{"id":26099,"date":"2023-04-22T13:24:07","date_gmt":"2023-04-22T20:24:07","guid":{"rendered":"https:\/\/occupysf.net\/?p=26099"},"modified":"2023-04-22T13:24:09","modified_gmt":"2023-04-22T20:24:09","slug":"even-if-trump-goes-down-democracy-is-still-at-risk","status":"publish","type":"post","link":"https:\/\/occupysf.net\/index.php\/2023\/04\/22\/even-if-trump-goes-down-democracy-is-still-at-risk\/","title":{"rendered":"EVEN IF TRUMP GOES DOWN, DEMOCRACY IS STILL AT RISK"},"content":{"rendered":"\n<p>WED, 4\/19\/2023 &#8211; BY\u00a0<a href=\"https:\/\/www.occupy.com\/author\/carl-gibson\">CARL GIBSON<\/a> (Occupy.com)<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/www.occupy.com\/sites\/default\/files\/field\/image\/trump-golden-lockup.jpg?itok=TNlB0IYx\"><img decoding=\"async\" src=\"https:\/\/www.occupy.com\/sites\/default\/files\/styles\/slide_narrow\/public\/field\/image\/trump-golden-lockup.jpg?itok=TNlB0IYx\" alt=\"\"\/><\/a><\/figure>\n\n\n\n<p>Tuesday, April 4 was cathartic for many Americans who had the impression that former President Donald Trump would never face any accountability for his actions due to his power and status. The New York District Attorney&#8217;s 34-count indictment \u2013 all&nbsp;<a href=\"https:\/\/www.vanityfair.com\/news\/2023\/04\/donald-trump-possible-prison-sentence\" target=\"_blank\" rel=\"noreferrer noopener\">class E felonies<\/a>&nbsp;for falsification of business records \u2013 marks the first time a former US president has ever been charged with a crime, and he faces a maximum sentence of 136 years in prison if found guilty on all counts.&nbsp;<\/p>\n\n\n\n<p>The chance of Trump doing that much prison time from this case is, of course, highly unlikely, but regardless, at 76 years of age, Donald Trump may very well spend the rest of his life in a prison cell given the three other ongoing criminal investigations against him. Georgia is investigating him for allegedly trying to rig the 2020 election following a phone call in which Trump pressured Georgia\u2019s top elections official to \u201c<a href=\"https:\/\/www.nytimes.com\/2021\/01\/03\/us\/politics\/trump-raffensperger-call-georgia.html\" target=\"_blank\" rel=\"noreferrer noopener\">find 11,780 votes<\/a>\u201d in order to give him Georgia\u2019s haul of electoral college votes. No indictment has yet been unveiled as of this writing, but it\u2019s believed the Georgia investigation is coming to its conclusion this spring.<\/p>\n\n\n\n<p>Still more consequential are the two Washington, DC grand juries, which are investigating him for both allegedly mishandling classified documents&nbsp;<a href=\"https:\/\/www.nytimes.com\/2021\/01\/03\/us\/politics\/trump-raffensperger-call-georgia.html\" target=\"_blank\" rel=\"noreferrer noopener\">pertaining to national security<\/a>, and for his role in instigating the deadly attack on the US Capitol on January 6, 2021. Former Vice President Mike Pence, who is presumed to be weighing his own campaign for the presidency in 2024, has been&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2023\/mar\/28\/mike-pence-testify-jan-6-trump\" target=\"_blank\" rel=\"noreferrer noopener\">compelled by a federal judge<\/a>&nbsp;to testify against Trump in that investigation. If those cases also result in indictments, that will mean Trump \u2013 who is currently the 2024 frontrunner for the Republican presidential nomination \u2013 will be in and out of courts in three separate jurisdictions during the peak of the presidential primary season early next year.<\/p>\n\n\n\n<p>While it\u2019s tempting for those wishing for criminal accountability to celebrate, multiple serious threats to democracy will continue to persist even if Donald Trump goes to prison for the rest of his life, and those who seek to protect democracy must remain vigilant.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">FAR-RIGHT REPUBLICAN FRINGE FIGURES NOW GOING MAINSTREAM<\/h3>\n\n\n\n<p>Across the United States, there are signs the Republican Party is only doubling down on the extremism that produced Donald Trump, with new far-right political figures eager to step up and be the new standard-bearer of the GOP. Congresswoman Marjorie Taylor Greene (R-Georgia) was recently given a national platform on 60 Minutes to introduce her odious brand of far-right extremism to a mainstream audience with little pushback.