@CBP @ICEgov separated the brothers based on minor technicalities and wouldn’t allow legal representation and wouldn’t allow them to speak with their family.
SF public defender intern Christelle, who works with @nikisolisSF, was supposed to pick up Christian and Vlad at SFO Saturday evening (January 16th) but they weren’t permitted to leave the airport. They were held at SFO for over 24 hours.
19 yr old student Christian Laporte had a valid F1 student visa, was enrolled at Diablo Valley College in Bay Area @DVC_updates and had legal representation. He only lacked an I-20 form=minor technicality.
He had previously traveled to the US on a visa with no problem. Immigration disallowed legal representation, took his visa & deported him to the Dominican Republic where he is not a citizen and doesn’t speak the language. He was deported late at night on January 19.
Border patrol took away 9 year old Vlad Fardin’s visa, claims he is no longer in lawful status, they can consider him an “unaccompanied minor.” and so he’s now subject to the Torture Victim Protection Act, requiring detention. He is at a shelter operated by @ICEgov in San Diego.
Vlad will likely be quarantined and kept in solitary confinement due to the Covid-19 pandemic
