But it wouldn\u2019t be a shock if Mayor Breed vetoed the measure.<\/p>\n\n\n\n<p>Oddly, the late September tweet where Twitter\/X owner Elon Musk declared that SF Supervisor Dean Preston \u201c<a href=\"https:\/\/twitter.com\/elonmusk\/status\/1707725140618858935?s=20\">should go to prison<\/a>\u201d was in response to a\u00a0<a href=\"https:\/\/missionlocal.org\/2023\/09\/sf-ban-armed-guards-property-crime\/\">Mission Local article<\/a>\u00a0reporting that a Board of Supervisors committee had voted to recommend approving a\u00a0<a href=\"https:\/\/sfist.com\/2023\/09\/28\/san-francisco-may-ban-security-guards-from-pulling-guns\/\">ban on retail security guards drawing guns<\/a>\u00a0on property crime suspects. (That Musk dustup led to\u00a0<a href=\"https:\/\/sfist.com\/2023\/10\/13\/preston-becomes-latest\/\">Preston quitting Twitter<\/a>.)<\/p>\n\n\n\n<p>But on a more serious note, Preston proposed this\u00a0<a href=\"https:\/\/sfist.com\/2023\/05\/10\/after-banko-brown-shooting-supervisor-preston-wants-to-ban-retail-security-guards-from-using-guns\/\">restriction on security guards pulling guns\u00a0<\/a>in the aftermath of the April\u00a0<a href=\"https:\/\/sfist.com\/2023\/04\/28\/shooting-outside-market-street-walgreens-leaves-one-dead\/\">shooting and killing of Banko Brown<\/a>, a unarmed 24-year-old Black trans man who\u2019d allegedly shoplifted\u00a0<a href=\"https:\/\/www.cbsnews.com\/sanfrancisco\/news\/san-francisco-district-attorney-brooke-jenkins-patience-banko-brown-investigation\/\">$15 worth of candy<\/a>. That shooting inspired\u00a0<a href=\"https:\/\/sfist.com\/2023\/05\/16\/protests-erupt-following-banko-brown-charging-decision-video-release\/\">weeks of protests<\/a>, a\u00a0<a href=\"https:\/\/sfist.com\/2023\/05\/24\/ca-attorney-general-agrees-to-look-into-banko-brown-shooting-case\/\">state investigation<\/a>, and some\u00a0<a href=\"https:\/\/sfist.com\/2023\/05\/08\/da-jenkins-issues-statement-on-banko-brown-case-says-it-is-not-closed\/\">PR headaches or DA Brooke Jenkins<\/a>\u00a0who decided to\u00a0<a href=\"https:\/\/sfist.com\/2023\/05\/15\/video-of-banko-brown-shooting-released-as-da-jenkins-announces-final-decision-not-to-file-charges-against-security-guard\/\">not charge the security guard<\/a>. \u00a0<\/p>\n\n\n\n<p>Preston\u2019s proposal hoped to prevent anyone else from being shot and killed over minor shoplifting incidents. And in a Tuesday vote, the SF Board of Supervisors approved Preston\u2019s ban in a unanimous vote, with no discussion.<\/p>\n\n\n\n<p>\u201cI am grateful that the Board has taken this important step forward in ensuring that the people of San Francisco will be placed above property,\u201d Preston said in a statement his office sent after the vote. \u201cWe should be doing everything in our power to prevent something like the killing of Banko Brown from happening again.\u201d<\/p>\n\n\n\n<p>Private security guards are regulated&nbsp;<a href=\"https:\/\/sf.gov\/sites\/default\/files\/2022-09\/PoliceCommission090722-Article%2025%20Plan_SFPD%20Proposal.pdf\">under the SF Police Code<\/a>. That code currently says they can\u2019t draw their firearms, except when there\u2019s \u201can actual and specific threat to person and\/or property.\u201d Preston\u2019s&nbsp;<a href=\"https:\/\/sfgov.legistar.com\/View.ashx?M=F&amp;ID=12370555&amp;GUID=FFE7BB31-3DA9-46EE-A00D-71BBA1D71FE0\">just-approved proposal<\/a>&nbsp;deletes any reference to property, so the guards could only draw their firearms when there\u2019s a threat to a human being. Hence, no shooting people merely for suspected shoplifting.<\/p>\n\n\n\n<p>While the board approved the proposal unanimously, this could still be one to watch. Mayor Breed is&nbsp;<a href=\"https:\/\/sfist.com\/2023\/10\/17\/mayor-london-breed-announces-ballot-measure\/\">on her tough-on-crime kick<\/a>, so she could theoretically veto this bill, in hopes of fending off her&nbsp;<a href=\"https:\/\/sfist.com\/2023\/09\/26\/daniel-lurie-makes-candidacy-official-for-sf-mayor-says-theres-hunger-for-change\/\">other moderate challengers<\/a>&nbsp;in the 2024 mayoral election. Of course, the supervisors could simply&nbsp;<a href=\"https:\/\/codelibrary.amlegal.com\/codes\/san_francisco\/latest\/sf_charter\/0-0-0-59\">override that veto<\/a>, and considering they passed this with an 11-0 vote, they have the majority to do so.<\/p>\n\n\n\n<p>But the veto would allow Breed to grandstand about giving law enforcement \u201c<a href=\"https:\/\/twitter.com\/LondonBreed\/status\/1714336983827562621\">the tools and support they need<\/a>\u201d in &nbsp;the lead-up to the election. And it would put Supervisor Ahsha Safai on record as voting not once but twice to limit the actions of security guards.
