{"id":11761,"date":"2019-04-30T11:54:49","date_gmt":"2019-04-30T18:54:49","guid":{"rendered":"http:\/\/occupysf.net\/?p=11761"},"modified":"2019-04-30T11:54:51","modified_gmt":"2019-04-30T18:54:51","slug":"federal-judge-rules-homeless-camp-residents-given-72-hours-notice-to-vacate","status":"publish","type":"post","link":"https:\/\/occupysf.net\/index.php\/2019\/04\/30\/federal-judge-rules-homeless-camp-residents-given-72-hours-notice-to-vacate\/","title":{"rendered":"Federal judge rules, homeless camp residents given 72 hours notice to vacate"},"content":{"rendered":"\n<h4 class=\"wp-block-heading\">Second round of mediation was unsuccessful<\/h4>\n\n\n\n<p><a href=\"https:\/\/www.santacruzsentinel.com\/2019\/04\/29\/homeless-camp-follow-proceedings-from-todays-hearing-in-federal-court\/#comments\"><\/a>By\u00a0<a href=\"https:\/\/www.santacruzsentinel.com\/author\/jessica-a-york\/\">JESSICA A YORK<\/a>\u00a0| Santa Cruz Sentinel &#8211;\u00a0April 29, 2019 <\/p>\n\n\n\n<p>SAN JOSE \u2014 A federal court judge sent Santa Cruz city officials and litigants in a homeless civil rights lawsuit back to a second round of mediated talks Monday in the midst of witness testimony.<\/p>\n\n\n\n<p>U.S. District Court Judge Edward Davila was, he said, determined to \u201cfinish this case today.\u201d<\/p>\n\n\n\n<p>As with Friday, the second round of negotiations proved unsuccessful.<\/p>\n\n\n\n<p>Shortly after 6 p.m. Davila ruled he will dissolve the temporary restraining order due to his opinions that the main case is unlikely to succeed on its merits and that plaintiffs have not shown irreparable harm.<\/p>\n\n\n\n<p>The City expects to post eviction notices at the homeless camp at Gateway Plaze, behind Ross Dress For Less, early Tuesday morning, meaning \u201cmove out day\u201d would not be before 72 hours have passed, which would be Friday morning.<\/p>\n\n\n\n<p>Attorney Anthony Prince, appearing for a group of homeless litigants representing themselves, said he is \u201cinclined to appeal.\u201d<\/p>\n\n\n\n<p>As of press time Monday, Davila was hearing from the first and only witness city officials planned to call in the case.
