He wouldn\u2019t even be required, by the letter of the law, to allege an \u201cinsurrection.\u201d All that would be required is to assert that \u201cunlawful obstruction\u201d has made it&nbsp;<a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid:USC-prelim-title10-section252&amp;num=0&amp;edition=prelim#:~:text=Whenever%20the%20President%20considers%20that,Federal%20service%20such%20of%20the\" class=\"\">\u201cimpracticable to enforce the laws of the United States\u201d<\/a>&nbsp;(as President Dwight D. Eisenhower did when he ordered the Arkansas National Guard to enforce the desegregation of Little Rock, Ark., schools).<\/p>\n\n\n\n<p>This is where all the false claims and outright lies Trump and his political allies have been pushing will come into play: Trump falsely alleging, for example, that&nbsp;<a href=\"https:\/\/www.politico.com\/news\/2024\/10\/11\/trump-aurora-colorado-immigration-gangs-00183533\" class=\"\">an entire city in Colorado has been taken over by Venezuelan street gangs<\/a>, that a city in Ohio has been overrun by Haitian refugees who are&nbsp;<a href=\"https:\/\/www.bbc.com\/news\/articles\/c77l28myezko\" class=\"\">eating all the cats<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.sfchronicle.com\/opinion\/openforum\/article\/trump-dogs-haitians-19761702.php\" class=\"\">dogs<\/a>, and other vague assertions that \u201cmillions and millions\u201d of \u201cillegals\u201d are pouring into our country every week (or \u201cday\u201d depending on who\u2019s telling the lie at the moment).<\/p>\n\n\n\n<p>Each of these false claims and outright lies could be distilled, to declare martial law, into catchy phrases (beginning with the legalese word \u201cWhereas\u201d) to establish the legal premise for invoking the Insurrection Act, and to lay the predicate to begin going door-to-door, wherever they please, under the pretense of searching for undocumented immigrants who don\u2019t exist.<\/p>\n\n\n\n<p>Despite the logistical complexity, not to mention the sheer size of U.S. territory and population, implementing martial law could move quickly. Take that city in Colorado, for example:<\/p>\n\n\n\n<p>For months leading up to the election,&nbsp;<a href=\"https:\/\/abc7news.com\/post\/vance-stands-trumps-false-claims-venezuelan-gangs-have-invaded-aurora-colorado\/15424150\/\" class=\"\">Trump and his surrogates spread wild lies about Aurora<\/a>, promising extensive immigration raids, if elected.<\/p>\n\n\n\n<p>Aurora just happens to already have&nbsp;<a href=\"https:\/\/www.geogroup.com\/facilities\/aurora-ice-processing-center\/\" class=\"\">its own Immigration and Customs Enforcement office<\/a>, plus a military base, which has just been tapped to serve as a&nbsp;<a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2025\/02\/03\/buckley-space-force-base-ice-immigration-enforcement\/78193817007\/\" class=\"\">\u201ctemporary\u201d detention center<\/a>.<\/p>\n\n\n\n<p>Project 2025 further proposes to push past Trump\u2019s plan&nbsp;\u2014 already in progress (but reportedly being phased out),&nbsp;<a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/02\/21\/ice-camp-guantanamo-bay-surprise-review-trump\/79350737007\/\" class=\"\">to house up to 30,000 detainees<\/a>&nbsp;on a rolling basis at the U.S. Navy base at Guantanamo Bay, Cuba \u2014 by bringing Guantanamo to a town near you: setting up additional Guantanamos scattered out all across the country.<\/p>\n\n\n\n<p>One such potential Guantanamo I believe to be&nbsp;<a href=\"https:\/\/www.kctv5.com\/video\/2025\/02\/26\/city-officials-consider-proposal-ice-detention-facility-leavenworth\/\" class=\"\">under consideration<\/a>&nbsp;is the former Leavenworth Detention Center, a former outpost of our nation\u2019s for-profit \u201cprison industrial complex\u201d located near Kansas City, Mo.&nbsp;<a href=\"https:\/\/www.kshb.com\/news\/local-news\/in-city-already-filled-with-detention-centers-potential-ice-facility-worries-leavenworth-residents\" class=\"\">Nearby residents<\/a>&nbsp;are up in arms, hoping to prevent the site, previously closed due to egregious&nbsp;<a href=\"https:\/\/www.aclukansas.org\/en\/publications\/we-cannot-trust-corecivic-keep-anyone-safe-leavenworth-or-anywhere-else\" class=\"\">human rights violations<\/a>, from being reopened. I recently made a trip to see it and was horrified by the thought of hundreds, if not thousands, of undocumented families being herded there like the cattle who graze across the street.<\/p>\n\n\n\n<p>Of course, any of these Guantanamos could also potentially be used to detain U.S. citizens now that Trump is testing the waters on stripping U.S. citizens of citizenship. Vice President JD Vance has suggested that should the courts rule against the president on terminating birthright citizenship,&nbsp;<a href=\"https:\/\/www.sfchronicle.com\/news\/politics\/article\/vance-and-musk-question-the-authority-of-the-20157373.php\" class=\"\">Dear Leader could simply ignore the order<\/a>.<\/p>\n\n\n\n<p>\u201cBut what about civil disobedience?\u201d you might ask. \u201cYou can\u2019t just turn America into North Korea overnight!\u201d<\/p>\n\n\n\n<p>The only thing that stopped Trump the last time he ordered the military to open fire on American protesters (\u201cCan\u2019t you just shoot them? Just shoot them in the legs or something?\u201d) was the refusal by his then-defense secretary and top general to carry out his order.&nbsp;<\/p>\n\n\n\n<p>Fast forward four years, and the&nbsp;<a href=\"https:\/\/www.linkedin.com\/in\/dan-caine\/\" class=\"\">venture&nbsp;capitalist<\/a>&nbsp;slated to be our&nbsp;<a href=\"https:\/\/apnews.com\/article\/trump-joint-chiefs-chairman-razin-caine-military-41b3faeaefd4d965dc22b15b0223ec58\" class=\"\">next top general<\/a>&nbsp;is a Conservative Political Action Conference darling who Trump claims was wearing a MAGA hat when the two met previously in Iraq.<\/p>\n\n\n\n<p>Other vacancies waiting to be filled are the top uniformed lawyers for the Army, Navy and Air Force \u2014 the three-star generals responsible for reviewing orders from the commander-in-chief and defense secretary, to decide whether they\u2019re legal. Seeking to remove any doubt as to why the previous officers were being removed, Secretary of Defense Pete Hegseth recently explained that the action was taken, preemptively, to prevent them from&nbsp;<a href=\"https:\/\/www.newsmax.com\/newsfront\/hegseth-jag-fired\/2025\/02\/24\/id\/1200325\/\" class=\"\">blocking \u201corders that are given by a commander in chief.\u201d<\/a><\/p>\n\n\n\n<p>Thanks for saying the quiet part out loud.
