who are suing their state gather for a group photo before their case becomes the first climate-related constitutional challenge to make it to court.\"\/><\/a><\/figure>\n\n\n\n<p><a href=\"https:\/\/www.cnn.com\/2023\/06\/16\/us\/montana-climate-constitution-trial\/index.html\"><\/a><a href=\"https:\/\/www.cnn.com\/2023\/06\/16\/us\/montana-climate-constitution-trial\/index.html\">The &#8216;climate kids&#8217; want a court to force Montana&#8217;s state government to go green<\/a><\/p>\n\n\n\n<p>While Seeley\u2019s ruling won\u2019t prevent mining or burning fossil fuels in the state, it will reverse a recently passed state law that prohibits state agencies from considering planet-warming pollution when permitting fossil fuel projects.<\/p>\n\n\n\n<p>It is also a landmark win for young climate advocates who are turning more to the courts for judgments on the causes and impacts of the climate crisis.<\/p>\n\n\n\n<p>\u201cPlaintiffs have a fundamental constitutional right to a clean and healthful environment, which includes climate as part of the environmental life support system,\u201d Seeley wrote in her order.<\/p>\n\n\n\n<p>Rikki Held, one of the plaintiffs, told CNN\u2019s Jake Tapper on \u201cThe Lead\u201d the outcome was \u201ca long time coming\u201d and she was very excited.<\/p>\n\n\n\n<p>\u201cGetting a ruling that listens to our stories and our voices and the best available science is just really important,\u201d she said.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/230615180409-02-montana-climate-kids.jpg?c=16x9&amp;q=w_850,c_fill\" alt=\"Claire Vlases (plaintiff)\"\/><\/figure>\n\n\n\n<p>Video Ad Feedback<\/p>\n\n\n\n<p>Montana kids challenge state over fossil fuels<\/p>\n\n\n\n<p>03:50&nbsp;&#8211; Source:&nbsp;<a href=\"https:\/\/www.cnn.com\/\">CNN<\/a><\/p>\n\n\n\n<p>Attorneys for the plaintiffs called the court\u2019s decision a \u201csweeping win\u201d in a statement.<\/p>\n\n\n\n<p>\u201cToday, for the first time in US history, a court ruled on the merits of a case that the government violated the constitutional rights of children through laws and actions that promote fossil fuels, ignore climate change, and disproportionately imperil young people,\u201d said Julia Olson, chief legal counsel and executive director of Our Children\u2019s Trust. \u201cThis is a huge win for Montana, for youth, for democracy, and for our climate. More rulings like this will certainly come.\u201d<\/p>\n\n\n\n<p>Olson told Tapper she thinks the ruling will hamper the state\u2019s ability to approve fossil fuel projects.<\/p>\n\n\n\n<p>\u201cThe judge says it\u2019s unconstitutional to continue to do so. The State will appeal.\u201d<\/p>\n\n\n\n<p>Yet some legal experts believe this case sets a tone for climate litigation in the US.<\/p>\n\n\n\n<p>Seeley\u2019s decision is \u201cdramatic,\u201d said Pat Parenteau, emeritus professor of law at the Environmental Law Center at Vermont Law School. \u201cAny decision by any court recognizing a constitutional right to a safe climate would be a breakthrough in the US for sure.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"paragraph-a2a34e35-ba1e-74fc-3c5e-f5171c2fea7d\">Impact on other cases<\/h2>\n\n\n\n<p>Olson and other attorneys are also pursuing a federal case against the Biden administration, as well as cases in four other states; another youth climate trial could start in Hawaii as soon as this fall.<\/p>\n\n\n\n<p>The youth victory in Montana could serve as a new legal underpinning for future cases \u2013 especially in other state courts, legal experts said.<\/p>\n\n\n\n<p>\u201cPeople are very attuned to what\u2019s happening in other jurisdictions,\u201d said Daniel Farber, an environmental law professor and expert at the University of California Berkeley. \u201cIt does send a signal to judges in other states that maybe these cases aren\u2019t so far out after all.\u201d<\/p>\n\n\n\n<p>The Montana case won\u2019t have a direct impact on another federal climate case \u2013&nbsp;<a href=\"http:\/\/www.cnn.com\/2023\/08\/09\/politics\/biden-juliana-youth-climate-trial\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">Juliana v. United States<\/a>&nbsp;\u2013 that Our Children\u2019s Trust lawyers are also bringing in hope it will go to trial by spring of 2024. The federal climate case alleges the federal government\u2019s activities allowing further fossil fuel development, including permitting and leasing for oil and gas drilling, is violating young people\u2019s constitutional rights to life, liberty and property.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.cnn.com\/2023\/08\/09\/politics\/biden-juliana-youth-climate-trial\/index.html\"><\/a><\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/www.cnn.com\/2023\/08\/09\/politics\/biden-juliana-youth-climate-trial\/index.html\"><img decoding=\"async\" src=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/230808121753-05-joe-biden-arizona-080823.jpg?c=16x9&amp;q=h_144,w_256,c_fill\" alt=\"U.S. President Joe Biden speaks with Ed Keable, superintendent of Grand Canyon National Park, at Grand Canyon National Park in Grand Canyon, Arizona, U.S. August 8, 2023.
