Thomas Gross, was sentenced to 100 years for attempted murder of a law enforcement officer and lesser offenses, including discharging a firearm during a violent crime, conspiracy to use and using an explosive, and rioting. Song, a former US Marine, contends that he shot Gross in self-defense after the officer drew his gun first.<\/p>\n\n\n\n<p>The \u201cexplosives\u201d in question were fireworks brought to the July 4 protest to show&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/solidarity\">solidarity<\/a>&nbsp;with people detained by ICE.<\/p>\n\n\n\n<p>Savanna Batten, Zachary Evetts, Autumn Hill, Bradford Morris, and Elizabeth Soto got 50 years each for rioting, providing material support to terrorists, and conspiracy to use and using an explosive.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>No paywall. Those documents were leftist pamphlets protected by the&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/first-amendment\">First Amendment<\/a>.<\/p>\n\n\n\n<p>Rueda\u2019s husband, Daniel \u201cDes\u201d Rolando Sanchez Estrada, was hit with a 30-year prison sentence for conspiracy to conceal documents for moving a box full of the pamphlets after speaking with his wife. He did not attend the protest.<\/p>\n\n\n\n<p>Judge Reed O\u2019Connor, an appointee of former President&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/george-w-bush\">George W. Bush<\/a>&nbsp;and a&nbsp;<a href=\"https:\/\/www.texastribune.org\/2018\/12\/19\/reed-oconnor-federal-judge-texas-obamacare-forum-shopping-ken-paxton\/\" target=\"_blank\" rel=\"noreferrer noopener\">favorite<\/a>&nbsp;of&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/right-wing\">right-wing<\/a>&nbsp;judge shoppers, told the court that the lengthy sentences are meant to \u201csend a message to anyone who shares a similar ideology\u201d with the defendants,&nbsp;<a href=\"https:\/\/www.the-independent.com\/news\/world\/americas\/us-politics\/antifa-prairieland-ice-protest-prison-sentences-b3001526.html\" rel=\"noreferrer noopener\" target=\"_blank\">according to<\/a>&nbsp;one observer of Tuesday\u2019s proceedings.<\/p>\n\n\n\n<p>The Prairieland sentences were&nbsp;<a href=\"https:\/\/www.ussc.gov\/about\/annual-report-2024\" rel=\"noreferrer noopener\" target=\"_blank\">more severe<\/a>&nbsp;than the longest prison term for the average US murderer or rapist, as well as for the&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/january-6\">January 6<\/a>, 2021 Capitol insurrectionists\u2014all of whom were later&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/jan-6-pardons\">pardoned<\/a>&nbsp;by President Donald Trump\u2014as well as for convicted child sex trafficker and Jeffrey Epstein co-conspirator Ghislaine Maxwell.<\/p>\n\n\n\n<p>\u201cWhat happened on Tuesday, it\u2019s shocking to all of us, devastating to the families, 50- to 100-year sentences,\u201d Sufia Khalid, deputy director of the National Security Criminal Defense Center at the Muslim Legal Fund of America and lawyer to one of the Prairieland defendants,\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.democracynow.org\/2026\/6\/25\/prairieland_nine\" target=\"_blank\">told<\/a>\u00a0<a href=\"https:\/\/www.commondreams.org\/tag\/democracy\">Democracy<\/a>\u00a0Now! on Thursday. \u201cThose are essentially life sentences for all of the young people in this case, largely of whom were engaged in nonviolent protest at an ICE detention facility.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-x wp-block-embed-x\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">A group of anti-ICE protesters in Texas were sentenced to 30 to 100 years in jail on Tuesday, after federal prosecutors accused them of being an &quot;antifa terror cell.&quot;<br><br>The activists attended a protest and noise demonstration outside the Prairieland ICE jail in Alvarado, Texas.