What I mean by that is that all nine current Supreme Court justices have worked for decades to make it to the nation\u2019s highest court. And the last thing anyone of them would want to see is the Supreme Court being stripped of power rendering them as nothing more than nine people in black robes pretending that their decisions matter.<\/p>\n\n\n\n<p>Every member of the Supreme Court has seen the actions of Trump from his attempted coup to his Jan 6 attack. And as of late, they\u2019ve also seen a desperate Trump who has begun to openly quote Hitler while vowing to&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/44082741-c4ab-4bde-8cb5-8a55a6ef2edd?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">rule as a dictator<\/a>&nbsp;&nbsp;focused on weaponizing the government to punish critics. They, too, have seen Trump pledge to fill his administration with people who will be loyal to him and his autocratic desires.<\/p>\n\n\n\n<p><strong>As every one of the nine Supreme Court justices get, in the dictatorship Trump is vowing to implement, there is little to no place for a judiciary to be used as a check on his power.<\/strong>&nbsp;<strong>Do you think that Trump will tolerate an \u201cindependent judiciary\u201d to stand in his way?<\/strong>&nbsp;Bluntly, do you doubt for a moment that Trump\u2019s MAGA base would cheer if Trump disregarded court orders\u2014especially given he has long&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/f2ced093-d40b-45f3-8aeb-56cce52c1743?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">slammed<\/a>&nbsp;the judiciary as \u201cpolitical\u201d?<\/p>\n\n\n\n<p><strong>And the MAGA base would undoubtedly cheer if Trump expanded the Supreme Court to allow him to appoint absolute loyalists on the nation\u2019s top court, thus, diluting if not erasing the power of justices who refuse to support his agenda.<\/strong><\/p>\n\n\n\n<p>&nbsp;In fact, Trump in his first term had already made the judiciary and even the US Supreme Court dominated by GOP appointees one of his most visible targets.<\/p>\n\n\n\n<p><strong>Here are just a few reminders:<\/strong><\/p>\n\n\n\n<p>1.&nbsp;&nbsp;&nbsp;&nbsp; Early in his first year in office, Trump slammed the GOP appointed district judge who blocked the first version of his \u201cMuslim travel ban\u201d as a \u201c<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/3b0e4792-8c37-4901-92f1-886412d2cad0?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">so-called judge<\/a>\u201d whose \u201cridiculous\u201d ruling would be overturned. At the time, Trump also dangerously&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/1b9a3e35-bd48-4c15-99e8-6b78c37bc5f7?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">urged<\/a>&nbsp;his followers to blame the judge and the judiciary as a whole if any terrorist attack carried out by an immigrant. &nbsp;<\/p>\n\n\n\n<p>2.&nbsp;&nbsp;&nbsp;&nbsp; During the oral argument in the US court of appeals on that travel ban, he criticized the judges who were skeptical that Trump had the power to impose the ban saying:&nbsp;<strong>\u201cI listened to a bunch of stuff last night on television that was disgraceful<\/strong>\u2026I think it\u2019s sad. I think it\u2019s a sad day. I think our security is at risk today.\u201d<\/p>\n\n\n\n<p>Those comments caused Trump Supreme Court justice nominee&nbsp;<strong>Neal Gorsuch at the time to call Trump\u2019s&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/1b9a3e35-bd48-4c15-99e8-6b78c37bc5f7?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">attacks<\/a>&nbsp;on the federal judges as \u201cdemoralizing\u201d and \u201cdisheartening.\u201d<\/strong><\/p>\n\n\n\n<p>3.&nbsp;&nbsp;&nbsp;&nbsp; In 2017, Trump&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/c467c37a-6c44-4242-b256-e1699f88e38a?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">said<\/a>&nbsp;<strong>\u201cthe courts are slow and political.\u201d<\/strong><\/p>\n\n\n\n<p>4.&nbsp;&nbsp;&nbsp;&nbsp; In 2018: After Judge Jon Tigar of the U.S. Court of Appeals for the Ninth Circuit ordered the Trump administration to accept asylum claims regardless of where migrants entered the country, Trump&nbsp;<strong><a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/446ff99c-1aa6-4f19-97ea-0e9c4a288b6c?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">called<\/a><\/strong>&nbsp;the decision&nbsp;<strong>\u201ca disgrace,\u201d attacked Tigar as \u201can Obama judge,\u201d and critiqued the Ninth Circuit as \u201creally something we have to take a look at because it\u2019s not fair.\u201d<\/strong><\/p>\n\n\n\n<p>When&nbsp;<strong>Supreme Court Chief Justice John Roberts<\/strong>&nbsp;issued a rare public statement in response saying there are no \u201cObama judges,\u201d only people who serve impartially as judges, Trump &nbsp;\\criticized Roberts by name&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/c467c37a-6c44-4242-b256-e1699f88e38a?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">writing:<\/a>&nbsp;<strong>\u201cSorry Chief Justice John Roberts, but you do indeed have \u201cObama judges,\u201d<\/strong>&nbsp;and they have a much different point of view than the people who are charged with the safety of our country.\u201d Trump then slammed the idea that these judges are an \u201cindependent judiciary\u201d and warned that&nbsp;<strong>\u201cthese rulings are making our country unsafe! Very dangerous and unwise!\u201d<br><\/strong><br>Clearly, Trump was laying the groundwork with his supporters to view the judiciary and their decisions that he didn\u2019t agree with as illegitimate. The same way Trump later would claim the 2020 election results were illegitimate.