants.<\/p>\n\n\n\n<p>U.S. District Court Judge Trina Thompson\u2019s decision pertains to a&nbsp;<a href=\"https:\/\/www.aclunorcal.org\/cases\/national-tps-alliance-v-noem-ntpsa-ii\/\">recent lawsuit<\/a>&nbsp;that challenged the administration\u2019s&nbsp;<a href=\"https:\/\/missionlocal.org\/2025\/11\/s-f-packs-the-court-as-judge-hears-arguments-against-termination-of-temporary-protected-status\/\">decision<\/a>&nbsp;to terminate TPS for migrants who fled natural disasters in Honduras, Nepal and Nicaragua.&nbsp;It was filed by the American Civil Liberties Union of Northern California and partnering law firms.<\/p>\n\n\n\n<p>The program covers about 72,000 Hondurans, 13,000 Nepalis and 4,000 Nicaraguans, according to the U.S. Department of Homeland Security. It gives them temporary status to legally stay in the country.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/newspack-missionlocal.s3.amazonaws.com\/mission\/wp-content\/uploads\/2024\/03\/mission-local-logo-300x300.jpg\" alt=\"Mission Local logo, with blue and orange lines on the shape of the Mission District\" class=\"wp-image-639216\"\/><\/figure>\n\n\n\n<p>Want the latest on the Mission and San Francisco? The Ninth Circuit Court of Appeals upheld the decision on&nbsp;<a href=\"https:\/\/www.aclusocal.org\/en\/press-releases\/ninth-circuit-court-allows-termination-tps-proceed-60000-long-term-residents-nepal\">Aug. 20<\/a>, and on Sept. 7, TPS holders from Nicaragua and Honduras lost their status.<\/p>\n\n\n\n<p>Wednesday\u2019s decision restores TPS for those from Nepal, Nicaragua and Honduras. However, the government could challenge Thompson\u2019s ruling by appealing the decision to the Ninth Circuit Court of Appeals.&nbsp;<\/p>\n\n\n\n<p>Jhonny Silva, 30, who is from Honduras,&nbsp;<a href=\"https:\/\/missionlocal.org\/2025\/09\/i-havent-slept-i-havent-eaten-immigrants-desperate-as-protections-come-to-an-end\/\">lost his job<\/a>&nbsp;as a nursing student after TPS was terminated in September.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/paxtongate.com\/?srsltid=AfmBOortpViqhDC5ZZKihY8Y0PFRAg6LdZlVUszRZNHCkYlkDxU95_Kr\" target=\"_blank\" rel=\"noreferrer noopener\"><img decoding=\"async\" src=\"https:\/\/cdn.broadstreetads.com\/assets\/d43e2184-1803-495b-b982-cbb3c171a8b5.png\" alt=\"Paxton gate - 14\"\/><\/a><\/figure>\n\n\n\n<p>\u201cThe court\u2019s order today is a tremendous relief, but the administration\u2019s decision to terminate TPS has already wreaked havoc for me and so many others,\u201d Silva wrote in an email today.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/newspack-missionlocal.s3.amazonaws.com\/mission\/wp-content\/uploads\/2025\/09\/090825_MMG_JohnySilva-5-854x640.jpg\" alt=\"A man sits at a table with a cake featuring &quot;29&quot; candles while a young girl hugs and kisses him on the cheek. Photo courtesy of Jhony Silva.<\/figcaption><\/figure>\n\n\n\n<p>He continued,\u201cI hope that this means my child and I can be secure in the United States for the time being but we will not give up fighting to protect our rights and the rights of others.\u201d<\/p>\n\n\n\n<p>In today\u2019s&nbsp;52-page&nbsp;<a href=\"https:\/\/newspack-missionlocal.s3.amazonaws.com\/mission\/wp-content\/uploads\/2025\/12\/tps-decision-trina-thompson.pdf\">decision<\/a>, Thompson wrote that the administration failed to adequately consider country conditions that would prevent TPS holders from safely returning and rebuilding their lives in their home countries.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"http:\/\/www.backtothepicture.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><img decoding=\"async\" src=\"https:\/\/cdn.broadstreetads.com\/assets\/278cc7bd-fdea-4cea-b1cf-b8d2175b0646.png\" alt=\"Back to the Picture SR\"\/><\/a><\/figure>\n\n\n\n<p>Thompson found that the decision to end TPS was likely \u201cpreordained,\u201d meaning that it was made before the government received country-condition reviews for Honduras and Nicaragua.&nbsp;<\/p>\n\n\n\n<p>The decision&nbsp; alleges that the Department of Homeland Security relied on \u201cskewed data,\u201d requesting&nbsp; roughly one page of information on country conditions. The latter, Judge Thompson concluded, failed to capture the full scope of the conditions in the affected countries.<\/p>\n\n\n\n<p>The judge further concluded that the decision was likely motivated by racial animus, echoing claims previously raised by the National TPS Alliance, one of the organizations that represents the plaintiffs.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/bayarea.hibaacademy.org\/en?utm_medium=Digital%20Ads&amp;utm_source=Other%20Digital%20Ads&amp;utm_campaign=Branding$Mission%20Local%20website&amp;utm_content=Homepage\" target=\"_blank\" rel=\"noreferrer noopener\"><img decoding=\"async\" src=\"https:\/\/cdn.broadstreetads.com\/assets\/f470b9e9-7e66-48f0-baa2-426635e327d2.jpg\" alt=\"1-1-26 to 1-31-26\"\/><\/a><\/figure>\n\n\n\n<p>In the court order, Thompson cited statements by President Trump and social media posts by Homeland Security Secretary Kristi Noem that portrayed TPS holders as criminal invaders.<\/p>\n\n\n\n<p>Among them were Trump\u2019s statement that migrants were \u201cpoisoning the blood of our country,\u201d and another in which he wrote, \u201cYou now know a murderer.
