{"id":28292,"date":"2023-09-07T13:01:39","date_gmt":"2023-09-07T20:01:39","guid":{"rendered":"https:\/\/occupysf.net\/?p=28292"},"modified":"2023-09-07T13:01:41","modified_gmt":"2023-09-07T20:01:41","slug":"watchdog-sues-to-keep-trump-off-ballot-in-colorado-citing-14th-amendment","status":"publish","type":"post","link":"https:\/\/occupysf.net\/index.php\/2023\/09\/07\/watchdog-sues-to-keep-trump-off-ballot-in-colorado-citing-14th-amendment\/","title":{"rendered":"Watchdog Sues to Keep Trump Off Ballot in Colorado, Citing 14th Amendment"},"content":{"rendered":"\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/www.commondreams.org\/media-library\/trump.jpg?id=36449670&amp;width=1200&amp;height=400&amp;quality=90&amp;coordinates=0%2C229%2C0%2C835\" alt=\"Trump\"\/><\/figure>\n\n\n\n<p>Former U.S. President Donald Trump arrives at Trump Tower in New York City on September 4, 2023.&nbsp;<\/p>\n\n\n\n<p>(Photo: James Devaney\/GC Images)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">&#8220;As a longtime Republican who voted for him, I believe Donald Trump disqualified himself from running in 2024 by spreading lies, vilifying election workers, and fomenting an attack on the Capitol,&#8221; said one plaintiff.<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.commondreams.org\/author\/jessica-corbett\">JESSICA CORBETT<\/a><\/p>\n\n\n\n<p>Sep 06, 2023 (CommonDreams.org0<a href=\"javascript:void(0)\"><\/a><\/p>\n\n\n\n<p>A government watchdog and lawyers for six Republican and unaffiliated Colorado voters on Wednesday filed a&nbsp;<a href=\"https:\/\/www.citizensforethics.org\/wp-content\/uploads\/2023\/09\/2023-09-06-08-43-07-Anderson-v-Griswold-Verified-Petition-2023.09.06.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a>&nbsp;to ban former President Donald Trump as a candidate on the state&#8217;s 2024 GOP presidential primary election ballot and any future ballot, based on the January 6, 2021 insurrection and the&nbsp;<a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-14\/\" target=\"_blank\" rel=\"noreferrer noopener\">14th Amendment<\/a>&nbsp;to the U.S. Constitution.<\/p>\n\n\n\n<p>As&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-14th-amendment-january-6\" target=\"_blank\" rel=\"noreferrer noopener\">advocacy groups<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/conservative-scholars-trump-disqualified\" target=\"_blank\" rel=\"noreferrer noopener\">legal scholars<\/a>&nbsp;across the political spectrum have highlighted since the embattled ex-president and GOP front-runner confirmed his candidacy last year, Section 3 of the 14th Amendment bars anyone who has taken an oath to the Constitution and then &#8220;engaged in insurrection or rebellion&#8221; from holding any civil or military office.<\/p>\n\n\n\n<p>Citizens for Responsibility and Ethics in Washington (CREW) and firms representing the voters\u2014Tierney Lawrence Stiles LLC, KBN Law LLC, and Olson Grimsley Kawanabe Hinchcliff &amp; Murray LLC\u2014argue that &#8220;Trump is constitutionally ineligible to assume the office of the president&#8221; because he &#8220;knowingly and voluntarily aided and incited the insurrection&#8221; before and on January 6.<\/p>\n\n\n\n<p>&#8220;As a longtime Republican who voted for him, I believe Donald Trump disqualified himself from running in 2024 by spreading lies, vilifying election workers, and fomenting an attack on the Capitol,&#8221; plaintiff Krista Kafer, a&nbsp;<em>Denver Post&nbsp;<\/em>columnist and GOP activist,&nbsp;<a href=\"https:\/\/www.commondreams.org\/newswire\/lawsuit-filed-to-remove-trump-from-ballot-in-co-under-14th-amendment\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;in a statement. &#8220;Those who by force and by falsehood subvert democracy are unfit to participate in it.