It is shared here with permission.<\/em><\/p>\n\n\n\n<p>The stunning vote by Amazon warehouse workers earlier this month to form a&nbsp;union at the JFK8 warehouse in Staten Island, New York, has invited fresh scrutiny of the e\u2011commerce giant\u2019s for-hire&nbsp;<a href=\"https:\/\/www.newyorker.com\/news\/dispatch\/how-to-unionize-at-amazon\" target=\"_blank\" rel=\"noreferrer noopener\">union busters<\/a>, as well as the&nbsp;<a href=\"https:\/\/nitter.net\/MorePerfectUS\/status\/1512186877981315074\" target=\"_blank\" rel=\"noreferrer noopener\">groups<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/nymag.com\/intelligencer\/2022\/04\/do-democrats-really-want-amazons-workers-to-win.html\" target=\"_blank\" rel=\"noreferrer noopener\">politicians<\/a>&nbsp;that do business with&nbsp;them.<\/p>\n\n\n\n<p>But there is another category of organization that has largely evaded such negative publicity: groups that help launder the image of Amazon, by presenting the company as a&nbsp;fair and enlightened employer. Perhaps the worst offender in this category is Human Rights Campaign (HRC), which describes itself as \u200b\u201cthe nation\u2019s largest lesbian, gay, bisexual and transgender (LGBTQ+) civil rights&nbsp;organization.\u201d&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>HRC has been criticized in the past for taking pro-corporate positions and undermining social justice causes\u2014for example,&nbsp;<a href=\"https:\/\/sundial.csun.edu\/45167\/opinions\/equality-for-some-a-critique-of-the-human-rights-campaign\/\" target=\"_blank\" rel=\"noreferrer noopener\">supporting<\/a>&nbsp;a&nbsp;version of the Employment Non-Discrimination Act in 2007 that would have excluded key workplace protections for transgender people.<\/p><\/blockquote>\n\n\n\n<p>HRC has been criticized in the past for taking pro-corporate positions and undermining social justice causes\u2014for example,&nbsp;<a href=\"https:\/\/sundial.csun.edu\/45167\/opinions\/equality-for-some-a-critique-of-the-human-rights-campaign\/\" target=\"_blank\" rel=\"noreferrer noopener\">supporting<\/a>&nbsp;a&nbsp;version of the Employment Non-Discrimination Act in 2007 that would have excluded key workplace protections for transgender people. More recently, the organization has fallen under scrutiny for its&nbsp;<a href=\"https:\/\/www.nytimes.com\/2021\/08\/12\/nyregion\/alphonso-david-human-right-campaign-cuomo.html\" target=\"_blank\" rel=\"noreferrer noopener\">close ties<\/a>&nbsp;to the disgraced administration of former New York Gov. Andrew&nbsp;Cuomo.<\/p>\n\n\n\n<p>In its \u200b\u201cCorporate Equality Index 2022,\u201d&nbsp;<a href=\"https:\/\/www.hrc.org\/press-releases\/the-human-rights-campaign-foundation-releases-20th-corporate-equality-index-announces-new-robust-criteria\" target=\"_blank\" rel=\"noreferrer noopener\">released<\/a>&nbsp;in January, HRC said that Amazon is among the \u200b\u201cBest Places to Work for LGBTQ+ Equality.\u201d HRC gave Amazon a&nbsp;score of 100%, alongside other major companies like Walmart and Chevron. This marks the fifth year in a&nbsp;row that the company has received a&nbsp;flawless equality&nbsp;score.<\/p>\n\n\n\n<p>HRC\u2019s report gives few details about why, exactly, Amazon received this rating, but the organization&nbsp;<a href=\"https:\/\/www.hrc.org\/resources\/best-places-to-work-for-lgbtq-equality-2022\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;in a&nbsp;statement, \u200b\u201cTo earn top ratings, these employers took concrete steps to establish and implement comprehensive policies, benefits and practices that ensure greater equity for LGBTQ+ workers and their&nbsp;families.