Pretti was an ICU nurse at a Veterans Affairs hospital and legally&nbsp;<a href=\"https:\/\/www.fox9.com\/news\/minneapolis-shooting-dhs-has-claimed-its-unlawful-protesters-carry-guneven-legal-permit#:~:text=Pretti%20had%20a%20permit%20to,firearm%2C%20according%20to%20Minneapolis%20police\" rel=\"noreferrer noopener\" target=\"_blank\">carrying a Sig Sauer pistol<\/a>. Bystander video shows him filming agents with a phone before being tackled and pinned facedown on the pavement as more than six officers swarm him. According to<a href=\"https:\/\/www.cnn.com\/2026\/01\/25\/us\/shooting-minneapolis-alex-pretti-killed\" rel=\"noreferrer noopener\" target=\"_blank\">&nbsp;video&nbsp;<\/a>of the shooting, at least one officer can be heard shouting \u201che\u2019s got a gun,\u201d and an agent appears to take Pretti\u2019s weapon and begin to walk away before<a href=\"https:\/\/www.cnn.com\/2026\/01\/25\/us\/shooting-minneapolis-alex-pretti-killed\" rel=\"noreferrer noopener\" target=\"_blank\"><\/a>&nbsp;at least 10 shots ring out. Minneapolis Police Chief Brian O\u2019Hara said in a press conference that Pretti was \u201ca lawful gun owner with a permit to carry.\u201d Federal officials initially defended the shooting as&nbsp;<a href=\"https:\/\/mndaily.com\/city\/dhs-alleges-shooting-victim-was-killed-in-self-defense-in-press-conference\/01\/24\/2026\/\" rel=\"noreferrer noopener\" target=\"_blank\">self-defense,<\/a>&nbsp;insisting Pretti had resisted disarmament and threatened agents. But&nbsp;<a href=\"https:\/\/bsky.app\/profile\/bellingcat.com\/post\/3md6vleoxks2t\" rel=\"noreferrer noopener\" target=\"_blank\">open-source analysis<\/a>&nbsp;by Bellingcat concluded the gun had already been taken from Pretti by the time the shots were fired.&nbsp;<\/p>\n\n\n\n<p>Already, much has been made by the administration over the fact that Pretti was armed, a startling legal shift for officials who publicly espouse their love of the Second Amendment.&nbsp;<\/p>\n\n\n\n<p>The Trump Justice Department has now formally embraced the idea that a citizen carrying a legal firearm who approaches federal officers can be shot on sight. First Assistant U.S. Attorney Bill Essayli \u2014&nbsp;<a href=\"https:\/\/theintercept.com\/2025\/06\/24\/trump-bill-essayli-la-protests-ice\/\">a Trump appointee<\/a>&nbsp;\u2014 put this new doctrine&nbsp;<a href=\"https:\/\/x.com\/usattyessayli\/status\/2015121052201087371?s=46&amp;t=9aZA5r-o39IacIMmVWg_7Q\" rel=\"noreferrer noopener\" target=\"_blank\">bluntly<\/a>: \u201cIf you approach law enforcement with a gun, there is a high likelihood they will be legally justified in shooting you.\u201d In effect, the president who demanded absolute loyalty from gun rights voters is sanctioning deadly force against those voters whenever they come near a line of federal officers. This pronouncement came just hours after Pretti\u2019s killing, turning a local tragedy into a national declaration of policy. Expect a Bullet<\/strong>.<\/h2>\n\n\n\n<p>Essayli\u2019s declaration sent shockwaves through America\u2019s gun community, and leaders of pro-gun groups immediately distanced themselves from the White House line. (On&nbsp;<a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/115951636521315703\" rel=\"noreferrer noopener\" target=\"_blank\">Truth Social<\/a>, Trump posted a photo of the gun, writing, \u201cThis is the gunman\u2019s gun, loaded (with two additional full magazines!), and ready to go \u2013 What is that all about?\u201d Less than 24 hours later, Trump had seemingly moved on,&nbsp;<a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/115956692372915783\" rel=\"noreferrer noopener\" target=\"_blank\">posting<\/a>&nbsp;about construction on the White House ballroom.) Dana Loesch, a former spokesperson for the National Rifle Association and a conservative radio host, questioned the administration\u2019s contention that Pretti had two loaded magazines as evidence he intended to harm immigration agents: \u201cWhat he has or didn\u2019t have isn\u2019t the issue. What he was doing, with or without it, is the issue.