Social clubs where people will be able to obtain marijuana are due to launch in July.<\/p>\n\n\n\n<p>Under the new policy, adults 18 and older are allowed to possess up to 25 grams of cannabis and grow up to three plants for personal use.<\/p>\n\n\n\n<p>Once social clubs open over the summer, members will be able to buy up to 25 grams of cannabis, with a cap of 50 grams per month. That cap is 30 grams for members under 21 years old.<\/p>\n\n\n\n<p>The social clubs cannot be be located near schools or playgrounds, and each jurisdiction will be able to have only one club for every 6,000 residents. Clubs will be limited to 500 members and will need a permit, which will be valid for up to seven years with the possibility of receiving an extension.<\/p>\n\n\n\n<p>There will be an official analysis of the effects of legalization on youth safety that must be completed within 18 months of enactment under the&nbsp;<a href=\"https:\/\/www.recht.bund.de\/bgbl\/1\/2024\/109\/VO.html\" target=\"_blank\" rel=\"noreferrer noopener\">law<\/a>.<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"de\" dir=\"ltr\">Ich w\u00fcnsche euch allen einen sch\u00f6nen ersten April. Ein gutes Gef\u00fchl. <a href=\"https:\/\/t.co\/zHEBWRB0cz\">https:\/\/t.co\/zHEBWRB0cz<\/a><\/p>&mdash; Carmen Wegge (@CarmenWegge) <a href=\"https:\/\/twitter.com\/CarmenWegge\/status\/1774682711258448188?ref_src=twsrc%5Etfw\">April 1, 2024<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p>Bundesrat President Manuela Schwesig signed the legislation last week, completing its lengthy journey to enactment that involved debate and compromises within the government so-called traffic light party coalition.<\/p>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/germanys-parliament-approves-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noreferrer noopener\">Bundestag passed the marijuana legalization measure in February<\/a>.<\/p>\n\n\n\n<p>Last month,&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/top-german-officials-commit-to-marijuana-legalization-law-changes-ahead-of-key-vote-to-avoid-implementation-delay\/\" target=\"_blank\" rel=\"noreferrer noopener\">members of the separate Bundesrat representing individual states reached a deal with Health Minister Karl Lauterbach<\/a>&nbsp;and other government ministers and&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/germany-marijuana-legalization-law-will-take-effect-on-schedule-next-month-after-lawmakers-decline-to-delay-implementation\/\" target=\"_blank\" rel=\"noreferrer noopener\">declined to refer the cannabis legislation to a mediation committee<\/a>&nbsp;that would have delayed implementation by six months.<\/p>\n\n\n\n<p>The Bundesrat previously&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/bill-to-legalize-marijuana-in-germany-advances-after-state-representatives-fail-to-block-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">tried to block the proposed reform in September but ultimately failed<\/a>.<\/p>\n\n\n\n<p>Officials are eventually planning to introduce a complementary second measure that would establish pilot programs for commercial sales in cities throughout the country. They also&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/german-lawmakers-postpone-marijuana-legalization-vote-scheduled-for-next-week-pushing-proposed-reform-into-2024\/\" target=\"_blank\" rel=\"noreferrer noopener\">pushed back a vote scheduled for November<\/a>&nbsp;as supporters worked on improvements to the bill.<\/p>\n\n\n\n<p>At a meeting in December, the health minister took questions from members, some of whom oppose legalization. At several points, he&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/germanys-top-health-official-defends-marijuana-legalization-bill-against-critics-ahead-of-next-weeks-vote\/\" target=\"_blank\" rel=\"noreferrer noopener\">pushed back against lawmakers who suggested that legalization would send the wrong message to youth<\/a>&nbsp;and lead to increased underage consumption, saying their arguments \u201cmisrepresented\u201d the legislation.<\/p>\n\n\n\n<p>Lawmakers also&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/german-lawmakers-reach-agreement-on-revised-marijuana-legalization-bill-with-final-vote-expected-next-week\/\" target=\"_blank\" rel=\"noreferrer noopener\">previously made a raft of adjustments to the bill<\/a>, mostly designed to loosen restrictions that faced opposition from advocates and supporters in the Bundestag. They included increasing home possession maximums and removing the possibility of jail time for possessing slightly more than the allowable limit.