\u201d<\/p>\n\n\n\n<p>Amazon, it turns out, is a&nbsp;donor to HRC. The e\u2011commerce giant is&nbsp;<a href=\"https:\/\/www.hrc.org\/about\/corporate-partners\" target=\"_blank\" rel=\"noreferrer noopener\">listed<\/a>&nbsp;as a \u200b\u201cplatinum partner\u201d on HRC\u2019s website, and is among those companies thanked for their \u200b\u201cgenerous support of the work of the Human Rights Campaign.\u201d It is not immediately clear how much money platinum partners donate to HRC, but platinum is the highest level of donor listed on the organization\u2019s website. HRC did not return a&nbsp;request for comment about whether Amazon\u2019s donations influenced the company\u2019s&nbsp;rating.<\/p>\n\n\n\n<p>Amazon has used its \u200b\u201cperfect score\u201d for promotional purposes. A&nbsp;company statement released in January is&nbsp;<a href=\"https:\/\/www.aboutamazon.com\/news\/workplace\/amazon-earns-perfect-score-for-lgbtq-supportive-workplaces\" target=\"_blank\" rel=\"noreferrer noopener\">titled<\/a>, \u200b\u201cAmazon earns perfect score for LGBTQ-supportive workplaces,\u201d and vaunts the company\u2019s supposed pro-LGBTQ&nbsp;credentials.&nbsp;<\/p>\n\n\n\n<p>In the statement, Amazon highlights its \u200b\u201caffinity group,\u201d which is called \u200b\u201cglamazon.\u201d It states, \u200b\u201cThere are now 60 active glamazon chapters around the world that work with Amazon\u2019s People Experience and Technology Solutions and business teams to create an inclusive workplace, host hundreds of community events, and celebrate Pride annually.\u201d (This is&nbsp;<a href=\"https:\/\/www.aboutamazon.com\/news\/workplace\/a-perfect-score\" target=\"_blank\" rel=\"noreferrer noopener\">not the first time<\/a>&nbsp;Amazon has advertised its HRC score in promotional&nbsp;materials.)<\/p>\n\n\n\n<p>But Justine Medina, a&nbsp;queer worker at the JFK8 warehouse, says the company\u2019s vicious union busting&nbsp;<a href=\"https:\/\/theintercept.com\/2022\/04\/02\/amazon-union-staten-island\/\" target=\"_blank\" rel=\"noreferrer noopener\">tactics<\/a>, including holding captive audience meetings and arresting organizers, are \u200b\u201cabsolutely incompatible with LGBTQ protections and a&nbsp;good work environment and&nbsp;safety.\u201d&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Justine Medina, a&nbsp;queer worker at the JFK8 warehouse, says the company\u2019s vicious union busting&nbsp;<a href=\"https:\/\/theintercept.com\/2022\/04\/02\/amazon-union-staten-island\/\" target=\"_blank\" rel=\"noreferrer noopener\">tactics<\/a>, including holding captive audience meetings and arresting organizers, are \u200b\u201cabsolutely incompatible with LGBTQ protections and a&nbsp;good work environment and&nbsp;safety.\u201d<\/p><\/blockquote>\n\n\n\n<p>\u201cUnions are one of the only ways workers can stand up and get their rights,\u201d says Medina, an active organizer in the successful union campaign that was led by Amazon Labor Union (ALU). \u200b\u201cUnion busting hinders the rights of the most oppressed, because unions are how oppressed workers come together and secure their&nbsp;rights.\u201d<\/p>\n\n\n\n<p>There is evidence to back this up. In 2020, the UCLA Labor Center published the results of a&nbsp;survey of 1,004 United Food and Commercial Workers members in the United States and Canada. The study found that \u200b\u201cthree-quarters of survey participants said their local union takes concrete actions to support LGBTQ workers and 70% said LGBTQ workers are protected by their union contracts,\u201d according to a&nbsp;<a href=\"https:\/\/newsroom.ucla.edu\/releases\/labor-unions-protection-for-lgbtq-workers\" target=\"_blank\" rel=\"noreferrer noopener\">summary<\/a>.