In&nbsp;<em>LULAC v. Executive Office of the President<\/em>, a federal district court ruled that&nbsp;<strong>\u201cour Constitution entrusts Congress and the States \u2014 not the President \u2014 with the authority to regulate federal elections.\u201d<\/strong>&nbsp;On October 31, 2025, Judge Colleen Kollar-Kotelly permanently blocked the proof-of-citizenship provisions, finding the order&nbsp;<strong>\u201ccontrary to the manifest will of Congress\u201d<\/strong>.\u2074&nbsp;The&nbsp;<strong>Center for American Progress<\/strong>&nbsp;warns that declaring a manufactured emergency is \u201cthe next escalatory step\u201d \u2014 one that would throw midterm elections into chaos and lock in political power outside any democratic mandate.\u2075<\/p>\n\n\n\n<p>Emergency declarations are designed for genuine crises.&nbsp;<strong>Using them to impose voting conditions in the absence of any documented emergency sets a precedent that future administrations of any party could exploit.<\/strong>&nbsp;The normalization of emergency power as an electoral tool is the real threat, regardless of which party wields it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who Is Harmed<\/h2>\n\n\n\n<p>The people most immediately harmed are those&nbsp;<strong>least insulated from bureaucratic barriers<\/strong>: low-income voters, elderly Americans, rural communities, naturalized citizens, and communities of color. As the&nbsp;<strong>Brennan Center<\/strong>&nbsp;notes, noncitizen voting is&nbsp;<em>\u201calmost nonexistent\u201d<\/em>&nbsp;given existing laws and penalties \u2014 meaning these requirements solve no real problem while creating enormous ones for millions of eligible Americans.\u2076&nbsp;A&nbsp;<strong>Washington Post\u2013ABC News\u2013Ipsos poll<\/strong>&nbsp;found that&nbsp;<strong>54 percent of American adults<\/strong>&nbsp;\u2014 and 55 percent of independents \u2014 oppose Trump\u2019s effort to federalize election administration.\u2077<\/p>\n\n\n\n<p>Election administrators, most of them&nbsp;<strong>nonpartisan local officials<\/strong>, are caught between federal pressure and state law, forced to navigate a legal minefield that undermines their ability to run orderly, fair elections. Civil society organizations \u2014 including the&nbsp;<strong>League of Women Voters<\/strong>, which has filed suit against the March 2025 order \u2014 are consuming litigation resources that would otherwise go toward civic engagement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Comes Next<\/h2>\n\n\n\n<p>Courts have pushed back decisively. But&nbsp;<strong>litigation is slow, and elections are not.<\/strong>&nbsp;Congress must reassert its constitutional role by passing legislation that clearly defines the&nbsp;<strong>limits of executive authority over elections<\/strong>&nbsp;and protects federal funding from being weaponized as a compliance tool.
