Alexandria Ocasio-Cortez.<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.commondreams.org\/author\/jessica-corbett\">JESSICA CORBETT<\/a><\/p>\n\n\n\n<p>Jul 28, 2023 (CommonDreams.org)<a href=\"javascript:void(0)\"><\/a><\/p>\n\n\n\n<p>While conservative Justice Samuel Alito&#8217;s new&nbsp;<em>Wall Street Journal<\/em><a href=\"https:\/\/www.wsj.com\/amp\/articles\/samuel-alito-the-supreme-courts-plain-spoken-defender-precedent-ethics-originalism-5e3e9a7\" target=\"_blank\" rel=\"noreferrer noopener\">interview<\/a>&nbsp;covered various topics, one that provoked intense ire on Friday was his suggestion that federal lawmakers don&#8217;t have the power to regulate the U.S. Supreme Court.<\/p>\n\n\n\n<p>For a series of&nbsp;<em>Journal<\/em>&nbsp;opinion pieces\u2014the first was&nbsp;<a href=\"https:\/\/www.wsj.com\/amp\/articles\/justice-samuel-alito-this-made-us-targets-of-assassination-dobbs-leak-abortion-court-74624ef9\" target=\"_blank\" rel=\"noreferrer noopener\">published<\/a>&nbsp;in April\u2014Alito spent four hours speaking on the record with David B. Rivkin Jr., an attorney who currently has a case before the high court, and James Taranto, the newspaper&#8217;s editorial features editor.<\/p>\n\n\n\n<p>The latest piece comes after&nbsp;<em>ProPublica<\/em><a href=\"https:\/\/www.commondreams.org\/news\/alito-private-jet-billionaire\">revealed<\/a>&nbsp;in June that Alito took a previously undisclosed 2008 fishing trip to Alaska on a private jet belonging to hedge fund billionaire Paul Singer, an excursion organized by Federalist Society leader Leonard Leo.<\/p>\n\n\n\n<p><em>ProPublica<\/em>&#8216;s reporting prompted Alito to&nbsp;<a href=\"https:\/\/www.wsj.com\/articles\/propublica-misleads-its-readers-alito-gifts-disclosure-alaska-singer-23b51eda\" rel=\"noreferrer noopener\" target=\"_blank\">defend himself<\/a>&nbsp;last month with his own&nbsp;<em>Journal<\/em>&nbsp;opinion piece and his vacation was among the mounting ethics concerns regarding justices that&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/supreme-court-code-of-ethics\" target=\"_blank\" rel=\"noreferrer noopener\">led<\/a>&nbsp;Democrats on the U.S. Senate Judiciary Committee last week to advance Sen. Sheldon Whitehouse&#8217;s (D-R.I.) Supreme Court Ethics, Recusal, and Transparency Act without any GOP support.<\/p>\n\n\n\n<p>Pointing to the panel&#8217;s vote, Rivkin and Taranto wrote Friday:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Justice Alito says he voluntarily follows disclosure statutes that apply to lower court judges and executive branch officials; so do the other justices. But he notes that &#8220;Congress did not create the Supreme Court&#8221;\u2014the Constitution did. &#8220;I know this is a controversial view, but I&#8217;m willing to say it,&#8221; he says. &#8220;No provision in the Constitution gives them the authority to regulate the Supreme Court\u2014period.&#8221;<\/p>\n\n\n\n<p>Do the other justices agree? &#8220;I don&#8217;t know that any of my colleagues have spoken about it publicly, so I don\u2019t think I should say. But I think it is something we have all thought about.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p>&#8220;This is wrong and frightening,&#8221;&nbsp;<a href=\"https:\/\/twitter.com\/SIfill_\/status\/1685017483470671872\" target=\"_blank\" rel=\"noreferrer noopener\">declared<\/a>&nbsp;Sherrilyn Ifill former president and director-counsel of the Legal Defense Fund. &#8220;Justice Alito\u2014and I&#8217;m certain not only Justice Alito\u2014believes that the Supreme Court is a branch of our [government] that is unchecked and unaccountable, and unreachable by the power of Congress.&#8221;<\/p>\n\n\n\n<p>Ifill was among many legal experts and lawmakers who took issue with Alito&#8217;s remarks, with many citing the U.S. Constitution.<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">love to be an originalist or a textualist or whatever who somehow has never read the section authorizing the existence of his court <a href=\"https:\/\/t.co\/fJKSm19wz5\">https:\/\/t.co\/fJKSm19wz5<\/a> <a href=\"https:\/\/t.co\/2Djn9nZeiB\">pic.twitter.com\/2Djn9nZeiB<\/a><\/p>&mdash; b-boy bouiebaisse (@jbouie) <a href=\"https:\/\/twitter.com\/jbouie\/status\/1685002496807235585?ref_src=twsrc%5Etfw\">July 28, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p>&#8220;Article III, Section 2 would like to have a word,&#8221;&nbsp;<a href=\"https:\/\/twitter.com\/SeanCasten\/status\/1685009140781895680\" target=\"_blank\" rel=\"noreferrer noopener\">tweeted<\/a>&nbsp;Congressman Sean Casten (D-Ill.). That part of the Constitution&nbsp;<a href=\"https:\/\/constitution.congress.gov\/browse\/article-3\/section-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">states<\/a>: &#8220;In all cases affecting ambassadors, other public ministers and consuls, and those in which a state shall be party, the Supreme Court shall have original jurisdiction. In all the other cases before mentioned, the Supreme Court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.