Charles Graner tortures hooded and handcuffed prisoners at Abu Ghraib prison outside Baghdad, Iraq.<\/p>\n\n\n\n<p>&nbsp;(Photo: U.S. Army Criminal Investigation Command)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">&#8220;The ruling has cleared the way, almost 20 years hence, for our clients to tell their story in open court,&#8221; said the legal director at the Center for Constitutional Rights, which filed suit on behalf of detainees.<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.commondreams.org\/author\/brett-wilkins\">BRETT WILKINS<\/a><\/p>\n\n\n\n<p>Aug 02, 2023  (ClommonDreams.org)<a href=\"javascript:void(0)\"><\/a><\/p>\n\n\n\n<p>Survivors of torture at the hands of U.S. troops and private interrogators cheered a federal judge&#8217;s rejection this week of an infamous military contractor&#8217;s latest bid to dismiss a lawsuit brought by Iraqis formerly jailed in the notorious Abu Ghraib prison during the early years of the American-led occupation.<\/p>\n\n\n\n<p>On Monday, Judge Leonie Brinkema of the U.S. District Court for the Eastern District of Virginia in Alexandria&nbsp;<a href=\"https:\/\/ccrjustice.org\/sites\/default\/files\/attach\/2023\/07\/1390_7-31-23_Order-MTD.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">refused to dismiss<\/a>&nbsp;the&nbsp;<a href=\"https:\/\/ccrjustice.org\/AlShimari\" target=\"_blank\" rel=\"noreferrer noopener\">torture suit<\/a>&nbsp;against&nbsp;<a href=\"https:\/\/www.caci.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CACI Premier Technology<\/a>, a military-industrial complex linchpin based in nearby Arlington with more than 22,000 employees and billions of dollars in government contracts.<\/p>\n\n\n\n<p>&#8220;I am so happy to receive the news that our case can proceed toward trial.&#8221;<\/p>\n\n\n\n<p>The lawsuit against CACI\u2014filed in 2008 by the Center for Constitutional Rights on behalf of former detainees Suhail Al Shimari, Asa&#8217;ad Al Zuba&#8217;e, and Salah Al-Ejaili\u2014alleges that company officials conspired with U.S. military personnel in subjecting the plaintiffs to torture and other crimes. A 2004&nbsp;<a href=\"https:\/\/www.thetorturedatabase.org\/files\/foia_subsite\/pdfs\/fay_jones_kern_report.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">investigation<\/a>&nbsp;by U.S. Army Lt. Gen. Anthony Jones and Maj. Gen. George Fay found that CACI employees participated in and encouraged the torture of Abu Ghraib prisoners.<\/p>\n\n\n\n<p>&#8220;I am so happy to receive the news that our case can proceed toward trial,&#8221; plaintiff&nbsp;<a href=\"https:\/\/ccrjustice.org\/salah-al-ejaili\" target=\"_blank\" rel=\"noreferrer noopener\">Salah Al-Ejaili<\/a>\u2014an&nbsp;<em>Al Jazeera<\/em>&nbsp;journalist imprisoned and tortured for two months at Abu Ghraib\u2014said in a&nbsp;<a href=\"https:\/\/ccrjustice.org\/home\/press-center\/press-releases\/judge-sides-abu-ghraib-torture-survivors-refuses-dismiss-historic\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>&nbsp;Tuesday.<\/p>\n\n\n\n<p>&#8220;I have stayed patient and hopeful during the two years we have waited for this decision\u2014and throughout the nearly two decades since I was abused at Abu Ghraib\u2014that one day I would achieve justice and accountability in a U.S. court,&#8221; he added. &#8220;Today brings me and the other plaintiffs one step closer.&#8221;<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">After 20 years, a trial about US contractor complicity at Abu Ghraib is within reach. Gen. Antonio Taguba.<\/p>\n\n\n\n<p>Beatings, death threats, and sexual, religious, and racial abuse were commonplace. Prisoners\u2014up to 90% of whom were innocent, according to a&nbsp;<a href=\"http:\/\/www.derechos.org\/nizkor\/us\/doc\/icrc-prisoner-report-feb-2004.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Red Cross report<\/a>\u2014were also menaced or attacked by trained dogs, forced to masturbate in groups in front of male and female interrogators, and were raped by men and objects, in one instance while a female soldier photographed the teenaged victim. (@democracynow) <a href=\"https:\/\/twitter.com\/democracynow\/status\/1684548086771732482?ref_src=twsrc%5Etfw\">July 27, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p>In addition to men, women\u2014some of whom&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/2004\/may\/20\/iraq.gender\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;they were raped or sexually abused by their U.S. captors\u2014were held at Abu Ghraib as&nbsp;<a href=\"https:\/\/www.foxnews.com\/story\/female-prisoners-bargaining-chips\" target=\"_blank\" rel=\"noreferrer noopener\">bargaining chips<\/a>&nbsp;meant to coerce wanted males to surrender to occupation authorities. One woman&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/2004\/sep\/20\/usa.iraq\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;she was thrown in a cell with the bloody corpse of her brother, one of dozens of Abu Ghraib detainees who&nbsp;<a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC1868355\/\" target=\"_blank\" rel=\"noreferrer noopener\">died<\/a>&nbsp;at the hands of U.S. troops, from medical neglect, or shelling by Iraqi insurgents.