Dick Durbin\"\/><\/figure>\n\n\n\n<p>U.S. Senate Judiciary Chair Dick Durbin (D-Ill.) listens during a hearing on Capitol Hill in Washington, D.C. on March 16, 2023.<\/p>\n\n\n\n<p>\u00a0(Photo: Tom Williams\/CQ-Roll Call, Inc via Getty Images)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">&#8220;Harlan Crow thinks he is the law,&#8221; remarked one legal expert. &#8220;The billionaire and his lawyer apparently believe they get to stop congressional investigations if they so choose.&#8221;<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.commondreams.org\/author\/brett-wilkins\">BRETT WILKINS<\/a><\/p>\n\n\n\n<p>May 23, 2023 (CommonDreams.org)<a href=\"javascript:void(0)\"><\/a><\/p>\n\n\n\n<p>Legal experts and U.S. Senate Judiciary Chair Dick Durbin on Tuesday derided billionaire Harlan Crow&#8217;s refusal to answer the panel&#8217;s questions regarding years of gifts\u2014including&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/clarence-thomas-defense-luxury-trips\" target=\"_blank\" rel=\"noreferrer noopener\">luxury vacations<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/harlan-crow-clarence-thomas-private-school-tuition\" target=\"_blank\" rel=\"noreferrer noopener\">private school tuition<\/a>\u2014bestowed by the Republican megadonor upon Supreme Court Justice&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/clarence-thomas\">Clarence Thomas<\/a>&nbsp;and his family.<\/p>\n\n\n\n<p>In a&nbsp;<a href=\"https:\/\/s3.documentcloud.org\/documents\/23822175\/crow-letter.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a>&nbsp;to Durbin (D-Ill.) responding to requests for information about the private jet, yacht, and upstate New York resort owned by Crow and his holding companies, Michael Bopp of the law firm Gibson Dunn\u2014which represents Crow\u2014asserted that the Judiciary Committee &#8220;has not identified a valid legislative purpose for its investigation and is not authorized to conduct an ethics investigation of a Supreme Court justice.&#8221;<\/p>\n\n\n\n<p>Durbin responded to Bopp&#8217;s letter with a&nbsp;<a href=\"https:\/\/www.judiciary.senate.gov\/press\/releases\/durbin-statement-on-response-from-harlan-crow-regarding-gifts-and-travel-given-to-justice-thomas\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>&nbsp;arguing that the missive &#8220;did not provide a credible justification for the failure of Mr. Crow and three corporate entities to respond to the committee&#8217;s written questions.&#8221;<\/p>\n\n\n\n<p><strong><\/strong>&#8220;First of all, the committee did not receive individual responses from anyone representing the three companies,&#8221; Durbin said. &#8220;That is untenable since the gifts and access to justices that these companies provided are highly relevant to the committee&#8217;s legislative efforts on ethics reform.&#8221;<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">SCOOP: Here&#39;s the letter that Justice Clarence Thomas&#39;s benefactor Harlan Crow sent to the Senate Judiciary Committee last night. He is wrong.&#8221;<\/p>\n\n\n\n<p>Chris Geidner, a former legal editor and Supreme Court correspondent for&nbsp;<em>BuzzFeed News<\/em>,&nbsp;<a href=\"https:\/\/www.lawdork.com\/p\/harlan-crow-thinks-he-is-the-law?utm_source=post-email-title&amp;publication_id=899862&amp;post_id=123332883&amp;isFreemail=true&amp;utm_medium=email\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>&nbsp;on his&nbsp;<em>Law Dork<\/em>&nbsp;Substack:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>What is perhaps most remarkable about the letter is not even its dismissal of the congressional oversight request\u2014which absolutely must be followed at the earliest possible moment by the committee&#8217;s issuance of a subpoena\u2014but, rather, the underlying basis for that decision. In the letter, Bopp concludes\u2014again, on Crow&#8217;s behalf\u2014that &#8220;Congress lacks the authority&#8221; to pass ethics legislation relating to the Supreme Court.<\/p>\n\n\n\n<p>Bopp cannot state that as a matter of law\u2014and dismiss Durbin&#8217;s request based on that knowledge. This is so because Chief Justice John Roberts himself has acknowledged that Congress has&nbsp;<em>already passed<\/em>&nbsp;ethics legislation that applies to the justices. What&#8217;s more, Roberts also explained in&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/publicinfo\/year-end\/2011year-endreport.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">2011<\/a>&nbsp;that the court has never addressed whether Congress can do so but that the justices &#8220;nevertheless comply with those provisions.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p>&#8220;Harlan Crow thinks he is the law,&#8221; Geidner contended. &#8220;The billionaire and his lawyer apparently believe they get to stop congressional investigations if they so choose.&#8221;<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">the tl;dr of this letter is &quot;the separation of powers means supreme court justices can do whatever they want &amp; congress can&#39;t do shit about it.&quot;<br><br>(can&#39;t wait to read neil gorsuch&#39;s ~fantastico~ rewriting of this into a supreme court opinion.) <a href=\"https:\/\/t.co\/ve7a1b04TS\">https:\/\/t.co\/ve7a1b04TS<\/a><\/p>&mdash; Leah Litman (@LeahLitman) <a href=\"https:\/\/twitter.com\/LeahLitman\/status\/1661064575255560193?ref_src=twsrc%5Etfw\">May 23, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p><em>MSNBC<\/em>&nbsp;legal analyst Jordan Rubin, a former Manhattan prosecutor,&nbsp;<a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/harlan-crow-clarence-thomas-senate-judiciary-committee-response-rcna85869\" target=\"_blank\" rel=\"noreferrer noopener\">quipped<\/a>&nbsp;that Crow&#8217;s &#8220;arrogant and misguided&#8221; response to Durbin &#8220;practically begs for a subpoena.&#8221;<\/p>\n\n\n\n<p>Rubin&#8217;s remarks echo&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/subpoena-clarence-thomas-harlan-crow\" target=\"_blank\" rel=\"noreferrer noopener\">progressive calls<\/a>&nbsp;to subpoena both Crow and Thomas.<\/p>\n\n\n\n<p>In addition to Durbin, Senate Finance Committee Chair Ron Wyden (D-Ore.) has also asked Crow to account for gifts he gave to Thomas and his family, and called the billionaire&#8217;s rationale for not doing so &#8220;a joke.&#8221;<\/p>\n\n\n\n<p>&#8220;The bottom line is that nobody can expect to get away with waving off finance committee oversight, no matter how wealthy or well-connected they may be,&#8221; Wyden&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/wyden-clarence-thomas-billionaire-friend\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;earlier this month.<\/p>\n\n\n\n<p>Our work is licensed under Creative Commons (CC BY-NC-ND 3.0).