&nbsp;<\/p>\n\n\n\n<p>Greene \u2013 a&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/politics\/greene-qanon-house-trump-republicans\/2021\/01\/30\/321b4258-623c-11eb-ac8f-4ae05557196e_story.html\" target=\"_blank\" rel=\"noreferrer noopener\">QAnon believer<\/a>&nbsp;who was&nbsp;<a href=\"https:\/\/www.npr.org\/2021\/02\/04\/963785609\/house-to-vote-on-stripping-rep-marjorie-taylor-greene-from-2-key-committees\" target=\"_blank\" rel=\"noreferrer noopener\">stripped of her committee assignments<\/a>&nbsp;in 2021 after trafficking in racist and anti-Semitic conspiracy theories \u2013 told Semafor she expected the interview to be a \u201chit job,\u201d but remarked after its airing that she thought \u201c<a href=\"https:\/\/www.semafor.com\/article\/04\/03\/2023\/fake-news-no-more-marjorie-taylor-greenes-journey-to-60-minutes\" target=\"_blank\" rel=\"noreferrer noopener\">it was pretty good.<\/a>\u201d<\/p>\n\n\n\n<p>In one notable exchange, 60 Minutes\u2019 Leslie Stahl asked Greene about her claim that the Democratic Party is full of pedophiles and child groomers, prompting Greene to restate the claim with emphasis. Stahl\u2019s only response was to make a surprised face and utter \u201cwow\u201d while Greene smirked. Stahl failed to counter that the Republican Party has an&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2022\/04\/from-hastert-to-gaetz-lets-talk-about-republicans-and-sex-crimes.html\" target=\"_blank\" rel=\"noreferrer noopener\">overwhelmingly worse record<\/a>&nbsp;concerning pedophiles and sexual predators within its ranks:<\/p>\n\n\n\n<ul>\n<li>Former Congressman Mark Foley (R-Florida) was eventually forced to resign after it was revealed he&nbsp;<a href=\"https:\/\/www.nytimes.com\/2006\/09\/30\/us\/30foley.html\" target=\"_blank\" rel=\"noreferrer noopener\">frequently sent sexually inappropriate messages<\/a>&nbsp;to House pages who were underage.<\/li>\n\n\n\n<li>Former Republican House Speaker Dennis Hastert\u2019s history of preying on boys on the wrestling team he coached led to a 2015 guilty plea, in which the judge presiding over his trial called him a \u201c<a href=\"https:\/\/www.nytimes.com\/2016\/04\/28\/us\/dennis-hastert-sentencing.html\" target=\"_blank\" rel=\"noreferrer noopener\">serial child molester<\/a>.\u201d&nbsp;<\/li>\n\n\n\n<li>Congressman Jim Jordan (R-Ohio) has been repeatedly accused by former Ohio State University wrestlers of turning a blind eye to the team\u2019s doctor&nbsp;<a href=\"https:\/\/compliance.osu.edu\/assets\/site\/pdf\/Revised_report.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">sexually abusing them for years<\/a>.<\/li>\n\n\n\n<li>Former Alabama Republican Senate Candidate Roy Moore, who was endorsed by then-President Trump, was accused by multiple women of sexually predatory behavior toward girls&nbsp;<a href=\"https:\/\/qz.com\/1147348\/these-nine-women-have-accused-roy-moore-of-sexual-misconduct\" target=\"_blank\" rel=\"noreferrer noopener\">as young as 14<\/a>.<\/li>\n\n\n\n<li>Last year, a former Republican National Committee staffer was&nbsp;<a href=\"https:\/\/www.politico.com\/news\/2022\/04\/08\/rnc-staffer-child-porn-case-00024031\" target=\"_blank\" rel=\"noreferrer noopener\">sentenced to 12 years in prison<\/a>&nbsp;for his role in a child pornography ring involving babies.<\/li>\n\n\n\n<li>Two of Donald Trump\u2019s county-level campaign surrogates&nbsp;<a href=\"https:\/\/www.snopes.com\/fact-check\/trump-2016-chairs-trafficking\/\" target=\"_blank\" rel=\"noreferrer noopener\">in Kentucky and Oklahoma<\/a>&nbsp;are currently serving time in prison for child sex trafficking.<\/li>\n\n\n\n<li>Trump himself was accused by teenage beauty pageant contestants of&nbsp;<a href=\"https:\/\/www.buzzfeednews.com\/article\/kendalltaggart\/teen-beauty-queens-say-trump-walked-in-on-them-changing\" target=\"_blank\" rel=\"noreferrer noopener\">barging into their dressing rooms<\/a>&nbsp;while they were changing.<\/li>\n<\/ul>\n\n\n\n<p>Stahl\u2019s failure to counter Greene\u2019s extremism arguably only served to sanitize her image and further secure the far-right Congresswoman\u2019s place as a rising leader within the Republican Party.