Sheldon Whitehouse on Thursday urged the top policymaking body for U.S. federal courts to refer Supreme Court Justice Clarence Thomas to the attorney general, citing the lack of immediate action from the high court amid&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/clarence-thomas-real-estate\" target=\"_blank\" rel=\"noreferrer noopener\">fresh evidence<\/a>&nbsp;that the right-wing judge violated disclosure laws.<\/p>\n\n\n\n<p>&#8220;It would be best for the chief justice to commence a proper investigation, but after a week of silence from the court and the latest disturbing reporting, I&#8217;m urging the Judicial Conference to step in and refer Justice Thomas to the attorney general for investigation,&#8221; the Rhode Island Democrat said in a statement.<\/p>\n\n\n\n<p>The senator&#8217;s call came shortly after&nbsp;<em>ProPublica<\/em><a href=\"https:\/\/www.propublica.org\/article\/clarence-thomas-harlan-crow-real-estate-scotus\" target=\"_blank\" rel=\"noreferrer noopener\">revealed<\/a>&nbsp;that a company owned by billionaire real estate mogul and GOP megadonor Harlan Crow bought property from Thomas in a deal that the justice did not disclose. The Thursday piece built on&nbsp;<em>ProPublica<\/em>&#8216;s&nbsp;<a href=\"https:\/\/www.propublica.org\/article\/clarence-thomas-scotus-undisclosed-luxury-travel-gifts-crow\" target=\"_blank\" rel=\"noreferrer noopener\">bombshell story<\/a>&nbsp;last week detailing years of luxury trips that Thomas took on Crow&#8217;s dime without disclosing them\u2014reporting that sparked calls for Thomas&#8217; resignation or&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/aoc-clarence-thomas-impeached\" target=\"_blank\" rel=\"noreferrer noopener\">impeachment<\/a>.<\/p>\n\n\n\n<p>But with impeachment unlikely given Republican control of the House, Democratic lawmakers have&nbsp;<a href=\"https:\/\/www.judiciary.senate.gov\/press\/dem\/releases\/durbin-senate-judiciary-democrats-urge-chief-justice-roberts-to-investigate-justice-thomas-undisclosed-gifts-and-take-action-to-prevent-further-misconduct\" target=\"_blank\" rel=\"noreferrer noopener\">demanded<\/a>&nbsp;that conservative Chief Justice John Roberts launch an investigation into Thomas&#8217; apparent disclosure law violations\u2014something the high court&#8217;s top judge has failed to do in response to other Thomas scandals, including his decision not to recuse himself from cases involving the 2020 election even though his wife was&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/2022\/05\/20\/ginni-thomas-pressed-arizona-lawmakers-reverse-bidens-2020-win-report\" target=\"_blank\" rel=\"noreferrer noopener\">actively involved<\/a>&nbsp;in efforts to overturn the results of that contest.<\/p>\n\n\n\n<p>Thomas, who has&nbsp;<a href=\"https:\/\/www.levernews.com\/thomas-pushed-to-kill-disclosure-laws-while-getting-secret-billionaire-gifts\/\" target=\"_blank\" rel=\"noreferrer noopener\">worked to weaken<\/a>&nbsp;federal transparency laws, also&nbsp;<a href=\"https:\/\/www.commoncause.org\/media\/common-cause-and-alliance-for-justice-ask-judicial-conference-to-investigate-potential-violations-of-ethics-in-government-act-by-justice-clarence-thomas\/\" target=\"_blank\" rel=\"noreferrer noopener\">previously failed<\/a>&nbsp;to disclose his wife&#8217;s income from right-wing organizations.<\/p>\n\n\n\n<p>In a statement last week, Thomas&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/clarence-thomas-defense-luxury-trips\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a>&nbsp;he was &#8220;advised&#8221; by colleagues that the gifts from and trips with Crow\u2014which included cruises on the billionaire&#8217;s superyacht and private jet flights over a period of two decades\u2014amounted to &#8220;personal hospitality&#8221; that shouldn&#8217;t be reported.<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Last week, news broke that Justice Thomas wasn\u2019t disclosing free luxury vacations paid for by Harlan Crow, a GOP megadonor, because he considered it \u201cpersonal hospitality.\u201d<br><br>Today, we\u2019re learning about an even more brazen disregard for disclosure laws.