This was true before the latest round of scandals involving Clarence Thomas, and it remains true in their aftermath. Roberts may be an \u201c<a href=\"https:\/\/newrepublic.com\/article\/168051\/john-roberts-lost-control-supreme-court\" rel=\"noreferrer noopener\" target=\"_blank\">institutionalist<\/a>,\u201d as he is often labeled by mainstream legal commentators, but he appears to be just fine with the direction and management of the institution he leads. Far from being a potential savior of the court, Roberts is at the center of its many burgeoning problems.<\/p>\n\n\n\n<p>On April 10, the eleven Democratic Senators who hold a slim majority on the upper chamber\u2019s judiciary committee cosigned a respectful&nbsp;<a href=\"https:\/\/www.durbin.senate.gov\/imo\/media\/doc\/Letter%20from%20Chair%20Durbin%20to%20Chief%20Justice%20Roberts%20-%204.10.23.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">letter<\/a>&nbsp;to Roberts, imploring him to open an investigation into Thomas\u2019s failure to disclose a stunning&nbsp;<a href=\"https:\/\/progressive.org\/latest\/unequal-justice-clarence-thomas-isn%E2%80%99t-going-anywhere-blum-140423\/\" rel=\"noreferrer noopener\" target=\"_blank\">array of gifts<\/a>&nbsp;that he and his wife Ginni Thomas, the crackpot uber-right election denier, had received from Texas billionaire and Republican mega-donor&nbsp;<a href=\"https:\/\/www.businessinsider.com\/who-is-harlan-crow-clarence-thomas-trips-billionaire-gop-megadonor-2023-4\" rel=\"noreferrer noopener\" target=\"_blank\">Harlan Crow<\/a>&nbsp;over the past twenty years.&nbsp;On April 20, they sent&nbsp;<a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/chair_durbin_invitation_to_chief_justice_roberts_to_testify_before_sjc.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">a second letter<\/a>, inviting Roberts to testify on May 2 about the need for ethics reform on the court.&nbsp;<\/p>\n\n\n\n<p>On April 25, Roberts&nbsp;<a href=\"https:\/\/s3.documentcloud.org\/documents\/23789636\/roberts-letter-to-durbin-4-25-2023.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">rebuffed the solicitations<\/a>, writing \u201cI must respectfully decline your invitation. Testimony before the Senate Judiciary Committee by the chief justice of the United States is exceedingly rare as one might expect in light of separation of powers concerns and the importance of preserving judicial independence.\u201d&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Far from being a potential savior of the court, Roberts is at the center of its many burgeoning problems.<\/p>\n<\/blockquote>\n\n\n\n<p>Roberts attached a six-page \u201c<a href=\"https:\/\/s3.documentcloud.org\/documents\/23789636\/roberts-letter-to-durbin-4-25-2023.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">Statement on Ethics Principles and Practices<\/a>\u201d to his letter, signed by all nine sitting justices. The statement asserted that the justices \u201cconsult a wide a wide variety of authorities to address specific ethical issues. They may turn to judicial opinions, treatises, scholarly articles, disciplinary decisions, and the historical practice of the Court and the federal judiciary. They may also seek advice from the Court\u2019s Legal Office and from their colleagues.\u201d&nbsp;<\/p>\n\n\n\n<p>The ethics statement further claimed that the court \u201ctakes guidance from\u201d the&nbsp;<a href=\"https:\/\/www.uscourts.gov\/judges-judgeships\/code-conduct-united-states-judges\" rel=\"noreferrer noopener\" target=\"_blank\">Judicial Code of Conduct for U.S. Judges<\/a>, although it also correctly noted that the code \u201capplies by its terms only to lower court federal judges.\u201d The Supreme Court stands alone as the only federal judicial body not bound by an ethics code.&nbsp;<\/p>\n\n\n\n<p>Roberts\u2019s response was not his first snub of the Senate Judiciary Committee. In February 2012, he&nbsp;<a href=\"https:\/\/www.durbin.senate.gov\/imo\/media\/doc\/letter_from_chair_durbin_to_chief_justice_roberts_-_021312.