\u2026 <a href=\"https:\/\/t.co\/QxFMPaGsvj\">pic.twitter.com\/QxFMPaGsvj<\/a><\/p>&mdash; Democracy Now! (@democracynow) <a href=\"https:\/\/x.com\/democracynow\/status\/2070167233037221986?ref_src=twsrc%5Etfw\">June 25, 2026<\/a><\/blockquote><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>Khalid noted that the&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/department-of-justice\">Department of Justice<\/a>&nbsp;(DOJ) invoked a rarely used \u201cmaterial support for terrorism\u201d statute that \u201cdoes not require any connection to a domestic terrorist organization or any kind.\u201d<\/p>\n\n\n\n<p>\u201cAny American can be targeted that way now. It does not require ties to antifa or to any domestic terrorist organization,\u201d she said. \u201cThat\u2019s a dangerous precedent, and what allowed them to stack these charges so high on Tuesday.\u201d<\/p>\n\n\n\n<p>The DOJ hailed \u201cthe first sentencing of defendants affiliated with antifa following&#8230; Trump\u2019s&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/09\/designating-antifa-as-a-domestic-terrorist-organization\/\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a>&nbsp;designating the group as a domestic terrorist organization in September 2025\u201d in the wake of the assassination of white supremacist influencer Charlie Kirk\u2014which had nothing to do with antifa, a decentralized and leaderless international ideology opposing&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/fascism\">fascism<\/a>&nbsp;that\u2019s more of a mindset than a movement.<\/p>\n\n\n\n<p>Later that month, Trump also&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/trump-war-on-critics\" target=\"_blank\" rel=\"noreferrer noopener\">signed<\/a>&nbsp;National Security Presidential Memorandum 7 (NSPM-7), a&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/09\/countering-domestic-terrorism-and-organized-political-violence\/\" target=\"_blank\" rel=\"noreferrer noopener\">directive<\/a>&nbsp;titled \u201cCountering Domestic Terrorism and Organized Political Violence,\u201d that focuses exclusively on left-wing activities and mandates a \u201cnational strategy to investigate and disrupt networks, entities, and organizations that foment political violence so that law enforcement can intervene in criminal conspiracies before they result in violent political acts.\u201d<\/p>\n\n\n\n<p>Khalid pointed to the pardoned&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/january-6\">January 6<\/a>&nbsp;insurrectionists, who \u201cwere involved in rioting, carrying massive arsenals of weapons, lots of discussions ahead of time\u2014that didn\u2019t exist in this case\u2014about targeting law enforcement, wanting to kill members of Congress, [and] actually storming the Capitol.\u201d<\/p>\n\n\n\n<p>\u201cSo, we have a massive, unwarranted sentencing disparity here,\u201d she said. \u201cWhat happened in the court in Fort Worth was unconstitutional and should concern everybody in this country in the direction that it is taking us.\u201d<\/p>\n\n\n\n<p>Mark Osler, a law professor and sentencing expert at the University of St. Thomas in Minneapolis,&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jun\/26\/texas-protesters-anti-ice-convictions\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a>&nbsp;The Guardian on Friday that \u201cthe 30-year sentence for Estrada is probably the one that for most people will come closest to shocking the conscience, simply because this is an activity that took place after the harm occurred.\u201d<\/p>\n\n\n\n<p>\u201cWhat happened in the court in Fort Worth was unconstitutional and should concern everybody in this country in the direction that it is taking us.\u201d<\/p>\n\n\n\n<p>Seth Stern, chief of advocacy at the Freedom of the Press Foundation, underscored during a Friday&nbsp;<a href=\"https:\/\/fair.org\/home\/seth-stern-on-criminalizing-dissent\/\" target=\"_blank\" rel=\"noreferrer noopener\">interview<\/a>&nbsp;in an episode of Fairness and Accuracy in Reporting\u2019s&nbsp;<em>Counterspin<\/em>&nbsp;podcast titled \u201cCriminalizing Dissent\u201d that Estrada \u201cwasn\u2019t even at the protest.