f{"id":12452,"date":"2019-07-25T10:39:40","date_gmt":"2019-07-25T17:39:40","guid":{"rendered":"http:\/\/occupysf.net\/?p=12452"},"modified":"2019-07-25T10:39:41","modified_gmt":"2019-07-25T17:39:41","slug":"mueller-says-trump-can-be-charged-with-obstruction-of-justice-after-he-leaves-office","status":"publish","type":"post","link":"https:\/\/occupysf.net\/index.php\/2019\/07\/25\/mueller-says-trump-can-be-charged-with-obstruction-of-justice-after-he-leaves-office\/","title":{"rendered":"Mueller says Trump can be charged with obstruction of justice after he leaves office"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><em>by&nbsp;<a href=\"https:\/\/www.good.is\/contributors\/tod-perry\">Tod Perry<\/a><\/em><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a0July 24, 2019 (good.is)<\/p>\n\n\n\n<figure><iframe loading=\"lazy\" allowfullscreen=\"1\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/uq3Y3P07bJ0?rel=0&amp;enablejsapi=1&amp;origin=https%3A%2F%2Fwww.good.is&amp;widgetid=1\"><\/iframe><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">During his testimony before the House Judiciary Committee, Robert Mueller, the former special prosecutor in the investigation into Russian election interference, confirmed that President Trump can face charges after leaving office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mueller\u2019s admission came during an exchange with Republican Ken Buck from Colorado.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCould you charge the president with a crime after he left office?\u201d Buck asked.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mueller responded, \u201cyes.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Buck asked again, \u201cYou believe that he committed \u2026 You could charge the President of the United States with obstruction of justice after he left office,\u201d to which Mueller repeated himself saying, \u201cyes.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One could also extrapolate from Buck\u2019s mangled question that Mueller believes&nbsp;Trump committed a crime. But it\u2019s unclear if Mueller is responding to the first part of Buck\u2019s question where he asked, \u201cYou believe that he committed \u2026\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mueller believes that Trump can not be charged with a crime while in office due to<a href=\"https:\/\/www.reuters.com\/article\/us-usa-trump-russia-indictment-explainer\/can-a-sitting-us-president-face-criminal-charges-idUSKCN1QF1D3\" target=\"_blank\" rel=\"noreferrer noopener\">a 2000 Justice Department Office of Legal Counsel (OLC) memo&nbsp;<\/a>that had concluded, \u201ca sitting President is constitutionally immune from indictment and criminal prosecution.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Democratic Representative Ted Lieu from California later clarified Mueller\u2019s thinking on whether Trump could be indicted. \u201cThe reason, again, that you did not indict Donald Trump is because of the OLC opinion stating that you cannot indict a sitting president, correct?\u201d&nbsp;<a href=\"https:\/\/www.yahoo.com\/news\/mueller-president-charged-obstruction-justice-160211477.html\" target=\"_blank\" rel=\"noreferrer noopener\">Lieu asked Mueller.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThat is correct,\u201d Mueller responded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While Mueller\u2019s report on election interference said that Trump wasn\u2019t involved in a&nbsp;criminal conspiracy with Russia,&nbsp;<a href=\"https:\/\/www.apnews.com\/e0d125d737be4a21a81bec3d9f1dffd8\" target=\"_blank\" rel=\"noreferrer noopener\">it detailed ten&nbsp;incidents<\/a>&nbsp;that could lead him to be charged with obstruction of justice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During his testimony, Mueller came close to saying he would have indicted the president if it was within his power. \u201cCharging the president with a crime was not an option we could consider,\u201d he told the House committee. \u201cIf we had confidence the president clearly did not commit a crime, we would have said so.
