{"id":35803,"date":"2024-08-28T12:49:58","date_gmt":"2024-08-28T19:49:58","guid":{"rendered":"https:\/\/occupysf.net\/?p=35803"},"modified":"2024-08-28T12:49:58","modified_gmt":"2024-08-28T19:49:58","slug":"neighborhood-businesses-threatened-by-upzoning-and-speculators","status":"publish","type":"post","link":"https:\/\/occupysf.net\/index.php\/2024\/08\/28\/neighborhood-businesses-threatened-by-upzoning-and-speculators\/","title":{"rendered":"Neighborhood businesses threatened by upzoning and speculators"},"content":{"rendered":"\n<p>Peskin plan would slow down the displacement of longtime commercial tenants as Breed&#8217;s proposal starts to fuel evictions.<a href=\"https:\/\/48hills.org\/author\/tim\/\"><\/a><\/p>\n\n\n\n<p>By <a href=\"https:\/\/48hills.org\/author\/tim\/\">TIM REDMOND<\/a><\/p>\n\n\n\n<p>AUGUST 26, 2024 (48hills.org)<\/p>\n\n\n\n<p>The first signs of a potentially massive problem with Mayor London Breed\u2019s plan to upzone commercial corridors for more housing emerged this week, as&nbsp;<a href=\"https:\/\/www.sfchronicle.com\/realestate\/article\/sf-investor-fillmore-businesses-19659568.php\">Laura Waxman at the Chron reported<\/a>&nbsp;that<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Earlier this year, stealthy entities spent upwards of $40 million on acquiring more than half a dozen aging buildings on Fillmore between Clay and Pine streets, including the\u00a0<a href=\"https:\/\/www.sfchronicle.com\/realestate\/article\/s-f-clay-theater-sold-mystery-18672293.php\">defunct Clay Theater<\/a>\u00a0at 2261 Fillmore. For now, they\u2019re adding to the street\u2019s shuttered storefronts by displacing a handful of long-time small businesses in an apparent bid to ultimately bring more high-end retailers into the area.\u00a0<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" loading=\"lazy\" width=\"768\" height=\"1024\" src=\"https:\/\/occupysf.net\/wp-content\/uploads\/2024\/08\/image-68.png\" alt=\"\" class=\"wp-image-35804\" srcset=\"https:\/\/occupysf.net\/wp-content\/uploads\/2024\/08\/image-68.png 768w, https:\/\/occupysf.net\/wp-content\/uploads\/2024\/08\/image-68-225x300.png 225w, https:\/\/occupysf.net\/wp-content\/uploads\/2024\/08\/image-68-113x150.png 113w\" sizes=\"(max-width: 768px) 100vw, 768px\" \/><\/figure>\n\n\n\n<p><em>Sup. Aaron Peskin talks about his plan in front of threatened businesses in the Upper Fillmore.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>This is one of the areas where Breed would like to see an eight-story height limit to allow more apartment buildings. It\u2019s a \u201ctransit corridor.\u201d That all sounds good in theory\u2014but most of the buildings in those corridors are occupied by existing residential and commercial tenants.<\/p>\n\n\n\n<p>Building new apartments means demolishing the existing structures\u2014and while residential tenants under rent control have some rights, and may be able to return to the new buildings (though many will be displaced forever), commercial tenants have almost no rights at all.<\/p>\n\n\n\n<p>So the upzoning could create massive displacement of legacy and neighborhood-serving businesses.<\/p>\n\n\n\n<p>In the wake of the Upper Fillmore news, Sup. Aaron Peskin, who is running for mayor, announced today a creative plan that could change the whole upzoning debate: He is suggesting that any landlord who wants to displace a legacy or neighborhood anchor business, for any reason, should have to get a conditional use approval from the Planning Commission, which mandates a public hearing.<\/p>\n\n\n\n<p>The conditional use process slows down any development activity. It adds expense to the developer, and can be appealed to the Board of Supes, which creates an opportunity for the community to bring the issue to citywide attention.<\/p>\n\n\n\n<p>Developers hate CUs, as generally do the Yimbys, who see the process as delaying housing. But it\u2019s hard to argue that the displacement of longtime community businesses is justified by the need to let speculators make huge profits buying up property before it is upzoned.<\/p>\n\n\n\n<p>Which, it appears, is starting to happen.<\/p>\n\n\n\n<p>Nick Ferris of Neighborhoods United SF:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWhat is happening on Fillmore Street shows that Mayor Breed\u2019s upzoning plan is already fueling real estate speculation and making small businesses vulnerable to displacement and demolition. We must ensure that a wave a displacement doesn\u2019t destroy our neighborhoods.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>More from a Peskin press release:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWe support the need for more housing and especially affordable housing, but it does not need to come at the expense of small businesses,\u201d said Justin Dolezal, President of Small Business Forward and owner of Bar Part Time. \u201cWe will not silently become a casualty of the upzoning plan.\u201d<\/p>\n<\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Among the advocates at the event was Bismar Jaffer, an attorney with Lawyers\u2019 Committee for Civil Rights of San Francisco: \u201cMany legacy businesses are owned by immigrants, or underrepresented groups who have historically faced barriers to economic opportunities. Protecting these businesses keeps these communities thriving and contributes to the city\u2019s diversity. San Francisco has a responsibility to support policies that safeguard the rights of small business owners and ensure equitable development. We demand that investors respect the historical and cultural significance of these businesses and provide the support needed to keep them in our communities.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>Peskin:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThere is a right and wrong way to grow our city, and this is the wrong way.\u201d said President Peskin. \u201cWe are here today with three generations of the Caf\u00e9 La Mediterran\u00e9e family. This family and this business are part of the cultural fabric of our city. They are being pushed out and not even getting a bus ticket.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>This is just one neighborhood commercial district, but it\u2019s a canary in the coal mine. There will be more.<\/p>\n\n\n\n<p>Potentially, if the supes can require a CU for the displacement of legacy businesses, they could add to the mayor\u2019s upzoning plan a CU mandate for any displacement of any neighborhood-serving business.<\/p>\n\n\n\n<p>For now, the Peskin proposal in an Interim Control plan, which would stay in place for 18 months. The district supervisor who represents the area, Catherine Stefani, told the Chron that she<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>is \u201ccollaborating closely\u201d with the new property owners, city departments and Fillmore stakeholders to \u201censure clear communication about the future of our cherished corridor.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>She\u2019s also running for the state Assembly, and is not a cosponsor of Peskin\u2019s proposal. Neither is Mayor London Breed:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>\u201cConversations are continuing about the future uses of the sites,\u201d said Jeff Cretan, Breed\u2019s spokesperson.<\/p>\n<\/blockquote>\n\n\n\n<p>I&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Mistakes_were_made\">just love the passive voice<\/a>.