&#8221;<\/p>\n\n\n\n<p>Georgetown University Law Center professor Josh Chafetz&nbsp;<a href=\"https:\/\/twitter.com\/joshchafetz\/status\/1685000548863598594\" target=\"_blank\" rel=\"noreferrer noopener\">highlighted<\/a>&nbsp;that section of the Constitution and three others about the law-making power of Congress, appropriations for the judicial branch, and the ability of federal lawmakers to impeach judges.<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Alito to the Constitution: \u201cnot true\u201d <a href=\"https:\/\/t.co\/PiVHU9490T\">https:\/\/t.co\/PiVHU9490T<\/a><\/p>&mdash; Leah Litman (@LeahLitman) <a href=\"https:\/\/twitter.com\/LeahLitman\/status\/1685008760698273792?ref_src=twsrc%5Etfw\">July 28, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p>&#8220;Alito&#8217;s unethical grift is matched only by his arrogance,&#8221;&nbsp;<a href=\"https:\/\/twitter.com\/BobVanceJr\/status\/1685036613489856513\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;attorney and former judge Bob Vance. &#8220;BTW, he&#8217;s wrong. The Congress has the power of the purse, controlling funds allocated to the federal judiciary. It can also alter the size of the Supreme Court, which it has done in the past.&#8221;<\/p>\n\n\n\n<p>U.S. Rep. Ted Lieu (D-Calif.) addressed the justice directly,&nbsp;<a href=\"https:\/\/twitter.com\/tedlieu\/status\/1685016061941252097\" target=\"_blank\" rel=\"noreferrer noopener\">writing<\/a>: &#8220;Dear Justice Alito: You&#8217;re on the Supreme Court in part because Congress expanded the court to nine justices. Congress can impeach justices and can in many cases strip the court of jurisdiction. Congress has always regulated you and will continue to do so. You are not above the law.&#8221;<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Justice Alito might not like Congress stepping in, but Congress has been the only body willing to act on the Court\u2019s full blown corruption crisis. Brian Schatz (D-Hawaii) suggested Alito&#8217;s comments could have consequences,&nbsp;<a href=\"https:\/\/twitter.com\/brianschatz\/status\/1685026045613801472\" rel=\"noreferrer noopener\" target=\"_blank\">saying<\/a>&nbsp;that &#8220;this seems escalatory, and nudges even reluctant court watchers and skeptics of statutory reforms towards doing something. But, for the record, Article III judges are not supposed to issue advisory opinions on constitutional questions that are not presented to them in case or controversy that their court properly has jurisdiction over.&#8221;<\/p>\n\n\n\n<p>Rep.&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/alexandria-ocasio-cortez\">Alexandria Ocasio-Cortez<\/a>&nbsp;(D-N.Y.), who earlier this month&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/aoc-calls-out-dangerous-authoritarian-expansion-of-power-in-the-supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">sounded the alarm<\/a>&nbsp;about &#8220;a dangerous creep toward authoritarianism and centralization of power in the court,&#8221; also took aim at Alito on Friday.<\/p>\n\n\n\n<p>&#8220;What a surprise, guy who is supposed to enforce checks and balances thinks checks shouldn&#8217;t apply to him. Too bad!&#8221; she&nbsp;<a href=\"https:\/\/twitter.com\/AOC\/status\/1685028166593613824\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>. &#8220;Corruption and abuse of power must be stopped, no matter the source. In fact, the court should be *most* subject to scrutiny, [because] it is unelected and life-appointed.&#8221;<\/p>\n\n\n\n<p>&#8220;Alito&#8217;s next opinion piece in the&nbsp;<em>WSJ<\/em>&nbsp;is about to be &#8216;I am a little king, actually. The Constitution doesn\u2019t explicitly say I&#8217;m not,'&#8221; the congresswoman added. &#8220;And it&#8217;d be boosted by some billionaire who secretly thinks voting rights should only belong to landed gentry.&#8221;<\/p>\n\n\n\n<p>Other critics called out Rivkin, who not only co-authored the pair of&nbsp;<em>Journal<\/em>&nbsp;pieces but also represents appellants in the tax case&nbsp;<a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/moore-v-united-states-3\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Moore v. United States<\/em><\/a>, which the court has agreed to hear in its upcoming session.<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">David Rivkin landed a fawning on-the-record interview with Alito shortly after the Supreme Court took up Rivkin\u2019s case seeking to roll back the federal income tax.
