The revised indictment comes in response to the U.S. Supreme Court&#8217;s July&nbsp;<em>Trump v. United States&nbsp;<\/em>ruling, which&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/donald-trump-immunity-case\" target=\"_blank\" rel=\"noreferrer noopener\">affirmed<\/a>&nbsp;presidents&#8217; &#8220;absolute immunity&#8221; for &#8220;official acts&#8221; taken while in office.<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">BREAKING: A superseding, post-immunity ruling indictment against Donald Trump has been issued in federal court in DC. <a href=\"https:\/\/t.co\/8FZCc1bPGZ\">https:\/\/t.co\/8FZCc1bPGZ<\/a> <a href=\"https:\/\/t.co\/Y9lS7aJDRg\">pic.twitter.com\/Y9lS7aJDRg<\/a><\/p>&mdash; Chris \u201cLaw Dork\u201d Geidner (@chrisgeidner) <a href=\"https:\/\/twitter.com\/chrisgeidner\/status\/1828527796836356230?ref_src=twsrc%5Etfw\">August 27, 2024<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p>None of the four charges against Trump\u2014conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights\u2014have been dropped.<\/p>\n\n\n\n<p>However, parts of Smith&#8217;s initial indictment\u2014like Trump&#8217;s conversations with officials at the Department of Justice after the 2020 election\u2014are no longer admissible under the high court&#8217;s ruling.<\/p>\n\n\n\n<p>&#8220;Trump is therefore absolutely immune from prosecution for the alleged conduct involving his discussions with Justice Department officials,&#8221; Chief Justice John Roberts wrote for the 6-3 majority in the decision.<\/p>\n\n\n\n<p>To secure the new indictment, Smith presented his evidence to an entirely new grand jury.<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">AND the statement issued by Jack Smith&#39;s office saying a NEW grand jury issue this indictment removes any argument that the prior indictment was tainted because the first grand jury was presented with evidence that violates the Supreme Court absolute immunity ruling. Brilliant! <a href=\"https:\/\/t.co\/deCze9DuJc\">https:\/\/t.co\/deCze9DuJc<\/a><\/p>&mdash; Glenn Kirschner (@glennkirschner2) <a href=\"https:\/\/twitter.com\/glennkirschner2\/status\/1828534819808256506?ref_src=twsrc%5Etfw\">August 27, 2024<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p>&#8220;So, a new group of American citizens, doing their civic duty, sat and heard this evidence and returned &#8216;a true bill&#8217; against Trump for the four charges in this superseding indictment,&#8221;&nbsp;<a href=\"https:\/\/x.com\/KatiePhang\/status\/1828543720653836786\" target=\"_blank\" rel=\"noreferrer noopener\">observed<\/a><em>MSNBC<\/em>&#8216;s Katie Phang.<\/p>\n\n\n\n<p>Reacting to the new indictment on his Truth social network, Trump fumed with his usual overcapitalization that &#8220;no Presidential Candidate, or Candidate for any Office, has ever had to put up with all of this Lawfare and Weaponization directly out of the Office of a Political Opponent.&#8221;<\/p>\n\n\n\n<p>&#8220;The whole case should be thrown out and dismissed on Presidential Immunity grounds, as already ruled unequivocally by the U.S. Supreme Court,&#8221; Trump said. &#8220;What they are doing now is the single greatest sabotage of our Democracy in History.&#8221;<\/p>\n\n\n\n<p>https:\/\/twitter.com\/ArtCandee\/status\/1828549086464671818?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1828549086464671818%7Ctwgr%5E5bc6cfdd2e6848437311b174b30df6c6d9a08fb4%7Ctwcon%5Es1_c10&#038;ref_url=https%3A%2F%2Fwww.commondreams.org%2Fnews%2Ftrump-indicted-again<\/p>\n\n\n\n<p>Grant Stern, the executive editor of Occupy Democrats, quipped on social media, &#8220;Congratulations to Donald Trump on being the historic first-ever major party presidential nominee to be indicted after the convention.&#8221;<\/p>\n\n\n\n<p>Trump was impeached twice during his presidency, including&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/2021\/01\/13\/mcconnell-urged-finish-job-and-reconvene-senate-put-twice-impeached-trump-trial\" target=\"_blank\" rel=\"noreferrer noopener\">for inciting<\/a>&nbsp;the January 6, 2021 storming of the U.S. Capitol by believers of the then-president&#8217;s &#8220;Big Lie&#8221; that the 2020 presidential contest was &#8220;rigged&#8221; by Democrats. He was not convicted by the Senate in either case.<\/p>\n\n\n\n<p>In May, a New York state jury&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-convicted\" target=\"_blank\" rel=\"noreferrer noopener\">found Trump guilty<\/a>&nbsp;on all 34 felony counts related to the falsification of business records regarding hush money payments to cover up sex scandals during the 2016 presidential election. It was the first time in U.S. history that a former president was convicted of felony crimes.<\/p>\n\n\n\n<p>In Georgia, the state Court of Appeals last month&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-georgia-case\" target=\"_blank\" rel=\"noreferrer noopener\">paused<\/a>&nbsp;proceedings in a separate election interference case against Trump and other defendants until an appellate panel determines whether the prosecuting district attorney should be disqualified for an alleged conflict of interest. Trump faces 10 felony charges in the case, including violations of the Racketeer Influenced and Corruption Organizations Act, conspiracy to commit impersonating a public officer, conspiracy to commit forgery in the first degree, false statements and writing, and filing false documents.<\/p>\n\n\n\n<p>Last month, U.S. District Judge Aileen Cannon\u2014a Trump appointee\u2014<a rel=\"noreferrer noopener\" href=\"https:\/\/www.commondreams.org\/news\/donald-trump-classified-documents\" target=\"_blank\">dismissed<\/a>\u00a040 felony charges against the former president over his alleged mishandling of classified government documents after he left office.