&#8221;<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">And the complaint filed by <a href=\"https:\/\/twitter.com\/CREWcrew?ref_src=twsrc%5Etfw\">@CREWcrew<\/a> charging that Trump is disqualified from serving in elective office is comprehensive, compelling and damning. Among them is former Colorado House and Senate Majority Leader Norma Anderson, who&nbsp;<a href=\"https:\/\/jeffcotranscript.com\/stories\/norma-says-no-to-gop,372724\" target=\"_blank\" rel=\"noreferrer noopener\">left<\/a>&nbsp;the GOP to become an Independent in 2021.<\/p>\n\n\n\n<p>&#8220;Spending 19 years as a state legislator and serving in leadership gave me the opportunity to work across the aisle and to always work to protect the freedoms our Constitution has given us as citizens,&#8221; she said. &#8220;I am proud to continue that work by bringing this lawsuit and ensuring the eligibility of candidates on Colorado ballots.&#8221;<\/p>\n\n\n\n<p>The other four plaintiffs are former GOP Congresswoman Claudine (Cmarada) Schneider; Kathi Wright, a previous member of the Loveland City Council; Christopher Castilian, an ex-deputy chief of staff for the state&#8217;s last GOP governor; and Michelle Priola, &#8220;who has been active in Republican politics and is also married to&nbsp;<a href=\"https:\/\/www.denverpost.com\/2022\/08\/22\/colorado-kevin-priola-state-senate-republican-democrat\/\" rel=\"noreferrer noopener\" target=\"_blank\">Republican-turned-Democratic state Sen. Kevin Priola<\/a>,&#8221;&nbsp;<a href=\"https:\/\/www.denverpost.com\/2023\/09\/06\/colorado-voters-lawsuit-donald-trump-ballot-challenge\/\" target=\"_blank\" rel=\"noreferrer noopener\">according to<\/a><em>The Denver Post<\/em>.<\/p>\n\n\n\n<p>&#8220;In my decade of service in the House of Representatives, I certified multiple presidential elections and saw firsthand the importance of ethics, the rule of law, and the peaceful transfer of power in our democracy,&#8221; said Schneider. &#8220;This lawsuit is crucial to protecting and fortifying those fundamental democratic values, and I&#8217;m honored to be a part of it.&#8221;<\/p>\n\n\n\n<p>&#8220;If the very fabric of our democracy is to hold, we must ensure that the Constitution is enforced and the same people who attacked our democratic system not be put in charge of it.&#8221;<\/p>\n\n\n\n<p>While there have not been many applications of Section 3 of the 14th Amendment throughout U.S. history, CREW has previously&nbsp;<a href=\"https:\/\/www.citizensforethics.org\/reports-investigations\/crew-reports\/past-14th-amendment-disqualifications\/\" target=\"_blank\" rel=\"noreferrer noopener\">documented<\/a>&nbsp;some and last year was involved with a successful legal battle in New Mexico to&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/2022\/09\/06\/historic-win-judge-removes-new-mexico-official-office-taking-part-jan-6-insurrection\" target=\"_blank\" rel=\"noreferrer noopener\">remove<\/a>&nbsp;Otero County Commissioner Couy Griffin from office for participating in the January 6 insurrection.<\/p>\n\n\n\n<p>&#8220;If the very fabric of our democracy is to hold, we must ensure that the Constitution is enforced and the same people who attacked our democratic system not be put in charge of it,&#8221; CREW president Noah Bookbinder declared Wednesday. &#8220;We aren&#8217;t bringing this case to make a point, we&#8217;re bringing it because it is necessary to defend our republic both today and in the future.&#8221;<\/p>\n\n\n\n<p>&#8220;While it is unprecedented to bring this type of case against a former president, January 6th was an unprecedented attack that is exactly the kind of event the framers of the 14th Amendment wanted to build protections in case of,&#8221; Bookbinder added. &#8220;You don&#8217;t break the glass unless there&#8217;s an emergency.