Jamie Raskin (D-Md.) speaks in the House of Representatives on July 12, 2022.<\/p>\n\n\n\n<p>\u00a0(Photo: Saul Loeb\/AFP via Getty Images)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">&#8220;The question is what do we do if he doesn&#8217;t recuse himself,&#8221; the Maryland Democrat said.<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.commondreams.org\/author\/jessica-corbett\">JESSICA CORBETT<\/a><\/p>\n\n\n\n<p>Dec 31, 2023 (CommonDreams.org)<a href=\"https:\/\/giving.commondreams.org\/-\/XKQWGZVR\"><\/a><\/p>\n\n\n\n<p>Amid expectations that the right-wing U.S. Supreme Court will soon&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">consider<\/a>&nbsp;legal arguments that former President Donald Trump should be disqualified from 2024 Republican primary ballots, Democratic Maryland Congressman&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/jamie-raskin\">Jamie Raskin<\/a>&nbsp;on Sunday&nbsp;<a href=\"https:\/\/www.cnn.com\/videos\/politics\/2023\/12\/31\/sotu-raskin-full.cnn\" target=\"_blank\" rel=\"noreferrer noopener\">called for<\/a>&nbsp;Justice&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/clarence-thomas\">Clarence Thomas<\/a>&nbsp;to recuse himself from any such cases.<\/p>\n\n\n\n<p>Raskin\u2014a constitutional scholar and the lead Trump impeachment manager after the January 6, 2021 attack on the U.S. Capitol\u2014appeared on&nbsp;<em>CNN<\/em>&#8216;s &#8220;State of the Union&#8221; to discuss claims that the Republican is not qualified to hold office under Section 3 of the 14th Amendment to the Constitution after inciting an insurrection.<\/p>\n\n\n\n<p>Thomas isn&#8217;t one of the court&#8217;s three justices appointed by the twice-impeached former president, but his wife, Ginni Thomas, participated in the far-right effort to obstruct the certification of the 2020 election that Trump lost to Joe Biden, the Democratic president who is now seeking reelection next year.<\/p>\n\n\n\n<p>After&nbsp;<em>CNN<\/em>&#8216;s Dana Bash asked about potential recusals, Raskin responded, &#8220;I think anybody looking at this in any kind of dispassionate, reasonable way would say if your wife was involved in the Big Lie and claiming that Donald Trump had actually won the presidential election and been agitating for that and participating in the events leading up to January 6, that you shouldn&#8217;t be participating.&#8221;<\/p>\n\n\n\n<p>&#8220;He absolutely should recuse himself,&#8221; added Raskin, ranking member of the&nbsp;<strong><\/strong>House Oversight and Accountability Committee, echoing a recent&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/clarence-thomas-recuse-trump-case\">letter<\/a>&nbsp;from other Democrats in Congress. &#8220;The question is what do we do if he doesn&#8217;t recuse himself.&#8221;<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">.<a href=\"https:\/\/twitter.com\/RepRaskin?ref_src=twsrc%5Etfw\">@RepRaskin<\/a> tells <a href=\"https:\/\/twitter.com\/DanaBashCNN?ref_src=twsrc%5Etfw\">@DanaBashCNN<\/a> that Supreme Court Justice Clarence Thomas should \u201cabsolutely\u201d recuse himself from any future 14th Amendment ballot disqualification case against Donald Trump, but \u201cthe question is, what do we do if he doesn&#39;t recuse himself?\u201d <a href=\"https:\/\/t.co\/1SW5F9v2Sj\">pic.twitter.com\/1SW5F9v2Sj<\/a><\/p>&mdash; State of the Union (@CNNSOTU) <a href=\"https:\/\/twitter.com\/CNNSOTU\/status\/1741491516734857221?ref_src=twsrc%5Etfw\">December 31, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p>Raskin also discussed the nonbinding Code of Conduct that the court&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/supreme-court-code-of-ethics-2666255397\" target=\"_blank\" rel=\"noreferrer noopener\">unveiled<\/a>&nbsp;last month\u2014amid mounting public pressure and concerns about right-wing justices taking gifts from wealthy Republican donors\u2014and the 14th Amendment argument about Trump, referencing an August&nbsp;<a href=\"https:\/\/www.commondreams.org\/r\/entryeditor\/A%20pair%20of%20conservative%20legal%20scholars\">essay<\/a>&nbsp;from a pair of conservative legal scholars.<\/p>\n\n\n\n<p>In a case brought by a watchdog group and legal team representing GOP and unaffiliated voters, the Colorado Supreme Court earlier this month barred Trump from the state&#8217;s 2024 primary ballot. Both the state&#8217;s Republican Party and those behind the case have&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">asked<\/a>&nbsp;for an expedited review by the U.S. Supreme Court.<\/p>\n\n\n\n<p>Maine voters also challenged formally challenged Trump&#8217;s eligibility, leading Democratic Secretary of State Shenna Bellows on Thursday to bar Trump from next year&#8217;s primary ballot. The recent developments have led to a&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-supporters\" target=\"_blank\" rel=\"noreferrer noopener\">surge<\/a>&nbsp;in threats against Bellows and her Colorado counterpart, Democrat Jena Griswold.<\/p>\n\n\n\n<p>If Trump\u2014who is also facing various criminal cases\u2014wins the Republican nomination but loses the 2024 general election, he will try to reverse the results again, Raskin warned Sunday.<\/p>\n\n\n\n<p>&#8220;Donald Trump can strike the pose of the martyr in any given context,&#8221; he said. &#8220;If he&#8217;s allowed to stay on the ballot, despite his clear incitement of an insurrection and attempt to overturn the results in the 2020 election, and he loses to Joe Biden&#8230; he will feel himself a martyr there, and he will try to overturn the election result again.&#8221;<\/p>\n\n\n\n<p>&#8220;So I don&#8217;t think we can run scared from Donald Trump,&#8221; Raskin argued. &#8220;We have got to enforce our Constitution.