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">rejected the committee\u2019s request<\/a>&nbsp;that the court officially adopt the federal code of conduct. That request was triggered by&nbsp;<a href=\"https:\/\/abcnews.go.com\/Politics\/Supreme_Court\/justice-clarence-thomas-amends-financial-disclosure-reports-virginia\/story?id=12750650\" rel=\"noreferrer noopener\" target=\"_blank\">Thomas\u2019s failure to report his wife\u2019s income<\/a>&nbsp;from the Heritage Foundation, Hillside College, and other employers on his annual financial disclosure forms, as required by the&nbsp;<a href=\"https:\/\/www.ojp.gov\/ncjrs\/virtual-library\/abstracts\/ethics-government-act-1978-public-law-95-521-october-26-1978\" rel=\"noreferrer noopener\" target=\"_blank\">Ethics in Government Act<\/a>. After the watchdog group&nbsp;<a href=\"https:\/\/www.commoncause.org\/resource\/supreme-conflict\/\" rel=\"noreferrer noopener\" target=\"_blank\">Common Cause<\/a>&nbsp;<a href=\"https:\/\/www.theatlantic.com\/national\/archive\/2011\/06\/clarence-thomas-ethics-violations\/351905\/\" rel=\"noreferrer noopener\" target=\"_blank\">publicly complained about the issue<\/a>&nbsp;in January 2011, Thomas&nbsp;<a href=\"https:\/\/www.politico.com\/story\/2011\/01\/thomas-revises-disclosure-forms-048086\" rel=\"noreferrer noopener\" target=\"_blank\">amended some thirteen-years\u2019 worth of disclosures<\/a>.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>The embarrassing episode, however, had no discernible impact on Roberts. Without specifically referring to Thomas, Roberts praised his colleagues in his&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/publicinfo\/year-end\/2011year-endreport.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">2011 Year-End report on the Federal Judiciary<\/a>&nbsp;as \u201cjurists of exceptional integrity and experience whose character and fitness have been examined through a rigorous appointment and confirmation process . . . We are all deeply committed to the common interest in preserving the Court\u2019s vital role as an impartial tribunal governed by the rule of law.\u201d<\/p>\n\n\n\n<p>In fact, Roberts has spent nearly his entire legal career as a highly partial rightwing operative, dating back to his stint as a&nbsp;<a href=\"https:\/\/www.politico.com\/magazine\/story\/2015\/08\/john-roberts-voting-rights-act-121222\/#:~:text=Roberts%20began%20clerking%20for%20Justice,experience%20for%20the%20young%20lawyer.\" rel=\"noreferrer noopener\" target=\"_blank\">clerk for the late Supreme Court Chief Justice William Rehnquist<\/a>&nbsp;after he graduated from Harvard Law School. In 1981, Roberts&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/archive\/politics\/2005\/07\/27\/documents-show-roberts-influence-in-reagan-era\/f7f2cbb4-f3fe-45a0-8902-0f11b1ce6004\/\" rel=\"noreferrer noopener\" target=\"_blank\">took a job<\/a>&nbsp;as special assistant to then-Attorney General William French Smith, becoming,&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/opinions\/2022\/11\/04\/supreme-court-john-roberts-tragedy-ruth-marcus\/\" rel=\"noreferrer noopener\" target=\"_blank\">in the words of<\/a>&nbsp;<em>Washington Post<\/em>&nbsp;columnist Ruth Marcus, a \u201cloyal foot soldier in President Ronald Reagan\u2019s legal revolution\u201d aimed at rolling back the regulatory framework of the New Deal, and restricting the gains of the civil rights movement. In one particularly aggressive&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/wp-srv\/nation\/documents\/roberts_appellate_jurisdiction.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">legal memo<\/a>, he urged the Reagan Justice Department to&nbsp;<a href=\"https:\/\/www.americanprogress.org\/article\/judge-roberts-and-the-court-stripping-movement\/\" rel=\"noreferrer noopener\" target=\"_blank\">support legislation<\/a>&nbsp;to strip the Supreme Court of jurisdiction over abortion, busing, and school prayer cases. The proposal was deemed too radical even for the Reagan Administration, and failed to gain traction.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Other&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/John_Roberts#Early_legal_career\" rel=\"noreferrer noopener\" target=\"_blank\">early stops in Roberts\u2019s career<\/a>&nbsp;included his service as an associate White House counsel from 1982 to 1986, and his work from 1989 to 1992 as principal deputy solicitor general in the administration of George H.W. Bush.