The proposed rule ignored the fact that Brazil&#8217;s military dictatorship displaced many Indigenous groups before it finally ended in 1985,&nbsp;<em>The Guardian<\/em><a href=\"https:\/\/www.theguardian.com\/world\/2023\/sep\/21\/brazil-supreme-court-indigenous-land-rights-win?CMP=share_btn_tw\" rel=\"noreferrer noopener\" target=\"_blank\">pointed out<\/a>.<\/p>\n\n\n\n<p>&#8220;I&#8217;m shaking,&#8221; J\u00e9ssica Nghe Mum Pripr\u00e1 of the Xokleng-Laklano Indigenous group&nbsp;<a href=\"https:\/\/apnews.com\/article\/brazil-indigenous-groups-land-rights-supreme-court-715fc33861a5d9b3c6ee98a8362d802f\" rel=\"noreferrer noopener\" target=\"_blank\">told<\/a><em>The Associated Press<\/em>&nbsp;while celebrating the news. &#8220;It took a while, but we did it. It&#8217;s a very beautiful and strong feeling. Our ancestors are present\u2014no doubt about it.&#8221;<\/p>\n\n\n\n<p>&#8220;The Supreme Court has shown that it cares about our lives and that it&#8217;s against genocide.&#8221;<\/p>\n\n\n\n<p>The particular case the nation&#8217;s highest court heard Thursday involved a land dispute in the state of Santa Catarina,&nbsp;<em>Reuters&nbsp;<\/em><a href=\"https:\/\/www.reuters.com\/world\/americas\/brazil-top-court-rejects-time-limit-indigenous-land-claims-2023-09-21\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>. The Xokleng people were driven from much of their traditional lands in the state during the 1950s, when Brazil sold the land to tobacco farmers, the outlet&nbsp;<a href=\"https:\/\/widerimage.reuters.com\/story\/brazils-indigenous-rights-hinge-on-one-tribes-legal-battle\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a>&nbsp;in 2021. Santa Catarina then used the 1988 time limit to push more members of the Xokleng group out of a national park, prompting the current dispute.<\/p>\n\n\n\n<p>&#8220;Before they killed us with guns, now they kill us with the stroke of a pen,&#8221; former chief Jo\u00e3o Pat\u00e9 told&nbsp;<em>Reuters&nbsp;<\/em>in 2021.<\/p>\n\n\n\n<p>However, the court on Thursday&nbsp;<a href=\"https:\/\/www.poder360.com.br\/justica\/por-9-a-2-stf-rejeita-tese-do-marco-temporal\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a>&nbsp;9-2 in favor of the Xokleng.<\/p>\n\n\n\n<p>&#8220;Areas occupied by Indigenous people and areas that are linked to the ancestry and tradition of Indigenous peoples have constitutional protection, even if they are not demarcated,&#8221; Justice Luiz Fux said.<\/p>\n\n\n\n<p>The only two dissenting judges were appointed by right-wing former Brazilian President&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/jair-bolsonaro\">Jair Bolsonaro<\/a>, who supported extractive industries at the expense of Indigenous rights.<\/p>\n\n\n\n<p>The court also said that the decision had &#8220;general repercussion&#8221; status, meaning it would apply to other rulings involving Indigenous land claims.<\/p>\n\n\n\n<p>&#8220;This is a momentous, historic victory for Brazil&#8217;s Indigenous peoples, and a massive defeat for the agribusiness lobby,&#8221; Survival International research and advocacy director Fiona Watson said in a statement, adding that a broad application of the time limit trick would have threatened many Indigenous groups in the country, among them the uncontacted Kawahiva.<\/p>\n\n\n\n<p>&#8220;It was all part of a devastating assault on Brazil&#8217;s Indigenous peoples and the Amazon rainforest, so this rejection of it is hugely important, not only for Indigenous peoples, but for the global fight against climate change too,&#8221; she said.<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Momentous victory after years of struggle! \u270a<br><br>The Indigenous peoples of Brazil and their allies around the world are celebrating a historic victory: the genocidal and catastrophic Time Limit Trick has been rejected by the Supreme Court!<a href=\"https:\/\/twitter.com\/hashtag\/MarcoTemporalN%C3%A3o?src=hash&amp;ref_src=twsrc%5Etfw\">#MarcoTemporalN\u00e3o<\/a> <a href=\"https:\/\/t.co\/ri7yovTxCQ\">pic.twitter.com\/ri7yovTxCQ<\/a><\/p>&mdash; Survival International (@Survival) <a href=\"https:\/\/twitter.com\/Survival\/status\/1704964204325720245?ref_src=twsrc%5Etfw\">September 21, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p>Indigenous peoples gathered in Brasilia celebrated the news with dancing and weeping,&nbsp;<em>The Guardian&nbsp;<\/em>reported, as did those following the case from their homes in the Amazon region.<\/p>\n\n\n\n<p>&#8220;We&#8217;re crying with joy,&#8221; Aty Guasu, an organization representing the Guarani group, said in a statement translated by Survival International. &#8220;Today we&#8217;re going to sing the song of life and dance the dance of joy. The Supreme Court has shown that it cares about our lives and that it&#8217;s against genocide. It has listened to the cry of the Indigenous peoples of Brazil.&#8221;<\/p>\n\n\n\n<p>National Indigenous rights group APIB also&nbsp;<a href=\"https:\/\/apiboficial.org\/2023\/09\/22\/victory-the-justices-of-the-supreme-court-of-brazil-form-a-majority-and-the-time-frame-thesis-is-overturned\/?lang=en\" rel=\"noreferrer noopener\" target=\"_blank\">welcomed<\/a>&nbsp;the decision, but said that there were other pending threats to Indigenous rights.<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Victory: The Justices of the Supreme Court of Brazil form a majority, and the Time Frame thesis is overturned<br><br>Access: <a href=\"https:\/\/t.co\/U6CYL2hxmV\">https:\/\/t.co\/U6CYL2hxmV<\/a><\/p>&mdash; Apib Oficial (@ApibOficial) <a href=\"https:\/\/twitter.com\/ApibOficial\/status\/1705269201651249543?ref_src=twsrc%5Etfw\">September 22, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p>&#8220;We have indeed emerged victorious from the time frame thesis, but there is still much to be done,&#8221; the group&#8217;s executive coordinator Dinamam Tux\u00e1 said in a statement.<\/p>\n\n\n\n<p>Tux\u00e1 pointed to a bill currently in the Senate that would only allow new reservations in land occupied by Indigenous groups as of 1988, as&nbsp;<em>Reuters&nbsp;<\/em>described it. While the court decision may make this provision harder to pass, the bill would also ease the way for mining, farming, dams, and transportation projects in Indigenous territory,&nbsp;<em>AP&nbsp;<\/em>explained.<\/p>\n\n\n\n<p>&#8220;We remain mobilized,&#8221; Tux\u00e1 said. &#8220;We continue to fight because we need to ensure and protect the rights of Indigenous peoples.&#8221;<\/p>\n\n\n\n<p>Our work is licensed under Creative Commons (CC BY-NC-ND 3.0).