<\/p>\n\n\n\n<p>Amazon workers say LGBTQ employees need a&nbsp;union for a&nbsp;reason: The company has faced a&nbsp;range of allegations of discrimination and poor working conditions from its LGBTQ workers. A&nbsp;May 2021&nbsp;<a href=\"https:\/\/www.glassdoor.com\/blog\/lgbtq-employee-satisfaction\/\" target=\"_blank\" rel=\"noreferrer noopener\">survey<\/a>&nbsp;from Glassdoor, which allows for anonymous reviews of employers, found that LGBTQ employees are \u200b\u201cless satisfied\u201d at Amazon than their non-LGBTQ coworkers. Among the major companies named in the report, Amazon was one of the&nbsp;lower-ranked.<\/p>\n\n\n\n<p>In 2017, a&nbsp;transgender woman and her husband&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2017\/aug\/09\/transgender-woman-sues-amazon-kentucky-discrimination\" target=\"_blank\" rel=\"noreferrer noopener\">sued<\/a>&nbsp;Amazon, alleging a&nbsp;climate of harassment, slurs, discrimination and physical threats at a&nbsp;Kentucky warehouse. When they complained to management, the couple charged, they faced retaliation instead of support. (Amazon&nbsp;<a href=\"https:\/\/www.reuters.com\/article\/employment-amazon\/amazon-settles-bias-claims-with-transgender-employee-husband-idUSL1N1Z21H9\" target=\"_blank\" rel=\"noreferrer noopener\">settled<\/a>&nbsp;the case in 2019, and the details of the agreement were not disclosed, while the company denied&nbsp;wrongdoing.)<\/p>\n\n\n\n<p>And in 2020, a&nbsp;transgender man at a&nbsp;warehouse in New Jersey&nbsp;<a href=\"https:\/\/www.nbcnews.com\/feature\/nbc-out\/transgender-man-files-pregnancy-discrimination-suit-against-amazon-n1242324\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a>&nbsp;a&nbsp;federal discrimination lawsuit against Amazon, charging that, after telling his boss that he was pregnant, he was denied a&nbsp;promotion, placed on leave and denied pregnancy accommodations. (The case is still&nbsp;<a href=\"https:\/\/unicourt.com\/case\/pc-db5-simmons-v-amazoncom-services-inc-et-al-695987\" target=\"_blank\" rel=\"noreferrer noopener\">pending<\/a>.)<\/p>\n\n\n\n<p>Complaints extend up the chain of command, with LGBTQ managers and corporate employees also saying they\u2019ve faced a&nbsp;climate of anti-LGBTQ discrimination, from&nbsp;<a href=\"https:\/\/news.bloomberglaw.com\/daily-labor-report\/black-gay-amazon-worker-alleges-bias-including-related-to-covid\" target=\"_blank\" rel=\"noreferrer noopener\">New York<\/a>&nbsp;to&nbsp;<a href=\"https:\/\/www.lgbtqnation.com\/2022\/02\/former-employee-sues-amazon-allegedly-firing-cover-anti-gay-harassment\/\" target=\"_blank\" rel=\"noreferrer noopener\">Washington<\/a>. A&nbsp;former executive in Amazon\u2019s web services cloud-computing business&nbsp;<a href=\"https:\/\/medium.com\/@cindylwarner1\/amazon-fired-me-for-reporting-gender-bias-now-others-are-speaking-out-e1ca420c3692\" target=\"_blank\" rel=\"noreferrer noopener\">says<\/a>&nbsp;she was fired in retaliation for pursuing a&nbsp;lawsuit against a&nbsp;manager for homophobic comments he allegedly made. The list&nbsp;<a href=\"https:\/\/www.lgbtqnation.com\/2022\/02\/former-employee-sues-amazon-allegedly-firing-cover-anti-gay-harassment\/\" target=\"_blank\" rel=\"noreferrer noopener\">goes on<\/a>.