&nbsp;<\/p>\n\n\n\n<p>Roberts left the public sector after the election of Bill Clinton, but maintained his role as a Republican insider. According to investigative reporter Marc Caputo,&nbsp;<a href=\"https:\/\/bellaciao.org\/en\/Roberts-had-larger-2000-recount-role\" rel=\"noreferrer noopener\" target=\"_blank\">Roberts operated<\/a>&nbsp;as a behind-the-scenes GOP \u201cconsultant, lawsuit editor, and prep coach for arguments before the Supreme Court\u201d in the run-up to&nbsp;<a href=\"https:\/\/www.oyez.org\/cases\/2000\/00-949\" rel=\"noreferrer noopener\" target=\"_blank\"><em>Bush v. Gore<\/em><\/a>, the case that decided the 2000 presidential election. Roberts was recruited to the Bush team by none other than Ted Cruz, then a young and very conservative Harvard-educated lawyer who had once also clerked for Rehnquist. &nbsp;<\/p>\n\n\n\n<p>Since assuming the post of Chief Justice, Roberts has led the court on a rightwing trajectory, betraying the pledge he made at his&nbsp;<a href=\"https:\/\/www.truthdig.com\/articles\/john-roberts-field-of-play\/\">2005 confirmation hearing<\/a>&nbsp;to serve in the fashion of a baseball umpire, \u201ccalling only balls and strikes, and not to pitch or bat.\u201d Under his stewardship, the court has issued a blistering array of extremist rulings on&nbsp;<a href=\"https:\/\/www.oyez.org\/cases\/2012\/12-96\" rel=\"noreferrer noopener\" target=\"_blank\">voting rights<\/a>,&nbsp;<a href=\"https:\/\/www.oyez.org\/cases\/2018\/18-422\" rel=\"noreferrer noopener\" target=\"_blank\">gerrymandering<\/a>,&nbsp;<a href=\"https:\/\/www.oyez.org\/cases\/2017\/16-1466\" rel=\"noreferrer noopener\" target=\"_blank\">union<\/a>&nbsp;<a href=\"https:\/\/www.reuters.com\/world\/us\/us-supreme-court-curbs-union-power-farm-access-dispute-2021-06-23\/\" rel=\"noreferrer noopener\" target=\"_blank\">organizing<\/a>,&nbsp;<a href=\"https:\/\/casetext.com\/case\/glossip-v-gross\" rel=\"noreferrer noopener\" target=\"_blank\">the death penalty<\/a>,&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-1530_n758.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">environmental protection<\/a>,&nbsp;<a href=\"https:\/\/tile.loc.gov\/storage-services\/service\/ll\/usrep\/usrep554\/usrep554570\/usrep554570.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">gun<\/a>&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">control<\/a>,&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/19-1392_6j37.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">abortion<\/a>,&nbsp;<a href=\"https:\/\/www.oyez.org\/cases\/2008\/08-205\" rel=\"noreferrer noopener\" target=\"_blank\">campaign finance<\/a>, and the&nbsp;<a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/americans-for-prosperity-foundation-v-becerra\/\" rel=\"noreferrer noopener\" target=\"_blank\">use of dark money<\/a>&nbsp;in politics. His 2013 majority opinion in&nbsp;<a href=\"https:\/\/www.oyez.org\/cases\/2012\/12-96\" rel=\"noreferrer noopener\" target=\"_blank\"><em>Shelby County v. Holder<\/em><\/a>, which gutted the Voting Rights Act, ranks among the worst.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Nor is Roberts above suspicion when it comes to potential personal conflicts of interest. His wife Jane Sullivan Roberts has a long history&nbsp;<a href=\"https:\/\/www.businessinsider.com\/jane-john-roberts-anti-abortion-husband-supreme-court-roe-wade-2023-5\" rel=\"noreferrer noopener\" target=\"_blank\">as an anti-abortion activist<\/a>. She also reportedly&nbsp;<a href=\"https:\/\/www.businessinsider.com\/jane-john-roberts-anti-abortion-husband-supreme-court-roe-wade-2023-5\" rel=\"noreferrer noopener\" target=\"_blank\">made more than $10 million<\/a>&nbsp;in commissions between 2007 to 2014 as a legal recruiter for blue-chip law firms, some of which&nbsp;<a href=\"https:\/\/www.nytimes.com\/2023\/01\/31\/us\/john-roberts-jane-sullivan-roberts.html\" rel=\"noreferrer noopener\" target=\"_blank\">had business before the Supreme Court<\/a>.&nbsp;<\/p>\n<\/blockquote>\n\n\n\n<p>Nor is Roberts above suspicion when it comes to potential personal conflicts of interest.