\u2b07\ufe0f\u2b07\ufe0f<a href=\"https:\/\/t.co\/9SOFVw44BI\">https:\/\/t.co\/9SOFVw44BI<\/a><\/p>&mdash; Sheldon Whitehouse (@SenWhitehouse) <a href=\"https:\/\/twitter.com\/SenWhitehouse\/status\/1646671956559773696?ref_src=twsrc%5Etfw\">April 14, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p>Whitehouse on Thursday urged Congress to pass his&nbsp;<a href=\"https:\/\/www.whitehouse.senate.gov\/news\/release\/new-version-of-supreme-court-ethics-recusal-and-transparency-act\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court Ethics, Recusal, and Transparency (SCERT) Act<\/a>, which would strengthen recusal standards and disclosure rules on the high court and establish a clear process for investigating misconduct.<\/p>\n\n\n\n<p>The Supreme Court, which has&nbsp;<a href=\"https:\/\/prospect.org\/justice\/the-case-against-judicial-review\/\" target=\"_blank\" rel=\"noreferrer noopener\">outsized power<\/a>&nbsp;that it has recently used to roll back&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/2022\/06\/24\/dark-day-our-nation-right-wing-supreme-court-ends-constitutional-right-abortion\" target=\"_blank\" rel=\"noreferrer noopener\">basic freedoms<\/a>, is currently the only U.S. federal court&nbsp;<a href=\"https:\/\/civilrights.org\/2023\/04\/06\/the-leadership-conference-calls-on-congress-to-act-in-response-to-reports-of-justice-clarence-thomas-failing-to-disclose-lavish-gifts\/#\" target=\"_blank\" rel=\"noreferrer noopener\">without<\/a>&nbsp;a binding code of ethical conduct.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.propublica.org\/article\/clarence-thomas-harlan-crow-real-estate-scotus\" target=\"_blank\" rel=\"noreferrer noopener\">According to<\/a><em>ProPublica<\/em>, Crow&#8217;s purchase of property from Thomas and his relatives &#8220;marks the first known instance of money flowing from the Republican megadonor to the Supreme Court justice.&#8221;<\/p>\n\n\n\n<p>&#8220;The Crow company bought the properties for $133,363 from three co-owners\u2014Thomas, his mother, and the family of Thomas&#8217; late brother, according to a&nbsp;<a href=\"https:\/\/www.documentcloud.org\/documents\/23774051-sales-document-pt61\" target=\"_blank\" rel=\"noreferrer noopener\">state tax document<\/a>&nbsp;and a&nbsp;<a href=\"https:\/\/www.documentcloud.org\/documents\/23774272-warranty-deed-thomas-and-crow\" target=\"_blank\" rel=\"noreferrer noopener\">deed<\/a>&nbsp;dated Oct. 15, 2014, filed at the Chatham County courthouse,&#8221;&nbsp;<em>ProPublica<\/em>&nbsp;noted. &#8220;The purchase put Crow in an unusual position: He now owned the house where the justice\u2019s elderly mother was living. Soon after the sale was completed, contractors began work on tens of thousands of dollars of improvements on the two-bedroom, one-bathroom home, which looks out onto a patch of orange trees. The renovations included a carport, a repaired roof, and a new fence and gates.&#8221;<\/p>\n\n\n\n<p>&#8220;A&nbsp;<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/5\/13104\" rel=\"noreferrer noopener\" target=\"_blank\">federal disclosure law<\/a>&nbsp;passed after Watergate requires justices and other officials to disclose the details of most real estate sales over $1,000,&#8221; the outlet added. &#8220;<a href=\"https:\/\/www.documentcloud.org\/documents\/23774093-2014-clarence-thomas-disclosure#document\/p5\" rel=\"noreferrer noopener\" target=\"_blank\">Thomas never disclosed<\/a>&nbsp;his sale of the Savannah properties. That appears to be a violation of the law, four ethics law experts told&nbsp;<em>ProPublica<\/em>.&#8221;<\/p>\n\n\n\n<p>Whitehouse said in response that &#8220;Justice Thomas told us that he didn&#8217;t disclose free vacations on a superyacht and private jet because it was personal hospitality from a friend and that&#8217;s just what friends do.&#8221;<\/p>\n\n\n\n<p>&#8220;Well, friends don&#8217;t also buy your properties and deck them out for your family members to continue living in,&#8221; the senator added. &#8220;And if all of this was on the up and up, why didn&#8217;t Justice Thomas disclose it to the American people as the law clearly requires?