\u201d<\/p>\n\n\n\n<p>\u201cHe\u2019s somebody who allegedly transported a box of pamphlets because his wife was at the protest,\u201d Stern said. \u201cAnd he believed, according to prosecutors, that the box of pamphlets might implicate his wife&#8230; so he was concealing evidence.\u201d<\/p>\n\n\n\n<p>\u201cEvidence of what?\u201d he continued. \u201cThis wasn\u2019t a how-to manual&#8230; They were zines. They said nothing about this protest, about the Prairieland detention facility, about shooting this police officer&#8230; So when they say that he concealed evidence by moving these zines, evidence of what? It\u2019s evidence of an ideology. It\u2019s evidence of somebody\u2019s reading habits.\u201d<\/p>\n\n\n\n<p>\u201cAnd now they\u2019re on the same plane as terrorists, as [Islamic State], according to this administration,\u201d Stern added. \u201cIt\u2019s all pretty absurd. But at the end of the day, we have a Constitution that prohibits people from being locked up for what they think, write, or read, as long as they are not inciting imminent violence. So hopefully the appellate courts will reverse these convictions. But the law is only as good as the people who enforce it.\u201d<\/p>\n\n\n\n<p><a href=\"https:\/\/freedom.press\/people\/jeremy-busby\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jeremy Busby<\/a>, an incarcerated journalist,&nbsp;<a href=\"https:\/\/theintercept.com\/2026\/02\/16\/daniel-sanchez-estrada-prairieland-trial-zines\/?ref=thedissenter.org\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>&nbsp;on the eve of Estrada\u2019s trial that the \u201chomespun zines at issue contain no plans for any shooting, and under normal circumstances, they would clearly be deemed constitutionally protected speech under the First Amendment.\u201d<\/p>\n\n\n\n<p>\u201cBut the government\u2019s concealment theory only makes sense if it views merely having the literature as criminal,\u201d he argued. \u201cCriminalizing possession of literature is a miscarriage of justice, whether in prison or at a protester\u2019s husband\u2019s parents\u2019 house. If the Trump administration is allowed to send Estrada to prison for the crime of possessing literature, members of society at large can be subjected to the same pernicious rules as the incarcerated.\u201d<\/p>\n\n\n\n<p>Amber Lowrey, the sister of Prairieland defendant Savanna Batten\u2014who was sentenced to 50 years behind bars for material support for terrorism and conspiracy to use and using \u201cexplosives\u201d (fireworks)\u2014<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/dec\/18\/texas-antifa-ice-detention-center\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a>&nbsp;The Guardian before Batten\u2019s trial that the Trump administration just wants \u201cto make an example of people and silence anyone who&#8230; opposes the government.\u201d<\/p>\n\n\n\n<p>\u201cThey want to silence dissent, criminalize dissent,\u201d she added.<\/p>\n\n\n\n<p>Trump administration prosecutors have also&nbsp;<a href=\"https:\/\/www.commondreams.org\/news\/minnesota-indictments\" target=\"_blank\" rel=\"noreferrer noopener\">invoked<\/a>&nbsp;NSPM-7 in the case of 15 organizers with the groups Direct Action Minnesota and Black Cat&nbsp;<a href=\"https:\/\/www.commondreams.org\/tag\/workers\">Workers<\/a>, who are accused of impeding the Department of Homeland Security\u2019s anti-immigrant crackdown in Minneapolis, where US citizens Renee Good and Alex Pretti were separately killed earlier this year by ICE and Border Patrol officers.<\/p>\n\n\n\n<p>\u201cWe live under a fascist state where ICE agents can murder us with impunity, yet we can go to prison for 50 years for protesting,\u201d socialist commentator and journalist Ryan Knight\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/x.com\/ProudSocialist\/status\/2070146458116899035\" target=\"_blank\">said<\/a>\u00a0Thursday on X. \u201cThe unjust sentences of the Prairieland protesters violate the First Amendment and infringe on our rights to fight back against a tyrannical government.\u201d<\/p>\n\n\n\n<p>Our work is licensed under Creative Commons (CC BY-NC-ND 3.0).
