The documents were found in his lunch box and basement, an FBI affidavit said.<\/p>\n\n\n\n<p><em>Politico<\/em>\u00a0senior legal affairs reporter Kyle Cheney noted that the criminal\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.597299\/gov.uscourts.mdd.597299.1.1.pdf\" target=\"_blank\">complaint<\/a>\u00a0regarding Perez-Lugones\u2019 case does not mention allegations that he gave any classified documents to a reporter.<\/p>\n\n\n\n<p><a href=\"https:\/\/x.com\/kyledcheney\/status\/2011446143666806852?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E2011446143666806852%7Ctwgr%5Ecee6535591dad8d408f159513c187e6ef7b385d1%7Ctwcon%5Es1_c10&amp;ref_url=https%3A%2F%2Fwww.commondreams.org%2Fnews%2Ffbi-journalist\">https:\/\/x.com\/kyledcheney\/status\/2011446143666806852?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E2011446143666806852%7Ctwgr%5Ecee6535591dad8d408f159513c187e6ef7b385d1%7Ctwcon%5Es1_c10&amp;ref_url=https%3A%2F%2Fwww.commondreams.org%2Fnews%2Ffbi-journalist<\/a><\/p>\n\n\n\n<p>\u201cThe FBI\u2019s search and seizure of a journalist\u2019s personal and professional devices appears to be a serious violation of press freedom and underscores why we need to enact greater federal protections for both journalists and their sources,\u201d said Clayton Weimers, executive director of Reporters Without Borders North America. \u201cAttorney General&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/pam-bondi\">Pam Bondi<\/a>&nbsp;confirmed the seizure is linked to an investigation into a federal contractor who is alleged to have leaked classified information. It\u2019s worth reiterating, though we shouldn\u2019t have to, that journalists have a constitutionally protected right to publish government secrets. We call for the FBI to immediately return Hannah Natanson\u2019s devices.\u201d<\/p>\n\n\n\n<p>Jameel Jaffer, director of the Knight First Amendment Institute at&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/columbia-university\">Columbia University<\/a>,&nbsp;<a href=\"https:\/\/www.nytimes.com\/2026\/01\/14\/us\/politics\/fbi-washington-post-journalist.html\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a>&nbsp;the&nbsp;<em><a href=\"https:\/\/www.commondreams.org\/tag\/new-york-times\">New York Times<\/a>&nbsp;<\/em>that the FBI search at Natanson\u2019s home was \u201cintensely concerning\u201d and could chill \u201clegitimate journalistic activity.\u201d<\/p>\n\n\n\n<p>\u201cThere are important limits on the government\u2019s authority to carry out searches that implicate First Amendment activity,\u201d Jaffer said.<\/p>\n\n\n\n<p>As the Committee to Protect Journalists&nbsp;<a href=\"https:\/\/cpj.org\/2024\/07\/guide-to-legal-rights-in-the-u-s-2\/#Fourth-Amendment-protections-of-journalists\" target=\"_blank\" rel=\"noreferrer noopener\">notes<\/a>&nbsp;in a guide to reporters\u2019 legal rights, the&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/privacy\">Privacy<\/a>&nbsp;Protection Act of 1980 established high standards for searches and seizures of journalists\u2019 materials that are \u201creasonably believed to be related to media intended for dissemination to the public\u2014including \u2018work product materials\u2019 (e.g., notes or voice memos containing mental impressions, conclusions, opinions, etc. of the person who prepared such materials) and \u2018documentary materials\u2019 (e.g., video tapes, audio tapes, photographs, and anything else physically documenting an event).\u201d<\/p>\n\n\n\n<p>\u201cThese materials generally cannot be searched or seized unless they are reasonably believed to relate to a crime committed by the person possessing the materials,\u201d reads the guide. \u201cThey may, however, be held for custodial storage incident to an arrest of the journalist possessing the materials, so long as the material is not searched and is returned to the arrestee intact.\u201d<\/p>\n\n\n\n<p>Last year, the&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/us-department-of-justice\">US Department of Justice<\/a>&nbsp;(DOJ) ended a Biden-era policy that limited its ability to search or subpoena a reporter\u2019s data as part of investigations into leaks.<\/p>\n\n\n\n<p>Attorney General Pam Bondi said the DOJ \u201cwill not tolerate unauthorized disclosures that undermine President Trump\u2019s policies, victimize government agencies, and cause harm to the American people.\u201d<\/p>\n\n\n\n<p>Before becoming FBI director, Kash Patel&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/kash-patel-fbi\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;in 2023 that should Trump return to the&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/white-house\">White House<\/a>, his administration would \u201ccome after people in the media\u201d in efforts to target the president\u2019s enemies.<\/p>\n\n\n\n<p>The&nbsp;<em>Post<\/em>&nbsp;reported Wednesday that \u201cwhile it is not unusual for FBI agents to conduct leak investigations around reporters who publish sensitive government information, it is highly unusual and aggressive for law enforcement to conduct a search on a reporter\u2019s home.\u201d<\/p>\n\n\n\n<p>Natanson has spent much of Trump\u2019s second term thus far covering his efforts to fire federal employees, tens of thousands of whom have been dismissed as the president seeks to ensure the entire government workforce is pushing forward his&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/right-wing\">right-wing<\/a>&nbsp;agenda.<\/p>\n\n\n\n<p>She wrote an&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/politics\/2025\/12\/24\/trump-federal-government-workers\/\" target=\"_blank\" rel=\"noreferrer noopener\">essay<\/a>&nbsp;last month for the&nbsp;<em>Post<\/em>&nbsp;in which she described being inundated with messages over the past year from more than 1,000 federal employees who wanted to tell her \u201chow President&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/donald-trump\">Donald Trump<\/a>&nbsp;was rewriting their workplace policies, firing their colleagues, or transforming their agency\u2019s missions.\u201d She has&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/investigations\/2025\/05\/20\/federal-workers-trump-mental-health\/\" target=\"_blank\" rel=\"noreferrer noopener\">written<\/a>&nbsp;about the toll the mass firings have had on&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/workers\">workers<\/a>\u2019 mental health.<\/p>\n\n\n\n<p>Bruce D. Brown, president of the Reporters Committee for Freedom of the Press,&nbsp;<a href=\"https:\/\/www.rcfp.org\/fbi-search-washington-post-statement\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;in a statement that \u201cphysical searches of reporters\u2019 devices, homes, and belongings are some of the most invasive investigative steps law enforcement can take.\u201d<\/p>\n\n\n\n<p>\u201cThere are specific federal laws and policies at the\u00a0<a href=\"https:\/\/www.commondreams.org\/tag\/department-of-justice\">Department of Justice<\/a>\u00a0that are meant to limit searches to the most extreme cases because they endanger confidential sources far beyond just one investigation and impair public interest reporting in general,\u201d said Brown. \u201cWhile we won\u2019t know the government\u2019s arguments about overcoming these very steep hurdles until the affidavit is made public, this is a tremendous escalation in the administration\u2019s intrusions into the independence of the press.\u201d<\/p>\n\n\n\n<p>Our work is licensed under Creative Commons (CC BY-NC-ND 3.0).