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">TRUMPIAN EXTREMISM PROLIFERATING AT THE LOCAL LEVEL<\/h3>\n\n\n\n<p>On Thursday \u2013 on the heels of a deadly mass shooting carried out by a shooter&nbsp;<a href=\"https:\/\/www.cnn.com\/2023\/03\/28\/us\/covenant-school-shooting-nashville-tennessee-tuesday\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">being treated for an emotional disorder<\/a>&nbsp;who legally obtained the firearms used to kill three nine-year-old children and three school staffers \u2013 the Republican-controlled Tennessee House of Representatives voted to expel two Democratic members of the body. The vote to expel the Democrats was put on the docket after they demonstrated on the floor of the House with a bullhorn for new firearm regulations.<\/p>\n\n\n\n<p>Three Democrats \u2013 Reps. Gloria Johnson, Justin Jones and Justin Pearson \u2013 faced expulsion over a&nbsp;<a href=\"https:\/\/www.npr.org\/2023\/04\/06\/1168363992\/tennessee-expel-3-democrats-house-vote\" target=\"_blank\" rel=\"noreferrer noopener\">violation of decorum<\/a>&nbsp;by speaking before being publicly recognized. Johnson (the lone white Democrat facing expulsion) was not expelled. However, expulsion is extremely rare, as Tennessee has only expelled members&nbsp;<a href=\"https:\/\/www.tennessean.com\/story\/news\/politics\/2023\/04\/04\/tennessee-house-expulsions-history-legislative-members\/70079648007\/\" target=\"_blank\" rel=\"noreferrer noopener\">twice since 1866<\/a>. According to the Tennessean, Republican state representative Jeremy Durham was expelled in 2016 on a 70-2 vote after nearly two dozen women accused him of sexual misconduct. And in 1980, Republican state representative Robert Fisher was expelled for accepting a $1,000 bribe. Prior to that, the last expulsions were of six representatives who tried to prevent Tennessee from recognizing the citizenship of former slaves in 1866.<\/p>\n\n\n\n<p>It\u2019s important to note that the two representatives who were expelled have since been reinstated, and according to TNLookout reporter Adam Friedman,&nbsp;<a href=\"https:\/\/twitter.com\/friedmanadam5\/status\/1644076009744916483\" target=\"_blank\" rel=\"noreferrer noopener\">representatives can\u2019t be expelled for the same thing twice<\/a>. But the cost of conducting those representatives being expelled and reinstated will nonetheless fall on local taxpayers.<\/p>\n\n\n\n<p>While the Tennessee expulsions were shocking, they\u2019re perhaps not quite as shocking as the ongoing far-right power grab taking place in Florida. Governor Ron DeSantis, who easily won reelection last year, notably signed an extreme measure into law that&nbsp;<a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/us-politics\/ron-desantis-book-bans-florida-b2270116.html\" target=\"_blank\" rel=\"noreferrer noopener\">bans books in schools<\/a>&nbsp;that are not approved by a state-appointed \u201cmedia specialist.\u201d Teachers can be prosecuted with a felony charge if non-approved books are found in classrooms.&nbsp;<\/p>\n\n\n\n<p>DeSantis also last year signed the so-called \u201c<a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/us-politics\/dont-say-gay-bill-florida-desantis-b2074720.html\" target=\"_blank\" rel=\"noreferrer noopener\">Don\u2019t Say Gay<\/a>\u201d bill into law, which prohibits discussion of LGBTQ+ related issues in elementary schools, specifically from kindergarten through third grade. Florida\u2019s Republican-controlled legislature also passed the \u201cStop WOKE Act\u201d last year, which restricts how certain topics pertaining to race, gender, and social justice are taught in public universities. However, federal courts have so far&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/floridas-stop-woke-law-remain-blocked-colleges-appeals-court-rules-rcna75455\" target=\"_blank\" rel=\"noreferrer noopener\">rejected<\/a>&nbsp;Florida\u2019s attempts to enforce it.<\/p>\n\n\n\n<p>As of 2023, Gov. DeSantis&nbsp;<a href=\"https:\/\/www.hrc.org\/press-releases\/breaking-gov-desantis-proposes-expansion-of-dont-say-lgbtq-law-to-all-grades-targeting-lgbtq-youth-and-turning-back-the-clock-on-equality\" target=\"_blank\" rel=\"noreferrer noopener\">wants to expand the Don\u2019t Say Gay law<\/a>&nbsp;to include all K-12 grades, which LGBTQ+ advocates say is designed to stigmatize and isolate LGBTQ+ kids. And a new bill introduced in the Florida House would take the Stop WOKE Act further by&nbsp;<a href=\"https:\/\/www.them.us\/story\/florida-house-bill-999-higher-education-race-gender#:~:text=News-,Florida%20Bill%20Would%20Bring%20Bans%20on%20Gender%20Studies%20and%20Critical,groups%20or%20even%20veterans'%20organizations.