Kennedy\u2019s campaign told supporters Wednesday that those facing charges in connection to the Jan. 6, 2021, Capitol riot are \u201cactivists sitting in a Washington DC jail cell stripped of their Constitutional liberties.\u201d<\/p>\n\n\n\n<p>Kennedy\u2019s campaign used the language in an email urging his followers to sign a petition calling for the release of WikiLeaks founder Julian Assange. In the email, titled \u201cWe Must Free Assange!&#8221;, the campaign compared those jailed for their actions on Jan. 6 to Assange and&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/world\/2022\/09\/26\/putin-snowden-citizenship-russia\/\" rel=\"noreferrer noopener\">Edward Snowden<\/a>, a former National Security Agency contractor who leaked information about top-secret U.S. surveillance programs and is now living in Moscow.<\/p>\n\n\n\n<p>The campaign on Thursday claimed Kennedy did not approve of the wording in the email, blaming the \u201cerror\u201d on a contractor. But Kennedy himself has previously downplayed the violence of the Jan. 6 attack and said he is open to pardoning convicted rioters.<\/p>\n\n\n\n<p>The email, sent from \u201cTeam Kennedy,\u201d refers to a British Court\u2019s decision to<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/world\/2024\/03\/26\/julian-assange-uk-court-extradition\/\" rel=\"noreferrer noopener\">&nbsp;delay extradition<\/a>&nbsp;to the United States until Assange is guaranteed free-speech protections and will not incur the death penalty in a U.S. trial. Kennedy \u2014 an anti-vaccine activist who rails against government censorship as a major plank of his third-party campaign \u2014 has said he&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.kennedy24.com\/pardon_julian_assange_robert_f_kennedy_jr\" rel=\"noreferrer noopener\">would pardon&nbsp;<\/a>Assange if elected president.<\/p>\n\n\n\n<p>\u201cThe Brits want to make sure our government doesn\u2019t kill Assange,\u201d the email says. \u201cThis is the reality that every American Citizen faces \u2014 from Ed Snowden, to Julian Assange to the J6 activists sitting in a Washington DC jail cell stripped of their Constitutional liberties.\u201d<\/p>\n\n\n\n<p>It\u2019s unclear which Jan. 6 defendants Kennedy\u2019s campaign is referring to \u2014 very few of them are in D.C. jail, where a small percentage of them await trial, sentencing, or transfer to a federal prison to serve out their sentences. Despite complaints from some far-right lawmakers, no court has found that detention violated their rights.<\/p>\n\n\n\n<p>The naming of the defendants as \u201cactivists\u201d echoes&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/elections\/2024\/03\/23\/trump-jan-6-rioters-rhetoric-campaign\/\" rel=\"noreferrer noopener\">Donald Trump\u2019s decision to align himself with the Jan. 6 rioters<\/a>&nbsp;by glorifying them as \u201cpatriots\u201d and \u201chostages\u201d and glossing over the violence committed that day intended to prevent Joe Biden from being legally certified as president.<\/p>\n\n\n\n<p>At campaign rallies, Trump has played a musical tribute to the jailed Capitol defendants. Meanwhile, President Biden has&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/politics\/2024\/01\/03\/biden-jan-6-trump-election-2024\/\" rel=\"noreferrer noopener\">slammed<\/a>&nbsp;Trump over his refusal to&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/politics\/2023\/01\/06\/biden-jan-6-awards\/\" rel=\"noreferrer noopener\">accept the results of the 2020 election<\/a>&nbsp;or&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/national-security\/2022\/07\/25\/biden-jan6-trump-medieval-hell\/\" rel=\"noreferrer noopener\">take responsibility for the violence<\/a>. Kennedy has mostly avoided talking about Jan. 6 on the campaign trail, in speeches or social media postings. He did not post on Twitter, now called X, about the riot.<\/p>\n\n\n\n<p>But Kennedy shared his views about the Capitol riot with Politico\u2019s David Freelander, who<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.politico.com\/news\/magazine\/2023\/10\/08\/robert-f-kennedy-jr-2024-campaign-profile-00119959\" rel=\"noreferrer noopener\">&nbsp;asked him<\/a>&nbsp;in October if he remembered where he was on Jan. 6. Kennedy\u2019s comments came after the two had discussed the presidential candidate\u2019s views on government censorship.<\/p>\n\n\n\n<p>\u201cWhat do you think is more dangerous,\u201d he asked Friedlander. \u201cThe censorship by the government of Americans who disagree with its policies or Jan. 6?\u201d<\/p>\n\n\n\n<p>He added: \u201cJan. 6 was an attack on a building. And we have lots of layers of government behind that building.\u201d<\/p>\n\n\n\n<p><a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/politics\/interactive\/2023\/presidential-candidates-2024-policies-issues\/robert-kennedy-jr-jan-6-2020-election-results\/\" rel=\"noreferrer noopener\">Kennedy previously told The Post<\/a>&nbsp;that he accepted the results of the 2020 election but would not commit to accepting the results of the 2024 election. He said he would consider pardoning those convicted of their role in the riot.<\/p>\n\n\n\n<p>\u201cIf prosecutorial malfeasance is demonstrated, then yes,\u201d he said. \u201cOtherwise, no.\u201d<\/p>\n\n\n\n<p>On Thursday, the campaign said in its statement that an email was \u201can error that does not reflect Mr. Kennedy\u2019s views.