&#8221;<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">The most 2023 statement of the year: \u201cWhile Section 3 has not been tested often in the last 150 years, due to lack of insurrections\u2026\u201d <a href=\"https:\/\/t.co\/8mzD0U9b55\">https:\/\/t.co\/8mzD0U9b55<\/a><\/p>&mdash; Mike Madrid (@madrid_mike) <a href=\"https:\/\/twitter.com\/madrid_mike\/status\/1699471304704024682?ref_src=twsrc%5Etfw\">September 6, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p>The Colorado lawsuit was filed a day after Proud Boys leader Enrique Tarrio was sentenced to 22 years in prison\u2014the&nbsp;<a href=\"https:\/\/www.politico.com\/news\/2023\/09\/05\/enrique-tarrio-prison-sentencing-proud-boys-00114104\" target=\"_blank\" rel=\"noreferrer noopener\">longest<\/a>&nbsp;insurrection-related sentence so far, followed by 18 years for Oath Keepers leader Stewart Rhodes. They were both&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/2022\/11\/29\/very-good-day-our-republic-key-jan-6-insurrectionist-convicted-seditious-conspiracy\" target=\"_blank\" rel=\"noreferrer noopener\">convicted<\/a>&nbsp;of seditious conspiracy.<\/p>\n\n\n\n<p>The suit also comes as Trump has been indicted this year due to two&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-indictment-unsealed-mar-a-lago-documents\" target=\"_blank\" rel=\"noreferrer noopener\">federal<\/a>&nbsp;investigations led by Special Counsel Jack Smith as well as probes in&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-indicted-georgia\" target=\"_blank\" rel=\"noreferrer noopener\">Georgia<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/donald-trump\" target=\"_blank\" rel=\"noreferrer noopener\">New York<\/a>. The Georgia case and&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-indictment-2020-election\" target=\"_blank\" rel=\"noreferrer noopener\">one<\/a>&nbsp;of the federal cases involve his efforts to overturn the 2020 election results.<\/p>\n\n\n\n<p>So far, polling has indicated Trump&#8217;s legal issues&nbsp;<a href=\"https:\/\/www.cnn.com\/2023\/09\/05\/politics\/cnn-poll-trump-primary-criminal-charges\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">have not dissuaded<\/a>&nbsp;many GOP voters, and the candidate has used the 91 felony charges against him to rally supporters\u2014as a campaign representative did in response to the new suit. As&nbsp;<em>NBC News<\/em><a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/six-colorado-voters-file-lawsuit-remove-trump-2024-ballot-rcna103660\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Trump campaign spokesperson Steven Cheung slammed the voters behind the lawsuit, saying in a statement that they&#8217;re &#8220;people who are pursuing this absurd conspiracy theory and political attack on President Trump.&#8221;<\/p>\n\n\n\n<p>They &#8220;are stretching the law beyond recognition much like the political prosecutors in New York, Georgia, and D.C.,&#8221; Cheung added. &#8220;There is no legal basis for this effort except in the minds of those who are pushing it.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p>Democratic Colorado Secretary of State Jena Griswold\u2014named as the defendant in the lawsuit because of her position\u2014<a href=\"https:\/\/www.sos.state.co.us\/pubs\/newsRoom\/pressReleases\/2023\/PR20230906AccessBallot.html\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;in a statement that &#8220;I look forward to the Colorado Court&#8217;s substantive resolution of the issues, and am hopeful that this case will provide guidance to election officials on Trump&#8217;s eligibility as a candidate for office.&#8221;<\/p>\n\n\n\n<p>Griswold is&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-disqualified-2024\" target=\"_blank\" rel=\"noreferrer noopener\">among<\/a>&nbsp;election officials in several key states who have recently&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-disqualified-ballots\" target=\"_blank\" rel=\"noreferrer noopener\">received<\/a>&nbsp;letters from Free Speech for People and Mi Familia Vota Education Fund&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-14th-amendment-january-6\" target=\"_blank\" rel=\"noreferrer noopener\">urging<\/a>&nbsp;them to keep Trump off the ballot because of the 14th Amendment.<\/p>\n\n\n\n<p>Our work is licensed under Creative Commons (CC BY-NC-ND 3.0).