<\/p>\n\n\n\n<p>Photographs of smiling U.S. troops posing beside the body&nbsp;<a href=\"https:\/\/www.thetorturedatabase.org\/files\/foia_subsite\/3._profile_homicide_manadel_al-jamadi--c05950958.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Manadel al-Jamadi<\/a>, who was tortured to death at Abu Ghraib, were among the hundreds of&nbsp;<a href=\"https:\/\/www.newyorker.com\/magazine\/2004\/05\/10\/torture-at-abu-ghraib\" target=\"_blank\" rel=\"noreferrer noopener\">horrific images<\/a>&nbsp;that shocked the world&#8217;s conscience upon their release after Army whistleblower&nbsp;<a href=\"https:\/\/www.npr.org\/2006\/08\/15\/5651609\/abu-ghraib-whistleblower-speaks-out\" target=\"_blank\" rel=\"noreferrer noopener\">Sgt. Joe Darby<\/a>&nbsp;leaked them.<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Sgt. Gen. Janis Karpinski, the prison&#8217;s commanding officer, was demoted, no other high-ranking military officer faced accountability for the abuse. Nor did any of the&nbsp;<a href=\"https:\/\/www.salon.com\/2009\/05\/18\/torture_25\/\" target=\"_blank\" rel=\"noreferrer noopener\">officials in the George W. Bush administration<\/a>&nbsp;or the Central Intelligence Agency who devised, approved, and ordered the torture of detainees in the so-called War on Terror.<\/p>\n\n\n\n<p>CACI\u2014which has tried to get the case dropped 18 times\u2014argues it is not responsible for its employees&#8217; torture of Abu Ghraib prisoners, this time unsuccessfully citing the U.S. Supreme Court&#8217;s 2021&nbsp;<em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/19-416_i4dj.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Doe v. Nestle<\/a><\/em>&nbsp;decision. In that case, the justices&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/2021\/06\/17\/dangerous-precedent-us-high-court-sides-corporate-giants-nestle-and-cargill-child\" target=\"_blank\" rel=\"noreferrer noopener\">ruled 8-1<\/a>&nbsp;that companies could not be sued under the&nbsp;<a href=\"https:\/\/www.law.cornell.edu\/wex\/alien_tort_statute\" target=\"_blank\" rel=\"noreferrer noopener\">Alien Tort Statute<\/a>\u2014which grants federal courts jurisdiction over civil suits brought by foreign nationals alleging violations of international law\u2014for their&nbsp;<a href=\"https:\/\/www.internationalrightsadvocates.org\/cases\/doevsnestlecargill\" target=\"_blank\" rel=\"noreferrer noopener\">alleged complicity<\/a>&nbsp;in the trafficking and enslavement of West African children in the cocoa industry.<\/p>\n\n\n\n<p>In 2013, CACI shocked observers by&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/2013\/08\/14\/abu-ghraib-torture-victims-sued-their-torturers?quicktabs_1=0\" target=\"_blank\" rel=\"noreferrer noopener\">suing<\/a>&nbsp;four of the former Abu Ghraib plaintiffs for $15,000 in witness fees, travel allowances, and deposition transcripts incurred by the multibillion-dollar corporation.<\/p>\n\n\n\n<p>Also in 2013, another contractor, Engility Holdings\u2014formerly known as L-3 Services and Titan Corp.\u2014<a href=\"https:\/\/www.commondreams.org\/news\/2013\/01\/09\/us-contractor-hook-abu-ghraib-torture-token-payment\" target=\"_blank\" rel=\"noreferrer noopener\">agreed to pay $5.28 million<\/a>&nbsp;to 71 former prisoners tortured at Abu Ghraib and other U.S. detention sites in Iraq during the American occupation.<\/p>\n\n\n\n<p>Center for Constitutional Rights legal director Baher Azmy&nbsp;<a href=\"https:\/\/ccrjustice.org\/home\/press-center\/press-releases\/judge-sides-abu-ghraib-torture-survivors-refuses-dismiss-historic\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;Brinkema&#8217;s decision &#8220;affirms that the human rights norms vindicated by the Alien Tort Statute remain vital and are available to address a case revealing substantial evidence identified by the court that CACI facilitated and promoted the torture and abuse of detainees at Abu Ghraib.&#8221;<\/p>\n\n\n\n<p>&#8220;The ruling,&#8221; Azmy added, &#8220;has cleared the way, almost 20 years hence, for our clients to tell their story in open court.&#8221;<\/p>\n\n\n\n<p>Our work is licensed under Creative Commons (CC BY-NC-ND 3.0).