\u201d<\/p>\n\n\n\n<p>\u201cIt was inserted by a new marketing contractor and slipped through the normal approval process,\u201d campaign spokeswoman Stefanie Spear said.<\/p>\n\n\n\n<p>Kennedy faced criticism when he argued earlier this week that Biden was a&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/elections\/2024\/04\/02\/rfk-jr-biden-trump-democracy\/\" rel=\"noreferrer noopener\">greater threat to democracy<\/a>&nbsp;than Trump, who still falsely denies that Biden was legitimately elected in 2020. His assertion was based on the Biden administration\u2019s push for social media companies to monitor their sites for medical misinformation; Kennedy was temporarily banned from Instagram for spreading misinformation about vaccines.<\/p>\n\n\n\n<p>\u201cHim trying to overthrow the election clearly is a threat to democracy,\u201d Kennedy told CNN of Trump. \u201cBut the question was, who is a worse threat to democracy and what I would say is \u2026 I\u2019m not going to answer that question, but I can argue that President Biden is.\u201d<\/p>\n\n\n\n<p>Kennedy started his run for the presidency as a Democrat, but decided to run as an independent in October and has increasingly ramped up his attacks on Biden. The descendant of the prominent political family has some appeal to&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/politics\/2024\/04\/03\/robert-kennedy-jr-voters\/\" rel=\"noreferrer noopener\">both Republicans and Democrats<\/a>&nbsp;in what looks to be a 2024 rematch as he is seeking ballot access across the country.<\/p>\n\n\n\n<p>More than three years after the attack on the Capitol that interrupted the certification of the 2020 presidential election, only 30 of the nearly&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.justice.gov\/usao-dc\/38-months-since-the-jan-6-attack-on-the-capitol\" rel=\"noreferrer noopener\">1,400 people charged<\/a>&nbsp;with committing crimes that day are in the D.C. jail. All but a few of them have been charged or convicted of assaulting police officers during the riot. Most are awaiting sentencing or transfer to a prison facility. Among the handful being held before trial are a man<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/dc-md-va\/2024\/03\/14\/banuelos-gun-jan6-capitol-riot\/\" rel=\"noreferrer noopener\">&nbsp;with a long criminal history&nbsp;<\/a>charged with firing a gun outside the Capitol building, a man&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/dc-md-va\/2023\/06\/30\/obama-house-arrest-taranto-jan6\/\" rel=\"noreferrer noopener\">who showed up armed outside<\/a>&nbsp;former president Barack Obama\u2019s house, and people accused of attacking police officers with weapons ranging from&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.255309\/gov.uscourts.dcd.255309.1.1.pdf\" rel=\"noreferrer noopener\">explosive devices<\/a>&nbsp;to a<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.234024\/gov.uscourts.dcd.234024.74.0.pdf\" rel=\"noreferrer noopener\">&nbsp;metal whip<\/a>.<\/p>\n\n\n\n<p>In late 2021, a federal judge&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/local\/legal-issues\/dc-jail-conditions-contempt-investigation\/2021\/10\/13\/65292cd0-2ba1-11ec-985d-3150f7e106b2_story.html\" rel=\"noreferrer noopener\">asked the Justice Department&nbsp;<\/a>to investigate complaints from Jan. 6 defendants that they were being mistreated in the D.C. jail. A surprise inspection&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/local\/public-safety\/dc-jail-inmates-transferred\/2021\/11\/02\/b5255388-3be8-11ec-bfad-8283439871ec_story.html\" rel=\"noreferrer noopener\">found<\/a>&nbsp;the facility was unsanitary and staff members were engaged in abusive behavior \u2014 but not in the section where alleged rioters were being held, where conditions were found to be \u201clargely appropriate and consistent with federal prisoner detention standards.\u201d<\/p>\n\n\n\n<p>The same judge has joined several colleagues in pushing back publicly on claims that riot participants are being punished for their beliefs or for demonstrating in support of Trump. The Capitol attack, he said in&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.227212\/gov.uscourts.dcd.227212.272.0.pdf\" rel=\"noreferrer noopener\">sentencing one rioter this week<\/a>, \u201cwas neither First Amendment-protected activity nor civil disobedience \u2026 because it was violent, not peaceful; opportunistic, not principled; coercive, not persuasive; and selfish, not patriotic.\u201d<\/p>\n\n\n\n<p>Fifty-five percent of Americans believe the storming of the Capitol on Jan. 6 was \u201can attack on democracy that should never be forgotten,\u201d according to a&nbsp;<a target=\"_blank\" href=\"https:\/\/archive.is\/o\/9Igs4\/https:\/\/www.washingtonpost.com\/tablet\/2024\/01\/01\/dec-14-18-2023-washington-post-university-maryland-poll\/\" rel=\"noreferrer noopener\">Post-University of Maryland poll<\/a>&nbsp;from January. However, Republicans increasingly view the rioters in a positive light, with only 18 percent saying Jan. 6 protesters were \u201cmostly violent,\u201d compared to 77 percent of Democrats and 54 percent of independents who held that view.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Meryl Kornfield and Rachel Weiner\/The Washington Post Independent presidential candidate Robert F.