<\/p>\n\n\n\n<p>5.&nbsp;&nbsp;&nbsp;&nbsp; In fact, in December 2020, &nbsp;when the US Supreme Court refused to overturn the 2020 election results with even the three justices Trump appointed ruling against him, Trump&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/24321648-3a35-403c-b805-b9874f467f9e?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">posted<\/a>&nbsp;on social media:&nbsp;<strong>\u201cThe Supreme Court really let us down. No Wisdom, No Courage!\u201d &nbsp;<\/strong>(That post sounds similar to Trump\u2019s tweet during the Jan 6 attack when he<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/1fc8bd79-09a5-4753-ad83-e0b8e7e42bc5?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">&nbsp;wrote<\/a>&nbsp;about Mike Pence letting him down: \u201cMike Pence didn\u2019t have the courage to do what should have been done to protect our Country and our Constitution.&#8221;&nbsp; That tweet<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/1fc8bd79-09a5-4753-ad83-e0b8e7e42bc5?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">&nbsp;incited<\/a>&nbsp;the crowd to become even angrier.&nbsp;<strong>Do you doubt that Trump would incite his followers to attack the Supreme Court the same way he did on Jan 6 if it was part of his scheme to remain in power?!<\/strong>)<\/p>\n\n\n\n<p><strong>6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/strong>In June 2020, when the GOP controlled Supreme Court in an opinion written by Chief Justice John Roberts that upheld a program known as DACA allowing young, undocumented immigrants&nbsp;to remain in the United States, Trump&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/bd9c324e-4423-4917-9a83-56018c267b22?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">posted<\/a>&nbsp;on line:&nbsp;<strong>&#8220;Do you get the impression that the Supreme Court doesn\u2019t like me?&#8221; &nbsp;<\/strong>And in another tweet that followed he&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/bd9c324e-4423-4917-9a83-56018c267b22?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">wrote<\/a>&nbsp;about the decision:&nbsp;<strong>&#8220;these horrible &amp; politically charged decisions coming out of the Supreme Court are shotgun blasts into the face of people that are proud to call themselves Republicans or Conservatives.&#8221;<\/strong><\/p>\n\n\n\n<p>Trump has made it clear that he has no respect for an independent judiciary. He wants a rubber stamp. And if he doesn\u2019t get that, at the very least Trump will ignore the court\u2019s ruling.&nbsp; As a reminder&nbsp;<strong>President Andrew Jackson<\/strong>&nbsp;allegedly&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/f503765c-84e1-43a5-b532-e6db19e74977?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">stated<\/a>&nbsp;about a Supreme Court ruling written by then Chief Justice John Marshall that he didn\u2019t like: \u201cJohn Marshall has made his decision now let him enforce it.\u201d (Trump&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/4173f360-e588-44e0-b959-656cb119935f?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">admires<\/a>&nbsp;Jackson as a \u201chero.\u201d)<\/p>\n\n\n\n<p><strong>Or Trump could\u2014if the GOP gets control the House and Senate\u2014expand the US Supreme Court to add loyalists who will run in his favor on every case, including that Trump could serve a third term despite the&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/4f7e3fec-c2d0-488c-a841-235d42cbbb93?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">22<sup>nd<\/sup>&nbsp;Amendment<\/a>&nbsp;barring that.<\/strong><\/p>\n\n\n\n<p>I\u2019m not suggesting that a majority of the US Supreme Court would bar Trump from office simply to preserve their own power. In fact, the GOP controlled Supreme Court has already ruled against Trump several times including the unanimous decision in December 2020 rejecting the&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/f548fc1d-4cea-4c39-ab19-2503b343f1c0?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">lawsuit<\/a>&nbsp;brought by Texas GOP Attorney General Ken Paxton to overturn the 2020 election and an 8 to 1 ruling in January 2022&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/7e14cd5c-58f7-424a-a2d4-6f56333db968?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">rejecting<\/a>&nbsp;Trump\u2019s claim that executive privilege barred the National Archives from giving the House Jan. 6 committee hundreds of pages of documents from his time in the White House.<\/p>\n\n\n\n<p>In reality, the Colorado supreme court&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/d6ae09d8-5897-44c8-a4b5-2fc2a53585e8?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">ruling<\/a>&nbsp;that Trump is&nbsp;<strong>\u201cdisqualified from holding the office of President under Section 3 of the 14th Amendment\u201d&nbsp;<\/strong>is well reasoned and relies heavily on the original intent of the framers of the 14<sup>th<\/sup>&nbsp;Amendment. That means there\u2019s an abundance of valid legal reasons to uphold this decision.<\/p>\n\n\n\n<p>My point is that the Justices of the Supreme Court are human beings who have seen the same actions and words from Trump that we have. And in a case where they are torn on which way to decide, you can\u2019t preclude that their human instinct of self-preservation could lead them to disqualify the dictator in waiting Trump from ever holding office again. And that would 100 percent be the correct decision.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Justices are human beings.
