The Constitution grants the interpretation of high crimes and misdemeanors to the U.S. House of Representatives. Not to SCOTUS. The Court has said as much itself,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/f9b97fbd-7cf3-4403-bff1-227ec3d9b3e4?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">ruling that impeachment is a political question, rather than a judicial one<\/a>. To the people\u2019s house. The way that mechanism is assembled feels intentional, and worth note.<\/p>\n\n\n\n<p>We elect the members of that house. We send them there to represent us, and by extension to represent our reading of the Constitution. So the question of whether a Justice\u2019s conduct is a high crime or misdemeanor was never handed to lawyers, or to the Court itself. It comes back to us, through the people we elect.<\/p>\n\n\n\n<p>I learned in the military that if you\u2019re going to raise a problem or ask someone to do something, you should come with the solution. So I learned what the impeachment standard actually is, reviewed his conduct against that standard, and then drafted articles of impeachment against Justice Clarence Thomas for the conduct that met it.<\/p>\n\n\n\n<p>The conduct in question is already common knowledge. Over the last two decades, wealthy benefactors have given Thomas&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/b8bb5ac8-7d5e-4304-b9f1-295018edd0b6?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">private jet flights, yacht voyages, resort stays<\/a>,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/82d3800e-e41e-42cb-861b-36edb739fe7d?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">real estate money<\/a>,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/75475a7a-d7b9-4bca-be54-9192ae07df29?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">tuition payments<\/a>, and&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/d6888438-6348-4c29-bf30-02ef08e11b3c?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">the forgiveness of a $267,230 loan<\/a>, and he&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/dafb0cc6-9e14-4051-bd93-ad47c3ad9c22?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">left all of it off the disclosure reports he certified each year<\/a>. He also voted in cases where&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/137b6947-d08b-475c-82ef-f176df812793?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">his benefactors<\/a>&nbsp;and&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/e4cb2e7a-25ee-46c7-834e-021904012885?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">his wife<\/a>&nbsp;held direct interests.<\/p>\n\n\n\n<p>The argument for drafting the articles concerns the conditions every Justice serves under, not just removing him from office. Right now a Justice who takes this kind of money runs little risk of being brought before Congress, put under investigation, and made to answer in public. Impeach Thomas, or open an inquiry into him, and things start changing. And for those concerned that a successful impeachment would just mean his retirement and a Trump-appointed successor: the next appointee, and every Justice currently seated, learns that misconduct will no longer be ignored. We need to create an environment where these justices don\u2019t feel above the law or above consequences.<\/p>\n\n\n\n<p>Articles of impeachment are charging counts, the House\u2019s equivalent of an indictment, and a simple majority of the House can adopt them. The Senate then&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/2fcd4f8c-9b1f-4e84-b864-5e083010b563?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">sits as a court, hears the evidence, and votes on each article separately, with a two-thirds vote required to convict and remove<\/a>. A separate majority vote can disqualify the person from ever holding federal office again. The Constitution\u2019s standard, treason, bribery, or other high crimes and misdemeanors, has no statutory definition, and the House has never adopted one. Representative Gerald Ford,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/feba4e35-2b6d-4428-af47-dfc174832fcd?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">leading the 1970 attempt to impeach Justice William O. Douglas<\/a>, gave the definition that has governed in practice ever since: \u201cAn impeachable offense is whatever a majority of the House of Representatives considers it to be at a given moment in history.\u201d<\/p>\n\n\n\n<p><a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/84463041-e18a-4d3b-8496-0e970caf32b0?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">Frank Bowman<\/a>, the University of Missouri law professor whose book is considered the standard modern history of impeachment, traces \u201chigh crimes and misdemeanors\u201d to&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/64c016af-e031-472f-86e2-10f9e1632d95?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">an English phrase that never meant indictable offenses at all<\/a>, but the kind of serious bad conduct that warranted removal from office. Essentially, the standard for impeachment is not inherently criminal conduct. This is because the House of Representatives alone decides what the conduct is within that phrase, and that\u2019s never been limited to what a prosecutor could charge. Further, the&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/80a6bd76-c23f-4d0a-9875-7352fbb3719b?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">Congressional Research Service<\/a>&nbsp;states plainly that impeachable conduct reaches serious violations of the public trust that are not necessarily indictable offenses.<\/p>\n\n\n\n<p>So we drafted four articles in the exact form of&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/f5d276ce-133c-490c-9693-05161bebdc1a?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">H. Res. 1031<\/a>, the resolution the House used to impeach Judge G. Thomas Porteous Jr. in 2010,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/94d6e7c3-611a-4537-aa75-4b4ad0d6e81a?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">the last time the Senate voted to convict and remove a judge<\/a>. Porteous was removed for conduct materially similar to what these articles charge:&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/f5d276ce-133c-490c-9693-05161bebdc1a?