Friends, American democracy has survived wars, economic collapse, and political scandal.<\/strong> But it has rarely faced a threat as quiet and bureaucratic as the one now unfolding: a systematic effort to use executive emergency powers<\/strong> to reshape how federal elections are administered. What is being attempted is not a dramatic coup but something potentially more durable \u2014 a legal architecture that would give one branch of government dominance over the machinery of voting itself.<\/strong><\/p>\n\n\n\n

What Happened<\/h2>\n\n\n\n

In March 2025, President Trump signed Executive Order 14248<\/strong>, titled \u201cPreserving and Protecting the Integrity of American Elections,\u201d<\/em> directing federal agencies to condition election-related grants and support on states adopting specific voting protocols, including proof-of-citizenship requirements<\/strong> and restrictions on mail-in balloting.\u00b9 Pro-Trump activists \u2014 some claiming White House coordination \u2014 simultaneously circulated a 17-page draft executive order<\/strong> that would declare a national emergency, citing alleged Chinese interference in the 2020 election as justification for seizing sweeping control over the 2026 midterm elections.\u00b2 The proposed measures include requiring hand-counted paper ballots, banning most mail voting, and forcing voters to re-register with citizenship documentation<\/strong>.\u00b3 States that resist face the prospect of losing federal funding tied to election administration.<\/p>\n\n\n\n

Why It Matters<\/h2>\n\n\n\n

The danger here is structural.<\/strong> The Constitution grants Congress \u2014 not the president \u2014 authority to regulate the time, place, and manner of federal elections. As the Brennan Center for Justice<\/strong> has made clear, \u201cthe president has no role in this constitutional scheme beyond signing or vetoing federal legislation.\u201d<\/em> When the executive branch asserts emergency powers to override that framework, it doesn\u2019t just bend a rule \u2014 it rewrites the relationship between the branches entirely.<\/strong><\/p>\n\n\n\n

Federal courts have already agreed. In LULAC v. Executive Office of the President<\/em>, a federal district court ruled that \u201cour Constitution entrusts Congress and the States \u2014 not the President \u2014 with the authority to regulate federal elections.\u201d<\/strong> On October 31, 2025, Judge Colleen Kollar-Kotelly permanently blocked the proof-of-citizenship provisions, finding the order \u201ccontrary to the manifest will of Congress\u201d<\/strong>.\u2074 The Center for American Progress<\/strong> warns that declaring a manufactured emergency is \u201cthe next escalatory step\u201d \u2014 one that would throw midterm elections into chaos and lock in political power outside any democratic mandate.\u2075<\/p>\n\n\n\n

Emergency declarations are designed for genuine crises. Using them to impose voting conditions in the absence of any documented emergency sets a precedent that future administrations of any party could exploit.<\/strong> The normalization of emergency power as an electoral tool is the real threat, regardless of which party wields it.<\/p>\n\n\n\n

Who Is Harmed<\/h2>\n\n\n\n

The people most immediately harmed are those least insulated from bureaucratic barriers<\/strong>: low-income voters, elderly Americans, rural communities, naturalized citizens, and communities of color. As the Brennan Center<\/strong> notes, noncitizen voting is \u201calmost nonexistent\u201d<\/em> given existing laws and penalties \u2014 meaning these requirements solve no real problem while creating enormous ones for millions of eligible Americans.\u2076 A Washington Post\u2013ABC News\u2013Ipsos poll<\/strong> found that 54 percent of American adults<\/strong> \u2014 and 55 percent of independents \u2014 oppose Trump\u2019s effort to federalize election administration.\u2077<\/p>\n\n\n\n

Election administrators, most of them nonpartisan local officials<\/strong>, are caught between federal pressure and state law, forced to navigate a legal minefield that undermines their ability to run orderly, fair elections. Civil society organizations \u2014 including the League of Women Voters<\/strong>, which has filed suit against the March 2025 order \u2014 are consuming litigation resources that would otherwise go toward civic engagement.<\/p>\n\n\n\n

What Comes Next<\/h2>\n\n\n\n

Courts have pushed back decisively. But litigation is slow, and elections are not.<\/strong> Congress must reassert its constitutional role by passing legislation that clearly defines the limits of executive authority over elections<\/strong> and protects federal funding from being weaponized as a compliance tool. Election law scholar Ned Foley<\/strong> has stated plainly that \u201cit would take new federal legislation to give the president or any part of the federal executive branch that kind of authority over the conduct of congressional elections\u201d<\/em>.\u2078<\/p>\n\n\n\n

Every emergency declaration touching election administration should require congressional approval within a defined window.<\/strong> Voters must demand transparency \u2014 and engagement. The machinery of democracy is only as strong as the consensus to protect it. That consensus requires active defense, not passive hope.<\/strong><\/p>\n\n\n\n

Democracy is not a spectator sport \u2014 and history has always belonged to those who showed up.<\/strong> The courts are holding, the people are paying attention, and every voice raised in defense of the ballot box is proof that the spirit of self-governance is very much alive.<\/p>\n\n\n\n
