{"id":30010,"date":"2023-11-18T14:09:02","date_gmt":"2023-11-18T22:09:02","guid":{"rendered":"https:\/\/occupysf.net\/?p=30010"},"modified":"2023-11-18T14:09:03","modified_gmt":"2023-11-18T22:09:03","slug":"judge-gives-biden-blinken-60-days-to-respond-to-gaza-genocide-claim","status":"publish","type":"post","link":"https:\/\/occupysf.net\/index.php\/2023\/11\/18\/judge-gives-biden-blinken-60-days-to-respond-to-gaza-genocide-claim\/","title":{"rendered":"Judge gives Biden, Blinken 60 days to respond to Gaza \u2018genocide\u2019 claim"},"content":{"rendered":"\n<p><a href=\"https:\/\/www.sfchronicle.com\/bayarea\/\"><\/a>By\u00a0<a href=\"https:\/\/www.sfchronicle.com\/author\/bob-egelko\/\">Bob Egelko<\/a> Updated\u00a0Nov 16, 2023 3:59 p.m.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" loading=\"lazy\" width=\"960\" height=\"540\" src=\"https:\/\/occupysf.net\/wp-content\/uploads\/2023\/11\/image-56.png\" alt=\"\" class=\"wp-image-30013\" srcset=\"https:\/\/occupysf.net\/wp-content\/uploads\/2023\/11\/image-56.png 960w, https:\/\/occupysf.net\/wp-content\/uploads\/2023\/11\/image-56-300x169.png 300w, https:\/\/occupysf.net\/wp-content\/uploads\/2023\/11\/image-56-150x84.png 150w, https:\/\/occupysf.net\/wp-content\/uploads\/2023\/11\/image-56-768x432.png 768w, https:\/\/occupysf.net\/wp-content\/uploads\/2023\/11\/image-56-250x141.png 250w\" sizes=\"(max-width: 960px) 100vw, 960px\" \/><\/figure>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" loading=\"lazy\" width=\"8\" height=\"5\" src=\"https:\/\/occupysf.net\/wp-content\/uploads\/2023\/11\/image-22.jpeg\" alt=\"\" class=\"wp-image-30011\" title=\"Article Image\"\/><figcaption class=\"wp-element-caption\"><em>A San Francisco police officer stands in a line near the Exploratorium on Wednesday as protesters rally demanding a\u00a0cease-fire in the Israel-Hamas conflict.Stephen Lam\/The Chronicle<\/em><\/figcaption><\/figure>\n\n\n\n<p>As President Joe Biden faced protests in the Bay Area on Thursday over U.S. support for Israel\u2019s attacks on Gaza, a federal magistrate issued summonses to Biden and two top aides requiring responses in 60 days to a lawsuit accusing them of complicity in genocide.<\/p>\n\n\n\n<p>Biden, Secretary of State Antony Blinken and Defense Secretary Lloyd Austin&nbsp;<a class=\"\" href=\"https:\/\/www.sfchronicle.com\/politics\/article\/bay-area-palestinians-sue-biden-federal-court-18488766.php\">were sued in a San Francisco federal court on Monday<\/a>&nbsp;by a group of Palestinians, immigrants and advocates of their rights.<\/p>\n\n\n\n<p>The suit alleges that the administration\u2019s political and financial support of Israel\u2019s response to the Oct. 7 assault by Hamas\u00a0\u2014 a response that has killed more than 11,000 people and cut off food, water and power supplies in Gaza, according to its health officials\u00a0\u2014 fits the definition of genocide under U.S. and international law: conduct \u201ccommitted with the intent to destroy in whole or in part a national, ethnical, racial or religious group.\u201d<\/p>\n\n\n\n<p>The suit seeks court orders requiring Biden and his administration to \u201ctake all measures within their power\u201d to end the bombing of Gaza, lift Israel\u2019s siege of the territory and stop vetoing United Nations resolutions calling for a cease-fire.&nbsp;<\/p>\n\n\n\n<p>In a new filing Thursday, the Palestinian rights groups asked for an injunction that would immediately halt U.S. aid to Israel\u2019s military attacks, with a hearing scheduled Jan. 11.<\/p>\n\n\n\n<p>Biden and his administration \u201chave not only failed in their legal obligation to prevent this unfolding genocide, they are enabling its development through their efforts to expedite and provide massive amounts of military assistance,\u201d attorney Maria LaHood of the Center for Constitutional Rights wrote in the court filing.<\/p>\n\n\n\n<p>She quoted Biden\u2019s declaration on International Holocaust Remembrance Day in January 2021: \u201cI recommit to the simple truth that preventing future genocides remains both our moral duty and a matter of national and global importance.\u201d<\/p>\n\n\n\n<p>It\u2019s not clear that courts could require such decisions on issues of foreign policy, but lawyers who filed the suit said the current situation justifies unprecedented actions.<\/p>\n\n\n\n<p>The White House has not responded to a request for comment on the suit. On Thursday, U.S. Magistrate Judge Donna Ryu of Oakland ordered Biden and his aides to file a response within 60 days and scheduled an initial case-management conference between the two sides for Feb. 21.<\/p>\n\n\n\n<p>Ryu, a magistrate appointed by the court\u2019s judges, is assigned to the case, but either side could have her removed and replaced by a presidentially appointed federal judge.<\/p>\n\n\n\n<p>Biden was in San Francisco for the Asia-Pacific Economic Cooperation summit and met Wednesday with China\u2019s president, Xi Jinping.&nbsp;<\/p>\n\n\n\n<p>At a news conference after the meeting, Biden was asked about an Israeli attack that has cut off power and supplies and killed patients at Al-Shifa Hospital, Gaza\u2019s largest medical facility. He backed Israel\u2019s contention that&nbsp;Hamas was hiding troops and weapons at the hospital, and refused to say what evidence he was relying on.<\/p>\n\n\n\n<p>The president did not mention a possible cease-fire, but said the violence would end only \u201cwhen Hamas no longer maintains the capacity to murder and abuse and \u2026 just do horrific things to the Israelis.\u201d<\/p>\n\n\n\n<p>On Wednesday night, pro-Palestinian demonstrators&nbsp;<a class=\"\" href=\"https:\/\/www.sfchronicle.com\/sf\/article\/apec-san-francisco-protest-closures-traffic-18491760.php\">briefly blocked cars<\/a>&nbsp;along the Embarcadero in San Francisco.