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">taking undisclosed things of value from people with business before his court, and making false statements about his own finances<\/a>. The articles are below, ready to file.<\/p>\n\n\n\n<p>Article I charges willful failure to report gifts and transactions the&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/f416be25-f792-46b5-8d23-87a9892a57d3?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">Ethics in Government Act<\/a>&nbsp;required him to disclose, on reports he certified as accurate, true, and complete, and the evidence of willfulness comes from Justice Thomas\u2019s own filings: he disclosed Dallas real estate developer Harlan Crow\u2019s gifts through 2003,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/dafb0cc6-9e14-4051-bd93-ad47c3ad9c22?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">stopped after the Los Angeles Times wrote about them in 2004<\/a>, marked \u201cnone\u201d for his wife\u2019s income while&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/96ecd0d9-bca6-4690-b248-07722b744524?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">the Heritage Foundation paid her $686,589 from 2003 to 2007<\/a>,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/b44b25c8-03b7-4b14-ad5f-4bcc022dfe2f?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">corrected more than a decade of forms in 2011<\/a>, and then omitted&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/82d3800e-e41e-42cb-861b-36edb739fe7d?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">the 2014 sale of his mother\u2019s house to Crow<\/a>,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/06e742c9-b77b-4e77-8291-5682dd6c216f?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">the 2018 Koch summit flight<\/a>,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/b8bb5ac8-7d5e-4304-b9f1-295018edd0b6?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">the 2019 Indonesia trip<\/a>, and the other omissions charged in Article I.<\/p>\n\n\n\n<p>In regards to the undisclosed gifts, and before most of the rest of this record was public, Jeremy Paul, former dean of Northeastern University School of Law,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/5dd60723-e420-4b76-ae4b-8cd8c08d7441?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">said<\/a>: \u201cWhat he did was just so clearly out of bounds that I don\u2019t think there\u2019s any defense of it.\u201d<\/p>\n\n\n\n<p>Article II charges acceptance of things of value from people with interests before the Court, followed by his participation in their matters. Harlan Crow, whose gifts fill Article I,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/b8bb5ac8-7d5e-4304-b9f1-295018edd0b6?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">sits on the boards of think tanks whose fellows file briefs in the Court<\/a>. Federalist Society official Leonard Leo&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/137b6947-d08b-475c-82ef-f176df812793?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">routed $25,000 to Virginia Thomas through Kellyanne Conway\u2019s polling firm with the instruction that the paperwork make \u201cNo mention of Ginni, of course,\u201d while Leo\u2019s nonprofit was filing a brief in Shelby County v. Holder<\/a>; Justice Thomas sat in that case and&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/c77ca1a0-ec69-4d13-a6a6-06766e266496?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">voted to strike down the heart of the Voting Rights Act<\/a>. The Koch political network&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/06e742c9-b77b-4e77-8291-5682dd6c216f?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">flew him to its donor summit<\/a>, and when the network\u2019s affiliates brought Loper Bright Enterprises v. Raimondo to overturn the Chevron doctrine, he&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/5ae4637e-a0af-4ded-87fb-e2768ef6d9bf?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">sat in the case and joined the majority<\/a>.<\/p>\n\n\n\n<p>Article III charges his participation, in violation of&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/a13c3194-2968-469a-9310-ba245f924cc0?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">28 U.S.C. 455<\/a>, in four cases that grew out of his own wife\u2019s work to overturn the 2020 election. Virginia Thomas&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/e4cb2e7a-25ee-46c7-834e-021904012885?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">texted White House Chief of Staff Mark Meadows 29 times pressing him to reverse the result<\/a>,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/0df95448-4d6a-4b47-9d2d-d24647e01a25?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">emailed Arizona and Wisconsin legislators urging them to substitute their states\u2019 electors<\/a>,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/bddfd681-f3a6-4169-8a50-e22a775e4d4e?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">corresponded with John Eastman<\/a>, the architect of the plan for the Vice President to reject state electors, and&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/74ce50c6-3722-4409-8b15-881f30a460b6?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">attended the January 6 rally at the Ellipse<\/a>. Her husband sat in cases about that same effort, including Trump v. Thompson, where he&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/b63f93d2-7354-4fb0-ad99-1e000369de7a?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">cast the lone vote to keep White House records from the Select Committee<\/a>, and&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/82f38c59-3492-4e27-85c4-642e403f85dd?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">Trump v. United States<\/a>, the presidential immunity case. He did&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/71266b91-d638-4e53-8b7d-0665cd7c8f31?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">recuse from Eastman v. Thompson in October 2023<\/a>, once Eastman\u2019s correspondence with his wife became public, which shows he knew how to apply the statute to matters involving his wife, and applied it selectively.