\" target=\"_blank\" rel=\"noreferrer noopener\">banning<\/a>&nbsp;students from majoring or minoring in gender studies, ethnic history, intersectionality, and other social justice-related fields. According to Them, an LGBTQ+ news site, the legislation \u2013 Florida House Bill 999 \u2013 is also causing some extracurricular organizations on college campuses to question whether or not it could be broadly interpreted to target them as well.&nbsp;<\/p>\n\n\n\n<p>Two other bills, House Bill 1069 and House Bill 1223, would restrict sex education in public schools to emphasize abstinence, and to prohibit the use of pronouns that don\u2019t match a child\u2019s assigned gender at birth, respectively. The bills are all expected to pass, given Republicans\u2019 large advantage in the Florida legislature. And while he hasn\u2019t yet declared his candidacy, Gov. DeSantis is expected to run for president in 2024 on his record in Florida.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">VIGILANCE PAYS OFF IN A DEMOCRACY<\/h3>\n\n\n\n<p>Even though threats to democracy are persisting across the country, there\u2019s one recent positive example of democracy enduring as a result of the vigilance of local residents. In Wisconsin, Milwaukee County Judge Janet Protasewicz recently won election to the state supreme court, which would give the court\u2019s liberal judges&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/elections\/wisconsin-supreme-court-election-liberals-win-majority-rcna77190\" target=\"_blank\" rel=\"noreferrer noopener\">a 4-3 majority<\/a>&nbsp;for the first time in 15 years. Protasewicz is replacing a retiring conservative justice and will serve a ten-year term.<\/p>\n\n\n\n<p>Protasewicz\u2019s election is particularly notable given its timing. The Badger State\u2019s highest court is set to hear a challenge to an abortion ban&nbsp;<a href=\"https:\/\/apnews.com\/article\/wisconsin-supreme-court-election-abortion-0d188b5c6f841546f98436c1ab8180fa\" target=\"_blank\" rel=\"noreferrer noopener\">dating back to 1849<\/a>&nbsp;that went unenforced prior to the US Supreme Court\u2019s overturning of the Roe v. Wade decision in 2022. With liberals in the majority, the right to abortion care is expected to prevail in Wisconsin, and it\u2019s possible the court could reject Republican-drawn Congressional maps that were designed to be overly favorable to the GOP. Protasewicz and the three other liberal-leaning justices are also now in a position to reject the Republican-controlled Wisconsin legislature\u2019s curtailing of voting rights and a slew of other bills that will require judicial review. All of this was made possible because Wisconsin residents came out to vote \u2013 the most recent election was the highest ever for a supreme court seat in a year that it didn\u2019t share a ballot with presidential candidates.<\/p>\n\n\n\n<p>Juicing turnout in heavily Democratic areas is likely what led to Protasewicz\u2019s victory. She carried liberal-leaning Dane County by an 82-18 margin, winning nearly 200,000 votes in that county alone. This is significant, as Protasewicz\u2019s statewide margin of victory was&nbsp;<a href=\"https:\/\/www.nytimes.com\/interactive\/2023\/04\/04\/us\/elections\/results-wisconsin-supreme-court.html\" target=\"_blank\" rel=\"noreferrer noopener\">roughly 203,000 votes<\/a>. Blue dots in a sea of red can indeed make a difference in statewide elections.<\/p>\n\n\n\n<p>It seems simple, but the best way to preserve democracy is to remain vigilant. Voting alone won\u2019t save democracy, but by combining the vote with other powerful tools like public protest, getting certain messaging to circulate throughout the media, and shoe-leather grassroots organizing, the most anti-democratic elements in society can be held at bay.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/www.occupy.com\/sites\/default\/files\/medialibrary\/5773abc3-412f-4672-8985-197ffceff57b-272970_1536_rgb.jpg\"><img decoding=\"async\" src=\"https:\/\/www.occupy.com\/sites\/default\/files\/medialibrary\/5773abc3-412f-4672-8985-197ffceff57b-272970_1536_rgb.jpg\" alt=\"\"\/><\/a><\/figure>\n\n\n\n<p><em>Carl Gibson is an independent journalist whose work has been published in CNN, The Guardian, The Washington Post, The Houston Chronicle, Barron\u2019s, Business Insider, the Independent, and NPR, among others.