<\/p>\n\n\n\n<p>While Germany\u2019s Federal Cabinet approved the initial framework for a legalization measure in late 2022, the government also said it&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/germanys-government-approves-marijuana-legalization-plan-but-reform-depends-on-european-union-sign-off\/\" target=\"_blank\" rel=\"noreferrer noopener\">wanted to get signoff from the EU<\/a>&nbsp;to ensure that enacting the reform wouldn\u2019t put them in violation of their international obligations.<\/p>\n\n\n\n<p>The framework was the product of months of review and negotiations within the German administration and the traffic light coalition government. Officials&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/german-officials-formally-launch-marijuana-legalization-effort-with-hearings-set-to-begin-this-week\/\" target=\"_blank\" rel=\"noreferrer noopener\">took a first step toward legalization in 2022<\/a>, kicking off a series of hearings meant to help inform legislation to end prohibition in the country.<\/p>\n\n\n\n<p>Government officials from multiple countries, including the U.S., also met in Germany last November to&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/germany-hosts-officials-from-u-s-and-other-countries-for-marijuana-forum-on-creating-international-policy-framework\/\" target=\"_blank\" rel=\"noreferrer noopener\">discuss international marijuana policy issues<\/a>&nbsp;as the host nation works to enact legalization.<\/p>\n\n\n\n<p>A group of German lawmakers, as well as Narcotics Drugs Commissioner Burkhard Blienert, separately&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/german-lawmakers-tour-california-marijuana-businesses-to-inform-national-legalization-plans\/\" target=\"_blank\" rel=\"noreferrer noopener\">visited the U.S. and toured California cannabis businesses<\/a>&nbsp;in 2022 to inform their country\u2019s approach to legalization.<\/p>\n\n\n\n<p>The visit came after top officials from Germany, Luxembourg, Malta and the Netherlands&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/germany-luxembourg-malta-and-the-netherlands-discuss-marijuana-legalization-at-historic-joint-meeting\/\" target=\"_blank\" rel=\"noreferrer noopener\">held a first-of-its-kind meeting to discuss plans and challenges<\/a>&nbsp;associated with recreational marijuana legalization.<\/p>\n\n\n\n<p>Leaders of the coalition government said in 2021 that they had&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/germany-will-legalize-marijuana-and-promote-drug-harm-reduction-governing-party-coalition-officially-announces\/\" target=\"_blank\" rel=\"noreferrer noopener\">reached an agreement to end cannabis prohibition<\/a>&nbsp;and enact regulations for a legal industry, and they first&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/german-officials-preview-marijuana-legalization-plan-details\/\" target=\"_blank\" rel=\"noreferrer noopener\">previewed certain details of that plan<\/a>&nbsp;last year.<\/p>\n\n\n\n<p>A novel international survey that was released in 2022&nbsp;<a href=\"https:\/\/www.marijuanamoment.net\/majority-of-europeans-support-marijuana-legalization-new-international-poll-finds\/\" target=\"_blank\" rel=\"noreferrer noopener\">found majority support for legalization<\/a>&nbsp;in several key European countries, including Germany.<\/p>\n\n\n\n<p>Meanwhile, the United Nations\u2019s (UN) drug control body recently reiterated that it considers legalizing marijuana for non-medical or scientific purposes a violation of international treaties, though it also said it\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.marijuanamoment.net\/un-body-reaffirms-that-marijuana-legalization-violates-international-treaties-while-addressing-germany-cannabis-reform-and-u-s-psychedelics-movement\/\" target=\"_blank\">appreciates that Germany\u2019s government scaled back its cannabis plan ahead of the recent vote<\/a>.<\/p>\n\n\n\n<p>(Contributed by Brett Wilkins)<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Published\u00a0on\u00a0April 1, 2024 (marijuanamoment.net) By\u00a0Kyle Jaeger\u00a0 Germany\u2019s marijuana legalization law officially took effect\u00a0on Monday, with personal possession and cultivation now permitted for adults.