<\/p>\n\n\n\n<p>Article IV charges false and misleading statements about all of the above, made&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/312f16c3-60d2-4db8-805b-2a8a57b0f386?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">through the Court\u2019s Public Information Office<\/a>,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/9cd4c783-a4c5-4863-b7fc-dc3c572afc42?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">through his counsel<\/a>, and&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/ea655364-0149-4eba-8301-d62b4a0d910d?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">in his amended filings<\/a>, in the same form the House used in&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/f5d276ce-133c-490c-9693-05161bebdc1a?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">Porteous\u2019s fourth article<\/a>: each statement quoted, followed by \u201cin truth and in fact, as Justice Thomas then well knew,\u201d followed by the records contradicting it.<\/p>\n\n\n\n<p>These are not the first articles drafted against Justice Thomas. Representative Alexandria Ocasio-Cortez&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/8dde9194-b4d8-47ca-b40c-e76c188f569d?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">introduced a three-article resolution on July 10, 2024<\/a>, charging one count of failure to disclose gifts, income, and transactions and two counts of refusal to recuse from matters involving his wife\u2019s interests. Hers was the first to put the conduct into articles of impeachment introduced in the House, and the articles here build on it, adding the benefactor-interest count, the false-statements count, the loan forgiveness, the Koch charter flight, and&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/5069f974-fd37-418d-87e1-8e89b22e923d?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">the Senate Judiciary Committee\u2019s December 2024 findings<\/a>.<\/p>\n\n\n\n<p>So what do we get out of impeachment without conviction? Opening an inquiry gives the House the ability to investigate, with subpoena power. From there:<\/p>\n\n\n\n<ul>\n<li>The investigation can yield legitimate evidence, some of which could be referred to states that may be interested parties in prosecutions, or to a future administration.<\/li>\n\n\n\n<li>His conduct goes public, and he testifies under oath, where dishonesty can be prosecuted.<\/li>\n\n\n\n<li>It pulls him away from his duties and his free time, a material cost.<\/li>\n\n\n\n<li>It potentially causes reputational harm, where the conduct merits it.<\/li>\n\n\n\n<li>It changes what a search of his name returns.<\/li>\n\n\n\n<li>It puts a stink on him that follows him into everything else, and makes other groups less willing to work with him.<\/li>\n<\/ul>\n\n\n\n<p>A House majority can start it the day it decides to.<\/p>\n\n\n\n<p>The fact is, congressional Democratic representatives are severely limited in their powers and it will stay that way barring a supermajority win by Dems that no serious forecast supports. Although&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/9b1f0584-a84e-4c08-b54f-d962398d5a43?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">Trump\u2019s disapproval is the worst of either of his terms<\/a>,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/27c0dc13-58bb-4392-9218-cf333c7897d9?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">his approval across major pollsters remains around 38 percent<\/a>, because&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/1b6848f3-2287-46c4-9d60-287d401213f2?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">Republican approval of him has stayed near 90 percent throughout both terms<\/a>. Approval that stable, combined with&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/6f5b2d99-32b8-454a-817e-74bc6bb6b257?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">every variety of<\/a>&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/0fa20498-2e2a-4cf9-9485-6ed5d26b9f91?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">election interference now in play<\/a>, does not indicate a once-in-a-generation landslide as particularly likely. But we still have elected officials in those roles, and there are still meaningful and effective ways for them to fight back regardless of outcome.<\/p>\n\n\n\n<p>The party that holds power now already knows this. The&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/29f8d16a-5fc1-4c6d-b533-10c42efff26f?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">Benghazi committee<\/a>&nbsp;ran for more than two years, brought no charges, and surfaced Hillary Clinton\u2019s private email server. The&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/30268c36-1597-4ccf-b6f9-ca7cd80c2e2c?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">2023 Biden impeachment inquiry<\/a>&nbsp;produced no articles and kept the President\u2019s family finances in the news for a year.<\/p>\n\n\n\n<p>And in 2024,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/eef780b2-9b59-474f-aa9b-a5718166ac9d?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">Republicans impeached Biden\u2019s border chief, a cabinet secretary named Alejandro Mayorkas, over immigration policy<\/a>. There was no crime; the charge was essentially that he ran the border badly. The House impeached him by one vote. The Senate threw it out immediately, no trial. And Republicans considered it a win anyway, because the goal was never removal, it was a year of border hearings, headlines, and a recorded vote to campaign on. That is the tool working as designed, for the party willing to use it.<\/p>\n\n\n\n<p>Does this set a bad precedent? That precedent is already set. Republicans have spent more than a decade setting it,&nbsp;<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/substack.com\/redirect\/82d48652-794a-4ec0-b7b2-f0cafb746947?j=eyJ1IjoiZTBpcSJ9.bWAl25BLPe62fl7RlezMOITuH1P4z_cuwPSwD9m_3WI\">with a target list that reached the President, the Vice President, six cabinet secretaries, and the director of the FBI<\/a>, and impeaching Justice Thomas would not create it.<\/p>\n\n\n\n<p>Everyone has a job in this fight, and the people we send to the House are no exception.
