Engelmayer said the Treasury Dept., in addition to suspending Musk and his team from access, must &#8220;immediately destroy any and all copies of material downloaded from the Treasury Department&#8217;s records and systems, if any.&#8221;<\/p>\n\n\n\n<p>In the coalition&#8217;s lawsuit, led by New York Attorney General Letitia James, the states&nbsp;<a href=\"https:\/\/ag.ny.gov\/press-release\/2025\/attorney-general-james-leads-multistate-coalition-suing-stop-elon-musk-and-doges\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a>&nbsp;that allowing DOGE personnel\u2014who have been characterized as far-right libertarian &#8220;<a href=\"https:\/\/www.commondreams.org\/news\/musk-doge-overreach\" target=\"_blank\" rel=\"noreferrer noopener\">goons<\/a>&#8221; and a &#8220;<a href=\"https:\/\/projects.propublica.org\/elon-musk-doge-tracker\/\" target=\"_blank\" rel=\"noreferrer noopener\">demolition crew<\/a>&#8221; intent on gutting federal agencies from the inside out\u2014access to the Treasury system was unlawful in the first place and could give them the ability &#8220;to block federal funds to states and programs providing health care, childcare, and other critical services&#8221;\u2014none of which they are authorized to do.<\/p>\n\n\n\n<p><a href=\"https:\/\/x.com\/rparloff\/status\/1888207674463907943?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1888207674463907943%7Ctwgr%5E%7Ctwcon%5Es1_c10&amp;ref_url=https%3A%2F%2Fwww.commondreams.org%2Fnews%2Fdoge-treasury-payment-system\">https:\/\/x.com\/rparloff\/status\/1888207674463907943?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1888207674463907943%7Ctwgr%5E%7Ctwcon%5Es1_c10&amp;ref_url=https%3A%2F%2Fwww.commondreams.org%2Fnews%2Fdoge-treasury-payment-system<\/a><\/p>\n\n\n\n<p>Judge Engelmayer, in his decision, said the named defendants in the suit\u2014President&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/donald-trump\">Donald Trump<\/a>, his Treasury Secretary Scott Bessent, and the Treasury Department\u2014will be compelled to show cause at a hearing on Feb. 14 before a separate judge presiding over an existing challenge to DOGE&#8217;s access to the system.<\/p>\n\n\n\n<p>In a statement following the ruling, James&nbsp;<a href=\"https:\/\/x.com\/NewYorkStateAG\/status\/1888208483410972970\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>: &#8220;This morning, we won a court order blocking&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/elon-musk\">Elon Musk<\/a>, the world\u2019s richest man, from accessing Americans&#8217; private data. Musk and his DOGE employees must destroy all records they&#8217;ve obtained. I&#8217;ve said it before, and I&#8217;ll say it again: no one is above the law.&#8221;<\/p>\n\n\n\n<p>Under the order, as the&nbsp;<em>Washington Post<\/em><a href=\"https:\/\/www.washingtonpost.com\/national-security\/2025\/02\/07\/trump-musk-government-efficiency-attorneys-general-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">reports<\/a>, &#8220;the Trump administration is prohibited from giving access to political appointees, special government employees or government employees that are not assigned to the Treasury Department.&#8221;<\/p>\n\n\n\n<p>On Friday,&nbsp;<em>Wired<\/em><a href=\"https:\/\/www.wired.com\/story\/treasury-bfs-doge-insider-threat\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>&nbsp;that an internal agency at Treasury had assessed the DOGE personnel place inside the department as &#8220;an insider threat.&#8221;<\/p>\n\n\n\n<p>&#8220;There is ongoing litigation, congressional legislation, and widespread protests relating to DOGE&#8217;s access to Treasury and the Bureau of the Fiscal Service,&#8221; reads a section of an email from the internal agency reviewed by the news outlet.<\/p>\n\n\n\n<p>&#8220;If DOGE members have any access to payment systems,&#8221; the email continued, &#8220;we recommend suspending that access immediately and conducting a comprehensive review of all actions they may have taken on these systems.&#8221;<\/p>\n\n\n\n<p>Our work is licensed under Creative Commons (CC BY-NC-ND 3.0).