<\/p>\n\n\n\n<p>The general workplace conditions that pushed employees to unionize Amazon in the first place\u2014low wages, inadequate breaks, surveillance, and lack of safety protections\u2014also, of course, impact LGBTQ workers. The best way to achieve equality, workers have argued, is to build the collective power of workers to oppose workplace injustice. \u200b\u201cAmazon doesn\u2019t treat us like real human beings; we\u2019re treated just like machines,\u201d Brima Sylla, a&nbsp;worker and organizer in the union campaign at the JFK8 warehouse,&nbsp;<a href=\"https:\/\/jacobinmag.com\/2022\/04\/amazon-warehouse-alu-staten-island-immigrant-workers\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a>&nbsp;<em>Jacobin<\/em>&nbsp;in a&nbsp;recent interview.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Complaints extend up the chain of command, with LGBTQ managers and corporate employees also saying they\u2019ve faced a&nbsp;climate of anti-LGBTQ discrimination, from&nbsp;<a href=\"https:\/\/news.bloomberglaw.com\/daily-labor-report\/black-gay-amazon-worker-alleges-bias-including-related-to-covid\" target=\"_blank\" rel=\"noreferrer noopener\">New York<\/a>&nbsp;to&nbsp;<a href=\"https:\/\/www.lgbtqnation.com\/2022\/02\/former-employee-sues-amazon-allegedly-firing-cover-anti-gay-harassment\/\" target=\"_blank\" rel=\"noreferrer noopener\">Washington<\/a>.<\/p><\/blockquote>\n\n\n\n<p>LGBTQ people comprise part of the workforce demanding better conditions. Michael Aguilar used to work at JFK8, and now is at the neighboring LDJ5 warehouse, where ALU is slated to hold a&nbsp;union election later this month. According to Aguilar, anti-queer discrimination is a&nbsp;problem at both warehouses\u2014a charge Medina corroborates. \u200b\u201cThis building [LDJ5] has a&nbsp;higher percentage of queer people. There are a&nbsp;lot of trans people and a&nbsp;lot of lesbians and gays. The stories I\u2019ve heard already are&nbsp;disgusting.\u201d<\/p>\n\n\n\n<p>Thanks to the&nbsp;<a href=\"https:\/\/www.huffpost.com\/entry\/how-amazon-workers-beat-the-union-busters-at-their-own-game_n_624b0385e4b0e44de9c52704\" target=\"_blank\" rel=\"noreferrer noopener\">extraordinary effort<\/a>&nbsp;of Amazon workers to name and expose the actions of union busters, they\u2019ve helped make association with them politically toxic, and even forced one, the research and public relations firm Global Strategy Group, to issue&nbsp;<a href=\"https:\/\/globalstrategygroup.com\/statement-from-gsg-on-work-with-amazon-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">an apology<\/a>&nbsp;on April 11, which states: \u200b\u201cWhile there have been factual inaccuracies in recent reports about our work for Amazon, being involved in any way was a&nbsp;mistake. We are deeply sorry, and we have resigned that&nbsp;work.\u201d<\/p>\n\n\n\n<p>According to Medina, HRC\u2019s \u200b\u201cabsurd\u201d flattery of Amazon also deserves attention. \u200b\u201cIt\u2019s indicative of the way these major corporations buy themselves publicity through back channels to make themselves look more&nbsp;legitimate.\u201d<\/p>\n\n\n\n<p><strong>Update:<\/strong>&nbsp;After publication of this article, Kelly Nantel, a&nbsp;spokesperson for Amazon, sent the following statement to&nbsp;<em>In These Times<\/em>: \u200b\u201cAt Amazon, we believe that the rights of LGBTQ+ people must be protected. We stand together with the LGBTQ+ community, were early and strong supporters of marriage equality, and are working at the U.S. federal and state level on legislation, including supporting passage of the Equality Act.
