Please support this work if you can as a paying member for as low as $5 bucks a mont<\/strong>h.<\/p>\n<\/blockquote>\n\n\n\n<p><a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/80e76a3e-f914-4fea-887e-b999e4fbea6b?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">SUPPORT ON THE GROUND REPORTING<\/a><\/p>\n\n\n\n<p>In what one criminal defense attorney told NBC News is a a \u201cmassive win\u201d for Luigi Mangione, the alleged killer of United Healthcare CEO Brian Thompson, NY State Judge Gregory Carro ruled key evidence found in his backpack in Altoona, Pennsylvania in December 2024 inadmissible in his upcoming September state of New York criminal trial.<\/p>\n\n\n\n<p>Carro called the search of Mangione at an Altoona McDonald\u2019s an \u201cimproper warrantless search\u201d and ruled the following items blocked from being used at trial:<\/p>\n\n\n\n<ul>\n<li>Gun magazine<\/li>\n\n\n\n<li>Cell phone<\/li>\n\n\n\n<li>Wallet<\/li>\n\n\n\n<li>Passport<\/li>\n\n\n\n<li>Computer chip<\/li>\n\n\n\n<li>Certain statements Mangione made to Altoona police<\/li>\n<\/ul>\n\n\n\n<p>\u201cEven a partial win here is a massive win for the defense,\u201d criminal defense attorney Danny Cevallos told NBC News about the ruling.<\/p>\n\n\n\n<p><a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/app-link\/post?publication_id=10151&amp;post_id=198292057&amp;utm_source=substack&amp;utm_medium=email&amp;utm_content=share&amp;utm_campaign=email-share&amp;action=share&amp;triggerShare=true&amp;isFreemail=true&amp;r=e0iq&amp;token=eyJ1c2VyX2lkIjo2NTM4NTgsInBvc3RfaWQiOjE5ODI5MjA1NywiaWF0IjoxNzc5MTI3OTk3LCJleHAiOjE3ODE3MTk5OTcsImlzcyI6InB1Yi0xMDE1MSIsInN1YiI6InBvc3QtcmVhY3Rpb24ifQ.FguzflDzELxHxPn--FaM08F1nocnMIHm6mg7oVWazrw\">Share<\/a><\/p>\n\n\n\n<p>Despite the partial favorable ruling for Mangione, the Judge did rule that other key evidence could be used at trial\u2014namely the gun Mangione allegedly used and a notebook prosecutors have described as Mangione\u2019s so-called \u201cmanifesto.\u201d<\/p>\n\n\n\n<p>As I point out in the above video, the fact that the Judge ruled the police search of Mangione\u2019s backpack improper and warrantless is significant for Mangione\u2019s defense in two ways; first, it could persuade one juror out of 12\u2014all the defense needs\u2014that Mangione was railroaded and his rights were violated. Second, if Mangione is convicted in the state of NY trial, the Judge\u2019s words can be one building block of a strong appeal.<\/p>\n\n\n\n<p>Mangione\u2019s NY state trial is scheduled to begin in September; his federal trial will follow soon after in October.<\/p>\n\n\n\n<p>Status Coup would love to cover both cases on a daily basis ON THE GROUND in NYC\u2014but need more financial support to afford to do so.