\u201d<\/p>\n\n\n\n<p>By the end of the day, the NRA \u2014 historically among Trump\u2019s biggest<a href=\"https:\/\/www.thetrace.org\/2020\/08\/nra-2020-election-spending-trump\/\" rel=\"noreferrer noopener\" target=\"_blank\">&nbsp;backers<\/a>&nbsp;\u2014 had finally issued a&nbsp;<a href=\"https:\/\/x.com\/NRA\/status\/2015227627464728661\" rel=\"noreferrer noopener\" target=\"_blank\">lukewarm call<\/a>&nbsp;for calm and due process and called Essayli\u2019s remarks \u201cdangerous and wrong,\u201d but only after its social media followers&nbsp;<a href=\"https:\/\/x.com\/nra\/status\/2015122503543513521?s=46&amp;t=9aZA5r-o39IacIMmVWg_7Q\" rel=\"noreferrer noopener\" target=\"_blank\">lambasted the group<\/a>&nbsp;for inexplicably staying silent at first. Remember: the NRA funneled<a href=\"https:\/\/www.huffpost.com\/entry\/nra-trump-campaign-illegally-coordinate-ads-says-fec-complaint_n_5c0b2798e4b035a7bf5b46fb\" rel=\"noreferrer noopener\" target=\"_blank\">&nbsp;some $25\u202fmillion&nbsp;<\/a>into Trump\u2019s campaigns. For gun owners who gave Trump everything, the silence was deafening.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>For gun owners who gave Trump everything, the silence was deafening.<\/p>\n<\/blockquote>\n\n\n\n<p>The conservative advocacy group Gun Owners of America&nbsp;<a href=\"https:\/\/x.com\/gunowners\/status\/2015178191715893725?s=46&amp;t=9aZA5r-o39IacIMmVWg_7Q\" rel=\"noreferrer noopener\" target=\"_blank\">called<\/a>&nbsp;for a \u201ccomplete, transparent, and prompt investigation\u201d and flatly rejected the idea that federal agents can justifiably shoot and kill legal gun owners. In a statement responding to Essayli, GOA warned \u201cagents are not \u2018highly likely\u2019 to be \u2018legally justified\u2019 in \u2018shooting\u2019 concealed carry licensees who approach while lawfully carrying a firearm.\u201d&nbsp;<\/p>\n\n\n\n<p>On the ground in Minnesota, gun rights advocates were outraged. The Minnesota Gun Owners Caucus&nbsp;<a href=\"https:\/\/x.com\/mnguncaucus\/status\/2015163744884490588?s=46&amp;t=9aZA5r-o39IacIMmVWg_7Q\" rel=\"noreferrer noopener\" target=\"_blank\">demanded evidence<\/a>&nbsp;that Pretti posed any real threat, and insisted that every lawful citizen has the right to carry arms \u2014 even in a protest. Its general counsel, Rob Doar, told&nbsp;<a href=\"https:\/\/kstp.com\/kstp-news\/top-news\/was-alex-pretti-disarmed-before-he-was-shot-a-closer-look-at-the-deadly-shooting\/\" rel=\"noreferrer noopener\" target=\"_blank\">local news station KSTP<\/a>&nbsp;that officers \u201chave to have been in reasonable fear of imminent death or great bodily harm\u201d to use deadly force and his read based on the video is \u201cthat at the time that the shots were fired he had been disarmed seconds before.\u201d Rick Hodsdon, an expert on permit to carry laws in the state, put an&nbsp;<a href=\"https:\/\/www.fox9.com\/news\/minneapolis-shooting-dhs-has-claimed-its-unlawful-protesters-carry-guneven-legal-permit\" rel=\"noreferrer noopener\" target=\"_blank\">even finer point on the issue<\/a>: The idea that any citizen approaching armed agents with a legal gun should be shot is \u201cabsurd.\u201d&nbsp;<\/p>\n\n\n\n<p>Other vocal critics rebuked Border Patrol statements implying that Pretti was armed to the teeth, and aiming, as official Greg Bovino claimed, to do \u201c<a href=\"https:\/\/x.com\/disclosetv\/status\/2015146927956918662\" rel=\"noreferrer noopener\" target=\"_blank\">maximum damage and massacre law enforcement<\/a>.\u201d Veteran gun rights commentator Stephen Gutowski reminded followers that carrying extra magazines is&nbsp;<a href=\"https:\/\/x.com\/stephengutowski\/status\/2015169499670938023?s=46&amp;t=9aZA5r-o39IacIMmVWg_7Q\" rel=\"noreferrer noopener\" target=\"_blank\">common&nbsp;<\/a>for permit holders. Others pointed out that this new paradigm risks transforming routine encounters with public safety officials into moments of terror for lawful gun owners. Kostas Moros, director of legal research and education for the Second Amendment Foundation,&nbsp;<a href=\"https:\/\/thereload.com\/several-gun-rights-groups-call-for-investigation-into-ice-killing-of-ccw-permittee\/\" rel=\"noreferrer noopener\" target=\"_blank\">told The Reload<\/a>, \u201cPeople should not fear interacting with police officers simply because they are lawfully carrying a firearm.