{"id":28899,"date":"2023-10-05T21:32:14","date_gmt":"2023-10-06T04:32:14","guid":{"rendered":"https:\/\/occupysf.net\/?p=28899"},"modified":"2023-10-05T21:32:15","modified_gmt":"2023-10-06T04:32:15","slug":"trump-channels-nixon-with-presidential-immunity-defense-in-january-6-case","status":"publish","type":"post","link":"https:\/\/occupysf.net\/index.php\/2023\/10\/05\/trump-channels-nixon-with-presidential-immunity-defense-in-january-6-case\/","title":{"rendered":"Trump Channels Nixon With &#8216;Presidential Immunity&#8217; Defense in January 6 Case"},"content":{"rendered":"\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/www.commondreams.org\/media-library\/donald-trump.jpg?id=48987704&amp;width=1200&amp;height=400&amp;quality=90&amp;coordinates=0%2C553%2C0%2C1447\" alt=\"Donald Trump\"\/><\/figure>\n\n\n\n<p>Former President of the United States Donald Trump speaks to the press at his civil fraud trial in Manhattan, New York, United States on October 4, 2023.<\/p>\n\n\n\n<p>&nbsp;(Photo: Kyle Mazza\/Anadolu Agency via Getty Images)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Donald Trump&#8217;s legal team asked a federal judge to dismiss the criminal charges related to his effort to overturn the 2020 presidential election.<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.commondreams.org\/author\/common-dreams-staff\">COMMON DREAMS STAFF<\/a><\/p>\n\n\n\n<p>Oct 05, 2023 (CommonDreams.org)<a href=\"javascript:void(0)\"><\/a><\/p>\n\n\n\n<p>Former President Donald Trump on Thursday asked a federal judge in Washington, D.C. to toss the January 6-related charges against him, invoking a presidential immunity defense that Richard Nixon infamously&nbsp;<a href=\"https:\/\/teachingamericanhistory.org\/document\/transcript-of-david-frosts-interview-with-richard-nixon\/\" target=\"_blank\" rel=\"noreferrer noopener\">summarized<\/a>&nbsp;in 1977 as, &#8220;When the president does it&#8230; that means that it is not illegal.&#8221;<\/p>\n\n\n\n<p>In a&nbsp;<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.258148\/gov.uscourts.dcd.258148.74.0_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">50-page filing<\/a>&nbsp;with the U.S. District Court for the District of Columbia, Trump&#8217;s legal team argued that where &#8220;the president&#8217;s actions are within the ambit of his office, he is absolutely immune from prosecution.&#8221;<\/p>\n\n\n\n<p>The filing points to Supreme Court precedent, including&nbsp;<em><a href=\"https:\/\/www.oyez.org\/cases\/1981\/79-1738\" target=\"_blank\" rel=\"noreferrer noopener\">Nixon v. Fitzgerald<\/a><\/em>, a case in which a civilian U.S. Air Force employee sued Nixon for damages after he was terminated. The high court&nbsp;<a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/457\/731\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a>&nbsp;5-4 that the president is immune &#8220;from damages liability for acts within the &#8216;outer perimeter&#8217; of his official responsibility&#8221;\u2014a line that Trump&#8217;s legal team quotes in its new filing.<\/p>\n\n\n\n<p>Trump faces four criminal counts in the January 6 case, which was brought by U.S. Special Counsel Jack Smith. The charges include conspiracy to defraud the U.S. government and conspiracy against rights.<\/p>\n\n\n\n<p>The former president has pleaded not guilty to all four counts, which are among the&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/politics\/2023\/trump-charges-jan-6-classified-documents\/\" target=\"_blank\" rel=\"noreferrer noopener\">more than 90 charges he is facing<\/a>&nbsp;across four criminal cases.<\/p>\n\n\n\n<p>In an amicus brief filed earlier this year in a separate January 6-related case against Trump, the U.S. Justice Department&nbsp;<a href=\"https:\/\/firstamendmentwatch.org\/trump-isnt-immune-to-capitol-riot-lawsuits-the-department-of-justice-says\/\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a>&nbsp;that while&nbsp;<em>Nixon v. Fitzgerald<\/em>&nbsp;&#8220;establishes a rule of absolute immunity for the president&#8217;s official acts,&#8221; it isn&#8217;t &#8220;a rule of absolute immunity for the president regardless of the nature of his acts.&#8221;<\/p>\n\n\n\n<p>&#8220;In the United States&#8217; view,&#8221; DOJ added, &#8220;such incitement of imminent private violence would not be within the outer perimeter of the office of the president of the United States.&#8221;<\/p>\n\n\n\n<p>Our work is licensed under Creative Commons (CC BY-NC-ND 3.0).
