That almost certainly will greatly benefit Trump in his effort to regain the White House despite his failed coup in 2021.<\/p>\n\n\n\n<p>Don\u2019t expect to hear these three crucial words cited before the United States Supreme Court, which Trump says he will ask to take up the case, or to be the focus of mainstream news reports for reasons I\u2019ll explain.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>That Trump gave aid and comfort to the rebellion is indisputable.<\/p>\n<\/blockquote>\n\n\n\n<p>The Colorado challenge, one of nearly 20 filed so far, hangs on the 14th Amendment\u2019s lifelong ban on holding office for anyone who \u201cengaged in insurrection or rebellion.\u201d<\/p>\n\n\n\n<p>The 1868 amendment ensured that traitors who joined the Confederacy would never hold any office \u2014 federal, state or local \u2014 unless granted forgiveness by the grace of Congress.<\/p>\n\n\n\n<p>The Colorado case, brought by six Republicans and one independent, argued that the 14<sup>th<\/sup>&nbsp;Amendment\u2019s ban on holding office applies to Trump because he riled up a mob outside the White House and sent them to the Capitol two miles away.<\/p>\n\n\n\n<p>By 4 to 3, the Colorado Supreme Court agreed with this argument. The dissenters don\u2019t dispute that Trump motivated the attack, but argue that Trump was neither charged nor convicted of insurrection, which some United States Supreme Court justices are sure to latch onto, rejecting the idea that the 14<sup>th<\/sup>&nbsp;Amendment prohibition on holding office is self-executing.<\/p>\n\n\n\n<p>But proving insurrection or rebellion is a much higher standard than our Constitution requires. That\u2019s because the 14<sup>th<\/sup>&nbsp;Amendment prohibition also applies to anyone who gave \u201caid or comfort\u201d to rebels and insurrectionists.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Indisputable<\/h4>\n\n\n\n<p>That Trump gave aid and comfort to the coup attempt is indisputable.<\/p>\n\n\n\n<p>For more than three hours, Trump did nothing to stop the mob sacking our Capitol, shouting \u201chang Mike Pence,\u201d calling for the murder of Speaker Nancy Pelosi and injuring 150 police officers in his failed attempt to overthrow our government.<\/p>\n\n\n\n<p>Trump didn\u2019t call on federal law enforcement or summon readily available National Guard troops.<\/p>\n\n\n\n<figure class=\"wp-block-image\" id=\"attachment_28144\"><a href=\"https:\/\/www.dcreport.org\/image-12-20-23-at-12-45-am\/\"><img decoding=\"async\" src=\"https:\/\/www.dcreport.org\/wp-content\/uploads\/2023\/12\/Image-12-20-23-at-12.45%E2%80%AFAM-1024x175.jpeg\" alt=\"Huff Post headline\" class=\"wp-image-28144\"\/><\/a><figcaption class=\"wp-element-caption\">Huff Post headline<\/figcaption><\/figure>\n\n\n\n<p>Instead, Trump&nbsp;<a href=\"https:\/\/www.cbsnews.com\/video\/kinzinger-says-jan-6-hearing-on-trumps-actions-will-open-peoples-eyes-in-a-big-way\/#x\">\u201cgleefully\u201d watched the attack on television<\/a>&nbsp;in a room just off the Oval Office. Stephanie Grisham, the White House press secretary, testified that he even rewound some scenes of violence that he considered especially gratifying.<\/p>\n\n\n\n<p>Because appeals deal with issues raised in lower courts \u2014 not issues that could have been or should have been raised \u2014 the U.S. Supreme Court is unlikely to examine the \u201caid or comfort\u201d standard.<\/p>\n\n\n\n<p>The high court will face a sticky problem, at least for justices like Samuel Alito and Clarence Thomas, who claim to act based on the plain meaning of words when they were written into our Constitution. Under their legal reasoning, Trump clearly cannot be on any ballot, the words \u201caid or comfort\u201d being crystal clear.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Ethics and Recusal<\/h4>\n\n\n\n<p>Of course, Thomas should recuse himself given his wife\u2019s declared support for the insurrectionists. Don\u2019t count on the man who eagerly accepts lavish trips and money from billionaires with interests before the court to find his long-lost ethics.<\/p>\n\n\n\n<p>Other 14<sup>th<\/sup>&nbsp;Amendment cases are pending in nearly 20 states. More are likely to be filed. Lawyers in those cases could include \u201caid or comfort\u201d as a backup argument.<\/p>\n\n\n\n<p>Should the U.S. Supreme Court leave Trump on the Colorado ballot through the legal convenience of sending the matter back to the Colorado courts for further consideration, that will leave time for other cases to proceed.