\u201d&nbsp;<\/p>\n\n\n\n<p>For many Second Amendment stalwarts, the Trump administration\u2019s new stance is the ultimate betrayal. The man who vowed never to infringe on gun rights is now sanctioning lethal force against his own voters.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-thou-shalt-infringe\"><strong>Thou Shalt Infringe<\/strong><\/h2>\n\n\n\n<p>The Pretti killing and its official defense expose a wider hypocrisy in Trump\u2019s approach to gun rights, despite his rhetoric. While Trump once praised Kyle Rittenhouse \u2014 the armed teenager who killed two people at a protest in Wisconsin \u2014 as \u201c<a href=\"https:\/\/www.theguardian.com\/us-news\/2021\/nov\/24\/donald-trump-kyle-rittenhouse-really-a-nice-young-man-after-visit\" rel=\"noreferrer noopener\" target=\"_blank\">really a nice young man<\/a>\u201d who never deserved to go to trial, he has, throughout his career, quietly supported more gun safety measures than he admits.<\/p>\n\n\n\n<p>During his first term, he casually let it slip that he was&nbsp;<a href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/no-constitutional-authority-feds-confiscate-guns-without-due-process\" rel=\"noreferrer noopener\" target=\"_blank\">fine with taking guns without due process<\/a>&nbsp;before backtracking. During his first administration, he also famously signed a rule&nbsp;<a href=\"https:\/\/www.justice.gov\/archives\/opa\/pr\/department-justice-announces-bump-stock-type-devices-final-rule\" rel=\"noreferrer noopener\" target=\"_blank\">banning bump-fire stocks<\/a>&nbsp;(devices that simulated fully automatic fire) after the&nbsp;<a href=\"https:\/\/theintercept.com\/2017\/10\/04\/intercepted-podcast-guns-before-country\/\">2017 Las Vegas massacre<\/a>, a rule that was later&nbsp;<a href=\"https:\/\/www.npr.org\/2024\/06\/14\/g-s1-2929\/supreme-court-bump-stocks\" rel=\"noreferrer noopener\" target=\"_blank\">struck down<\/a>&nbsp;by the Supreme Court. Just last year, that same court \u2014 which is dominated by Trump appointees \u2014 upheld a sweeping new&nbsp;<a href=\"https:\/\/www.reuters.com\/legal\/us-supreme-court-upholds-federal-ghost-guns-restrictions-2025-03-26\/#:~:text=March%2026%20%28Reuters%29%20,with%20a%201968%20federal%20law\" rel=\"noreferrer noopener\" target=\"_blank\">Joe Biden-era rule<\/a>&nbsp;restricting untraceable \u201cghost guns,\u201d rejecting challenges by gun rights groups.<\/p>\n\n\n\n<p>Meanwhile, Trump has increasingly deployed federal forces into jurisdictions with some of the strictest gun-control laws in the country, using federal authority to lean into those regulations \u2014 despite promising to protect gun owners from government overreach. In August 2025, federal agents embedded with local police in Washington, D.C., and seized 111 firearms as part of Trump\u2019s federal surge in the district to combat \u201ccrime.\u201d For gun rights advocates, the operation exposed the quiet inversion underway: Federal agents can now treat gun ownership as a novel way to target, harass, and enforce their authority in ways that have little to do with any actual crime. Luis Valdes, a spokesperson for Gun Owners of America,&nbsp;<a href=\"https:\/\/www.13newsnow.com\/article\/news\/crime\/federal-surge-in-dc-seizes-111-guns-long-term-impacts\/65-8042f448-0429-4dc8-becc-275782a11b22\" rel=\"noreferrer noopener\" target=\"_blank\">said at the time<\/a>&nbsp;that these seizures amounted to low-hanging fruit. \u201cCharging [citizens] only for possession of a firearm means they couldn\u2019t even establish reasonable suspicion or probable cause for any other crime,\u201d he said. \u201cWe\u2019re not against law enforcement going out there and going after real criminals. We\u2019re just against law enforcement resources being mis-utilized, and having those resources used to violate people\u2019s due process and Second Amendment rights.\u201d<\/p>\n\n\n\n<p>From&nbsp;<a href=\"https:\/\/www.themarshallproject.org\/2025\/11\/04\/national-guard-trump-ice-crime-chicago\" rel=\"noreferrer noopener\" target=\"_blank\">Chicago<\/a>&nbsp;to&nbsp;<a href=\"https:\/\/calmatters.org\/justice\/2025\/12\/immigration-2025-year-in-review\/\" rel=\"noreferrer noopener\" target=\"_blank\">Los Angeles<\/a>, these federal \u201csurges\u201d have meant heavily armed federal agents roaming neighborhoods looking to scoop up American firearms along the way \u2014 hardly a symbol of Second Amendment liberation. At the same time, the Justice Department has quietly pursued policies that make life harder for gun owners, not easier. While Trump\u2019s February 2025 executive order on firearms directed the DOJ to review Biden-era regulations, many of his more expansive campaign promises remain outstanding, leaving little evidence that his administration has meaningfully expanded ordinary Americans\u2019 access to firearms.<\/p>\n\n\n\n<p>Trump\u2019s so-called \u201cBig Beautiful Bill,\u201d for instance,&nbsp;<a href=\"https:\/\/silencerco.com\/blog\/no-more-200-tax-stamps-for-suppressors\" rel=\"noreferrer noopener\" target=\"_blank\">made it cheaper<\/a>&nbsp;to purchase suppressors and short-barreled weapons but not easier \u2014 keeping buyers locked behind the same federal regulatory regime his campaign&nbsp;<a href=\"https:\/\/www.nssf.org\/articles\/former-president-trumps-pick-of-u-s-sen-j-d-vance-a-solid-second-amendment-choice\/\" rel=\"noreferrer noopener\" target=\"_blank\">promised to dismantle<\/a>. In response, major gun rights groups have moved to mount new&nbsp;<a href=\"https:\/\/www.guns.com\/news\/2025\/08\/04\/pro-2a-groups-team-up-to-challenge-nfa\" rel=\"noreferrer noopener\" target=\"_blank\">legal challenges against Trump\u2019s ATF<\/a>&nbsp;to eliminate outstanding red tape. And despite early promises to enact national concealed-carry reciprocity \u2014 a policy that would require every state to recognize gun permits issued by other states, much like driver\u2019s licenses \u2014 that reform has&nbsp;<a href=\"https:\/\/protectwithbear.com\/blogs\/news\/trumps-national-concealed-carry-reciprocity-proposal?srsltid=AfmBOorXd_gsZfbOoLcS_oy0yEF5uKIntTl3kBuFIb8DjeTA0U8noyEX\" rel=\"noreferrer noopener\" target=\"_blank\">yet to materialize<\/a>.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Under Trump, gun rights have increasingly been filtered through federal power, not individual freedom.<\/p>\n<\/blockquote>\n\n\n\n<p>It is also worth noting who Trump is in this equation:&nbsp;<a href=\"https:\/\/abcnews.go.com\/US\/secret-service-agents-suspended-conduct-attempted-trump-assassination\/story?id=123628351\" rel=\"noreferrer noopener\" target=\"_blank\">a gun-violence survivor<\/a>, raised in one of the most restrictive&nbsp;<a href=\"https:\/\/worldpopulationreview.com\/state-rankings\/strictest-gun-laws-by-state\" rel=\"noreferrer noopener\" target=\"_blank\">gun safety environments in the country<\/a>, who publicly champions the gun industry but now governs a&nbsp;<a href=\"https:\/\/www.nssf.org\/articles\/update-make-that-26-million-new-first-time-gun-owners-since-2020\/\" rel=\"noreferrer noopener\" target=\"_blank\">far more heavily armed nation<\/a>&nbsp;from behind layers of federal security. In Trump\u2019s America, the question is no longer whether guns should exist, but whether the government still views the people who legally carry them as legitimate.<\/p>\n\n\n\n<p>The bottom line is harder to ignore: Under Trump, gun rights have increasingly been filtered through federal power, not individual freedom. Now, after a second fatal shooting by federal immigration authorities in Minneapolis in as many weeks, his administration is crystallizing this shift as de facto policy: If an American simply owns a gun in front of feds, the use of \u201cdeadly force\u201d is not just permitted but justified. And now that the&nbsp;<a href=\"https:\/\/www.nytimes.com\/article\/trump-national-guard-military-cities.html\" rel=\"noreferrer noopener\" target=\"_blank\">feds are everywhere<\/a>, the implications for an armed citizenry are chilling.&nbsp;<\/p>\n\n\n\n<p>All of this flies in the face of Trump\u2019s campaign promises of a Second Amendment utopia. The millions the NRA and pro-gun political action committees funneled into electing him have bought little more than cold comfort. Gun rights groups can protest and litigate but the precedent is now set: Under this administration, trained federal officers can, on executive authority alone, treat legally armed citizens \u2014 protesters or otherwise \u2014 as legitimate targets. The president who promised not to take away Americans\u2019 guns has effectively signed off on taking away any safety those guns once provided.
